This actually happens far more frequently than people realize, and sometimes by automated systems. It should be illegal for car rental companies to report cars stolen within a reasonable time, e.g. 5 to 7 days after its expected back, because often people extend their rentals and the rental companies' systems are so bad that they accidently report it stolen. (2) There was no way to know who was driving that car when it was pulled over. The only thing the officers knew was that the license plate popped up as "stolen" in their systems. The driver eventually shares his story of a "Black man being pulled over in OC." Perhaps if I were of similar ethnicity, I might react the same way. But, how does bringing race into a situation where it had nothing to do with the situation help anyone? It gets picked up in media as a racial thing and then just keeps perpetuating stereotypes as if they are universal. I'm glad they published this video so people can see exactly what it was. A professionally executed stop by a police officer doing their job as required when they encounter a car that their systems say is stolen. (3) Even though I'm sure we all wish this didn't happen, I'm glad that he complied with the police and that the police acted professionally and reasonably. I can't imagine what impact that would have on a person, but mistakes are going to happen, period. No way around that. This is great example of when both sides act as they should, mistakes can be dealt with quickly and easily. (4) I do think the driver should file a lawsuit, but not against the police. He should sue the car rental company. The police did their jobs as mandated and trained. The fault for all of this rests with the rental company for reporting the car stolen. For that rental company, I have no sympathy and hope the driver gets a fair settlement. They’ve mentioned race because of the extra psychological damage being stopped by police causes. Unarmed black people don’t always survive encounters with the police - this guy almost reached for his waistband instead of his collar… others who’ve made that mistake aren’t here today. It’s an objective fact that race plays a role in how LEOs treat you. So him and his wife being terrified in this situation is reasonable. KIA should settle the lawsuit with this extra damage in mind because there’s no way they’re not at fault.
