I got a notice of involuntary lien placed on my real property from my bank from a personal loan I took out years ago. I initially was served papers and I negotiated and was able to do payment plans, but stopped due to my personal financial hardship. Now I have a lien on my real property, but I don’t own anything so what does that mean ? Also am I still able to negotiate with my bank ? Your feedback is appreciated!
Thank you
Thank you! best video about this matter. I have a question for you. I have a criminal judgment attached on my recent purchased property from the previous owner, but the title company told me I can't pay for it because it's not in my name. How do I remove this "judgment' from the title?
Wow! That's very unusual for a home to be able to be sold with a judgment attached. Usually, Title requires the judgments to be clear before the sale. I don't know the answer to this but you should definitely consult with a real estate attorney in your state to ask them what can be done.
What would be the best way to buy the debt from the creditor? Just make an offer?
I have no idea! That's not something I do so I don't know the best answer for you.
I was trying to get a Heloc and my son is on my house. He has a judgement on his house but they also attached it to my house. My question is if I did a quit claim deed and took him off my house would they have to takeoff the judgment on my house
That's a good question! You should definitely take that to an attorney in your state. It's too specific of a question for me to advise on over CZcams but generally - if something has been lien against the home, removing the borrower via a Quit Claim Deed will not remove the underlying obligation to pay. Consult with an attorney in your state though as state law might be different where you live!
I'm trying to get a HELOC and a lien popped up that I didn't even know I had! I'm willing to just pay it, how do I go about that? Can it be paid at the closing? Do I go to the magistrate's court and pay it? Thank you!
It probably can be paid at closing but since I don't know the specifics of the situation - the person you should ask is the closing agent or escrow agent handling the closing. They will likely know how to get a payoff statement for the lien and tell you how it can be paid.
@@nadiakilburn-mortgageforec3635 Thank you for the advice!
Can this affect both spouses credit if my wife did not pay her credit card and property is in both names?
Potentially, yes! You should ask an attorney in your state about it.
Thank you very much
Cretid cards are not allowed to put a lien
That's not always true! As long as the credit card debt remains unsecured and the company does not sue to place a judgment on the property - they will remain unsecured. Credit card companies can file a lawsuit against homeowners for unpaid debt and they can lien the property but they have to follow the state specific rules in order to do so.
