Dude literally just said “no” and people are acting like he insulted Theory. He simply responded to a question and answered it truthfully as well. This says absolutely nothing about whether he likes you, or not. He was asked a yes or no question, and gave an objectively true answer. He wasn't asked for permission to use his likeness, so he said as much. That's it.

@@ResidentRecon89 This is incorrect, the actors' and writers' strike served to establish that unauthorized AI deepfakes of actors are in fact illegal and can be pursued by law. It's no longer fair use to make deepfakes. That was one of the major pillars of the strike and one of the biggest wins from it. Disney could sue his ass into the ground, and so could Mark, over this, and I believe they should to make an example.

To be fair, this is what many actors were striking against; using their AI likeness without permission and without being paid. Sure, it's different in terms of a fan film, but it can still be a gray area. Maybe the safest bet would be to contact him and ask for permission, he may even respect that. That way none of these haters can complain that you didn't at least try.
Just ask for permission. Thats all I ask for when it comes to fan films that use a person’s likeness. Whether its for good or bad just ask for consent.

Personally I wouldn’t want someone using my image without my permission for a project even if it’s not for profit. It’s like that episode of black mirror where “Netflix” uses the likeness of a viewer for content.
Actors are public figures. If you don't want to have people imitate your likeness, don't go into acting, stay a private citizen.

Copyrighted material can be used without permission for purposes that are critical, educational, informative, satirical, or transformative. This rule applies to images of all people out in public. Remember, in the 2000s, and everybody loved to make fun of President Shrub, they made profitable plays about him, sold paintings and anx books and made mviez about him without ever asking permission Not to mention satire! However, it is illegal to take private pictures of celebrities and sell them to tabloids-- That is one of the reasons why the paparazzi are so hated. You also can not steal personal photos from a celebrity and release them and sell them for profit.
Actually, even if you are a nobody who is out in public but is caught on camera picking your nose, the person who photographed you can
plaster your image on the front of a magazine or website and make money off of that. They don't have to ask you for permission because when out in public, we have no right to privacy.
However, with respect to artwork, the courts have long ruled that any reproduction that qualifies as educational, informative, satirical, or transformative art is part of your First Amendment rights of free speech and thus you are immune from liability for violation of privacy or publicity rights. In regards to fan art, so long as you are not directly making money from that, it's perfectly legal, and you never have to even ask.
However, commercial reproductions of artwork or public figures in a film or play, etc. is in public, but the copyright holder of the actor in that role or performance--who is rarely ever the actor--has sole discretion to grant permission or not, If the person using the image wants to use it to make money. SWTheory is making $0 from his fan films and is financing it all on his own. Therefore, he is well within the bounds of law.

Theory, these are difficult times when it comes to acting and AI especially. Love your content, but I think it would at least be the decent thing to do to give word to Hamill what this was about and that it wasn’t meant to be dishonest or disrespectful.

The strikes over it literally just ended, it's a very sensitive topic for actors because it can set a precedent where anyone can use their likeness without compensation or approval. As a person, that has to be a really weird thing to see and be used like that. I believe getting permission on these things from the actor is important for this. I believe you should have tried to do that, and I don't believe this means Mark hates you. I get this really sucks, but just try to be careful going forward
It's irrelevant what Mark thinks on this topic anyway because he doesn't own the rights to his likeness when referenced as Luke Skywalker. He signed that away a long time ago. SWT has an agreement with LucasFilm who do own the likeness rights.
The stuff with the actors strike also isn't relevant because SWT isn't part of the industry, nor is he in any of the relevant unions. Those agreements aren't legally binding to the wider population because it isn't a piece of US legislation, just a contract between private entities.

Deepfake still works best on the OG actor it’s trying to deepfake, and deepfake are still best used to make someone younger.

SWT doesn't have any rights of use for Luke Skywalker either, which is why this is a big deal and one of the reasons the actors strike happened, because of unfair usage of their public image in AI

As a big fan of your channel for five years, I do think there are a lot of unethical aspects about using AI deep fake and voices. I feel like using an actor who sounds like Mark Hamill and either using (real) art or animation would go a long way.

The storm-troopers are suppose to invoke Nazi storm-troopers. The prequels took on imperialism and cold war-ism. Denying Star Wars was ever political is just plain false. If you truly knew what Lucas wanted you would never claim otherwise.
Its like people complaining that Xmen is going to be about inclusivity and not mindless action- Xmen was always about that. Disney didn't add politics to Star Wars or inclusivity to Xmen. Always been there. Light Sabers have never been an instant kill weapon. Sabine was hurt in a far less serious area than Qui-Gon, and neither of them died instantly. Luckily one was in reach of a bacta tank. Yet Disney is getting screamed at "you don't understand light sabers!". Lucas established the trend NOT Disney.
The fandom drove Lucas away with its divisive trollness. There was a movement to take creative control away from Lucas and not let him direct anymore Star Wars movies. Even music videos mocking him. Remember the "Han shot first"? controversy. That was Lucas, NOT Disney. The fandom had already become toxic. People accused Lucas of wanting to cash in on new action figures and dolls of Ewoks in Jedi instead of using Wookies. Check into what the actors playing Anakin and Jar Jar from the first movie had to go through and the damage it did to them, That all happened because of the fans LONG before Disney took ownership.
So stop saying you know what Star Wars was when it flies in the face of historical fact. Disney is just carrying the torch started by Lucas. If it doesn't hold up to your fan-fiction, that's on you not knowing Star Wars. Or whatever IP you seem to want exclusivity in liking. I like that Star Wars is gaining new fans. That means it will continue to be part of the social zeitgeist. It will continue to entertain and inspire kids and adults throughout the years. Even if Anakin, Luke and Rey are all Mary Sues.
That said Star Wars Theory, I do support you making your fan fic if you aren't monetizing it-OR using likenesses of real people. Using likenesses implies those people approve of it. If your fan fic was hypothetically doing something really offensive, just using Hamill's likeness would tie it to him. So I see why he said no-just to play it safe. After all, you wouldn't want someone making a deep fake of you for a pedo movie, right? OR a movie with a deepfake of you saying Lucas was a Nazi and the original movies sucked. Actor likenesses is a really touchy subject right now, and part of why there was an actor's strike. Play it safe and keep it non Deep-fake. And Mark I'm sure will still like you and continue to like you. And hopefully you will someday be OK with newer fans finding joy in a galaxy far far away just like you did and hopefully will again some day.

With all the criticism George got for decisions he made, show me one occasion where he went after the fans, calling them racist, sexist, misogynist, bigots or any other -ist or phobe you can think of… and I can’t recall Harrison Ford or Carrie Fisher or Mark Hamill (pre-Disney) doing the same either.
Fans criticise because they care, and sometimes they go overboard. George, unlike the snowflakes at Disney, knew that you can do one of two things, either push back and tell the fans that *they’re* the problem, which only makes the problem worse, or you can take it on the chin and move on. And with all the criticism fans have thrown George’s way, they STILL love him. There are problems with pretty much everything else you wrote but hey, you’re entitled to bark up the wrong tree, but when it comes to politicising SW, this is what I meant, and there is no doubt that while certain fans may in some measure have turned against Lucasfilm under George, it was under Disney that Lucasfilm turned against the fans.
