  • A real estate property lien is a claim against a property to secure debts. The property is used as collateral to compensate the debts if the owner is unable to pay the debt owed.

    There are three common types of liens and each one has a unique role on a property owner's land: Mechanic's lien, voluntary lien, and involuntary lien.
    A voluntary lien is a mutual agreement made between the creditor and the debt owner. In this scenario, the creditor will possess ownership over the collateral until the debt is repaid. The most common voluntary lien is a mortgage.
    An involuntary lien is imposed on the property owner by a government body. For example, if you fail to pay back your property taxes, a lien can be placed on specific parcels of your land.
    Liens are encumbrances that can cause disaster when selling a property. If the property you're selling has a lien, this could hamper any progress and leave you in trouble.

    Excellent quality video! Thank you. Question... I loaned my aunt money to pay off her home mortgage. I had a promissory note completed and used her home as collateral. I'm have a first position lien. There are no other liens on this home. If my aunt goes into a nursing home down the road and Medicaid places a lien on her home will I be paid in full before Medicaid?

    Informative site. Years ago, my mother signed over the deed to her house to my sister and I. I ran into some tough times about 20 years ago, and couldn’t pay on some credit cards. So, a 3rd party, a law firm whom I had no relationship with stepped in and sued me for the money I owed to Macys, Home Depot, etc. It’s a Civil matter of some kind. It’s been 20 or more years. I know they don’t want a house. Can these individuals be negotiated with? I don’t even know the amount since it’s been so long. Thanks

    Hey Robert, thanks for making these videos. They're so helpful! Quick question: when you were describing a voluntary lien, you said that the SELLER puts a lien on their own house (a mortgage). Wouldn't it be the BUYER who is getting a mortgage for a new home they are trying to buy? Or am I getting something wrong?

    buying foreclosure Courthouse step. so I get a title search two weeks before auction and things checkout good, am I good to go? or is there a risk for new liens, encumbrances, unpaid taxes, utility bills Etc. to accumulate as I'm waiting for the auction? (I've been told people try to slap liens on a property going to foreclosure right before the sale. not sure if there's any weight to that)

      No. The liens transfer with the property. The seller is not obligated to settle the lien once the house is sold.

    Im studying liens right now and have a question: Once a lien is placed on a house is it impossible to sell? And does the seller always pay it off or do the new homeowners pay it off?

      Good question! Thanks for asking.
      Liens do not make a home impossible to sell. It's doable. But, it will deter home buyers from buying the property because, once they do, the lien becomes their problem.
      You can work around liens by negotiating with the home owner with the argument of "give the home buyer $x off the listing price to compensate for the lien" or "Take care of the lien and you have a buyer ready to purchase." A lien can be a great tool or a headache depending on how you look at it.

    If a buyer buys a house with a lien on it, and the seller never settles it, does the lien become the new owner's burden to pay?

      Hi, Sophia! Thanks for asking this question. You're right! The lien is attached to the title of the house as an encumbrance. So, whoever possesses the title will burden the encumbrance.
      So, what is the seller's incentive to pay the lien, then?
      Some encumbrances, such as liens, discourage people from buying the home. If the seller really wants to sell the house, they will need to resolve the lien or give the buyer the resources to resolve the lien.
      This is where the real estate agent comes in handy.
      The agent can use the liens as a negotiation tool to help the buyer get a better price for the home since there will be extra work in store for them. Alternatively, the agent can tell the seller "resolve the lien and we got a deal!" In which case, this could motivate the buyer to resolve the lien.

    I'm confused why you don't want to buy a house with a lien... Is the seller required by law to settle the lien before the deal closes? Or does the responsibility of settlement fall on the buyer if the deal closes

    So A lien is baggage on a house. so let me get this straight. A vendor puts a lien on the house so when it's Sold he gets paid 1st.
    so how was that baggage for the buyer? Do you think about what you're saying before you say it? The buyer is an affected by it. The buyer is coming up with the money that goes towards the house which the lean comes out of that money. The buyer still gets the house.

      Hi, liens are transferrable from homeowners as they are attached to the property. When the house is sold, the money is NOT paid out to those who issued the lien. The buyer may choose to pay the lien with the proceeds from the house (like what you are suggesting) however they are not required to do so. Typically, the buyer will walk away from the deal as to not accrue additional debts or to avoid additional work convincing the seller to pay off the liens.
