    With regards to stuprum, is a civil marriage voidable if a man partakes in extramarital sexual intercourse with a 3rd party, and the said 3rd party falls pregnant?

      Consortium omnis vitae is explained on pages 42 to 44 of the prescribed textbook. You only need to study the first paragraph on page 42 of the textbook (see Study Unit 3). There, it is explained that marriage results in a consortium omnis vitae between the spouses. Freely translated, the Latin phrase means "consortium of everything in life"; in other words, the phrase refers to all the personal rights and duties of spouses, such as living together, having sexual intercourse, and being each other's companions. As the court stated in Grobbelaar v Havenga, consortium omnis vitae refers to "the totality of a number of rights, duties and advantages accruing to the spouses of a marriage”, including “[c]ompanionship, love, affection, comfort, mutual services, sexual intercourse”. This was reiterated in Peter v Minister of Law and Order, where the court stated that consortium omnis vitae is "an umbrella word for all the legal rights of one spouse to the company, affection, services and support of the other”. The relevance of the concept is that consortium obliges spouses to care for and look after each other, live together and be each other's helpmates and companions.

      Siblings ability to support their siblings rests on the siblings who have reached the majority age and are financially capable of doing so.
