  • The plaintiff says she was training for the Boston Marathon when the defendant’s dog viciously bit her on the back of her tricep, and the defendant yelled at her. She’s suing for medical bills, medicine, and a torn shirt. The defendant says her sweet dog was on a leash, and the plaintiff grabbed the defendant’s derriere, so the dog went into protective mode.

      Having dealt with a brilliant father who developed vascular dementia the last 7 years of his life,I think it’s finally dawning on this husband that his wife needs to see a neurologist.
      To me , he seems caught off guard.
      With the slow decline of dementia ,little signs pop up here and there ,until there finally comes an event that can’t be explained away .
      IMO, we are watching that moment the husband realizes he can’t explain away his wife’s behavior and it’s all caught on tv.

      The whole thing is that it's not the dog it's the owner, and if she couldn't tell if it was a girl she's blind. A dog or any type of animal that is not contrable by someone needs a new owner. I was attacked by my own dog in the middle of the night. A pitbull. He just turned we think he was thinking he was playing. My brother would get rough with him I wouldn't. He bit my neck but when I said drop he let go immediately. He was gone the next day. It's not the breed it's the owner. Train your dog don't let me it train you.

    At first I felt as if the defendant was just trying to avoid responsibility. But after observing and listening to the numerous times she said she forgot, her mix-up with the separate victims, I'm beginning to question her mental faculties.

      And the husband doesn't seem to give a damn as long as his dinner arrives on the table when he expects it to. For now, his wife is still able to function inside her own home without leaving the stove burners on until there's a fire, but for how much longer is that going to be the case? He needs to wake up and start managing her increasing impairments before someone gets fatally injured or homes go up in flames.

      She was too nice. She should have gotten more for pain and suffering but I think that is the maximum amount in small claims. I could be wrong but she deserved more. She had to have been in fear for her very life. You know that dog has attacked other people and the woman "forgot" about them too. When pits kill, their owners always say, "he never bit anyone before" and in reality they have either "forgotten" or discounted other attacks. When confronted about other attacks they either defend the dog "oh he touched my rear end and Poopeeskins was just protecting his mommy" or say, "Oh I forgot about that one" or "it was just a scratch." Pit owners are often delusional and the more violent the pit, the more delusional the owner.

    What irritates me, aside from innocent people getting hurt, is that irresponsible dog owners like the defendant are putting their OWN pets in danger of getting put down if they continue to let it happen. Animals are animals; it’s up to the owners to make sure they don’t put pets in environments they can’t handle so the pets don’t get taken away or put down.

      True, I make sure my German shepherd has plenty of free running time, NO LEASH. Unless it's too hot--He runs or walks at his own pace, stops to sniff everything, almost an hour near the woods or fields before we go out in the car to stores. I also give him big chucks of fresh beef liver from the butcher, not just dog food. He loves to tear into it like a wolf, he's 11, never bit anyone.

      she should have sued for the maximum small claims amount and she would have got most of it . she could have received pain and suffering money and not just medical bill money because a dog bite can cause pain for years after it happens because the force of the jaws are so strong that it usually injures alot of nerves and muscle fibers . these old people are disgusting . they probably have all kinds of money saved up and they would cry bloody murder if their social security check was ever late . they make me sick .

    $1000 isn't enough. $2000 bare minimum. The judge shoulda added money for the plaintiff to try to get scar removal treatment since the plaintiff seemed unaware that the scar would be permanent, and the judge realized it immediately.

The plaintiff unlike others just testified factually to what she experienced that day with no embellishment. The plaintiff was only asking a fair amount in damages. $380 for pain and suffering is such a small amount. All her other damages were reasonable and demonstrable.

    It kind of bothers me when people say to train the dog. Training your dogs does not stop dog attacks at the end of the day. Your trained dog is still an animal. And you will never have full complete control over the dog unless it's under control by a leash and/or behind a fence. You cannot 100% guarantee what your dog will do. Unless like I said, it is completely under your control.

      Yes, but there’s a reason some animals are considered domesticated and some aren’t. If training a dog can be effective in preventing attacks 95% of the time, why would you not train it?

    Unbelievable that the dog wasn’t taken “into custody.” Animal shelters here in Los Angeles are filled with aggressive pit bulls who have attacked people. They’re held in quarantine, typically euthanized, and rarely given back to the owner.

    The plaintiff was amazing. So in control and with a sense of humor towards the whole situation. The defendant's husband likely walked out of that courtroom wondering "who the hell did I marry??" Total embarrassment!!!

    i am a pitbull owner and holy cow...this defendant makes us look terrible. i've never had an issue but knowing it could and peoples feelings towards pits i do everything to protect everyone including my dog because ultimately it's on me as the dogs owner.

      I used to very afraid of pities but many years ago I went to visit my sister and she had a pittie mix. Turned out that dog was the most gentle dog ever! Changed my mind completely as it seems to me that dogs of any breed can bite, etc. due to how the dog is trained.

    She got super lucky with a dog attack. I was mauled by a dog last year and the bacteria from a dogs mouth almost took my leg. Not to mention you have the rabies shots that go with it.

      Maybe but the plaintiff asked for a small amount which I suspect weighed in her favor as being a fair amount. If she asked for $5,000, Judge Milan would not have granted that.

    I agree with the judge people need to learn to control their animals. That young lady didn’t ask to be bite. There was a time I was walking in a park and three dogs rushed me I didn’t know if they were friendly or not then I see the owner running over apologizing like why your dogs running loose.

    My ex recently let a dog pull my son off his bike and bite him. By "let" I mean this: she went to the owners house, confronted them about it, they admitted it and said sorry.... she did nothing else. Didn't call the police or animal control on this dog that was running the streets biting CHILDREN. I was blown away. Next week I went by and that dog was outside unleashed no owners around. I had to instruct my kids to not play outside at their own mothers house because she was fine with them being bitten. So sick of people not taking responsibility for mean dogs! That dog could bite any other kid at any time, and my ex will be partially responsible. She thinks I'm just being mean to her about it... smdh

    This whole case disgusted me. The non-chalant attitude of the defendants was infuriating. If I was the plaintiff I would have called animal control immediately. She also seemed to be downplaying her own pain and suffering, and that bothered me too. She would explain her injury, then finish by saying it wasn't that bad. I felt the judge was more irritated by the bite than the plaintiff was. Either way, the defendants obviously don't deserve a dog. I'm glad the plaintiff prevailed.

      Yes I get what you are saying, she seems to be a sweet girl, she was very polite toward the defendants even seemed a little sorry for them, I'm not sure if they are a little senile or just wicked people.
      And this was the first time I have ever seen the judge award someone for pain and suffering, the judge is clearly frustrated with these pitbull cases.

    They should’ve known the judge was not gonna play with them when it comes to pit bulls. She’s already not into them and to know that it’s bitten someone before that just wasn’t good at all. These ppl don’t need to be owners of the dog. It’s to dangerous for others. If they can’t control the dog they need to give him to someone who can. The judge’s decision was spot on. 👌🏾
