- The Justice system in the Elder Scrolls series leaves a lot to be desired. A lot of punishments for the crime are arbitrary, and each game Daggerfall, Morrowind, Oblivion, Skyrim and Online have their own quirks when it comes to how to deal with criminals and fugitives. Dagoth Ur is not exactly happy how each and every one of them works, and is not afraid to criticize the crime and punishment systems of the Elder Scrolls Series. This was a fun one to make! I hope you enjoy it as much as I did. This Elder Scrolls Lore bit is surprisingly not talked about a lot, but it has the most interesting outcomes. I hope you enjoy! Thank you for 13K Subscribers.

Oblivion has an indirect death sentence: if your jail time exceeds a certain number, the game will crash.

Feeding as a vampire, 40 gold
Turning into a vampire lord 1000 gold
Look like everything with grey skin is subject to the N'Wah nord's unjust racism

Like a big combination. The idea that different areas are persecuting separate is super neat. Combine that with the Daggerfall complexity.
You forgot that in TES4 Oblivion touching or lifting any item on a store or house will count as an act of thief.

If you uninstall broken mods, the crimes you committed in those mods TRANSFERS into vanilla game! My Orc Battle-Preist is still serving his 43 life sentences for genociding a doom cult. Hero in mod, terrorist in vanilla.
The greatest crime is that were still waiting for Elder Scrolls Six. This does not honor the 6th generation and the players unmourned

didn’t know Daggerfall’s legal system was that complex. I want them to bring back that Illicit Substance and Conspiracy to Commit Crime bounties for ES6.
Would make playing a thief both more exciting, harder, and more satisfying. You’d have to plan your heists to not get caught so you won’t have the lingering threat of Conspiracy to Crime and have guards watch over you more. Along with a potential thieves guild side side-quest line for skooma and other drugs.
Legalize Skooma!
While we wait for Bethesda to cook up TES6, I'll be exploring adding scripting to Morrowind for some of the legal system. IDK if it might need the extended support of the different forms of Lua scripting in the MGSE or OpenMW engine tho.

Skyrim's chicken honors the 6th house and the Tribe Unmoarned.
In Skyrim I keep 1000 gold in reserve and the Whiterun Thane Card for two reasons-
1- Straight up killing that vampire in Rorikstead for Dawnguard cause it's too much of a pain to stealth kill him.
2 - Nazeem and I don't care who sees the act.
I knew he was going to mention the chickens, and it did not disappoint.

I raised my thumb and wrote on the partchment below to honor the 6th house and the tribe unmourned.
I remember the first time I killed that farm tool Ra'Virr in his shop in Balmora. I remember a guard asking me for 40 gold afterwards as compensation for the murder. I remember laughing.
No witnesses...to the murder he yelled " help help I'm being attacked" 40 gold bounty then died
Guess who will have to clean up the crime scene. You're paying the guard for the paperwork
To be fair, lack of trials in Morrowind could be due to the government/Imperial Dogs/Tribunal throwing a hissy fit resisting your glorious Bligt, in Oblivion there is no emperor to further enforce the trials, with the police force being left to their own devices and Skyrim is in a civil war, and you start that game almost being on the recieving end of an executioner's axe
Morrowind can aslo be explained because Nerevar was reborn as an Outlander, farm tool or not, and all three games have the heros start as criminals, while Daggerfall has you be a close friend of the Emperor, so you'd be put on trial because of that
Edit: Also of note, in Arena guards straight up kill you because at the time, Jagar Tharn is ruling as a dictator under the guise of Uriel, so he'd sent out messages to have you hunt down, only the guards would still need to adhere to their own laws to prevent a mass uproar and just let the more discreet mercenaries do the job
What a grand and intoxicating innocence! In TES: Arena, you are actually getting punished for attacking citizens, or when attempting to steal from the trader. The guards just appear silently and attack you when you do that. Also, when breaking into a house, enemies spawn infinitely, though I am not sure if it is for justice or the game just throws enemies at you without reason.

You forgot to mention the fact that in oblivion during a certain questline if you use the associated dialogue option that's normally supposed to help you find people to testify against the corrupt guard to said guard, he accuses you of assault under bogus charges and the fine is much steeper than a normal assault charge. I think it's close to the murder charge in terms of bounty.

= Abduction will get a culprit a death sentence (example given Rochelle the Red);
= treason is punishable by death (in example, Ulfric in Helgen);
= openly supporting for local regime's rival faction will make you disinherited and branded as crazy at best (e.g. Saerlund) or thrown to jail (e.g. Threki the Innocent in Riften or Bjartur in Castle Dour);
= being Reachmen during Ulfric's reconquest of Markarth;
apllicable to Player Character :
= openly worshipping Talos sends you to Jarl's cell at best (example given Heimskr) and sent to Northwatch Keep at worst (example given Thorald Grey-mane). Though you can argue about that to people who care abut that rule, in essence wandering Thalmor agents, about that. With steel, magic, and shouts;
= Fine for stealing a horse is now 1000 Septim;
= Dagoth might like this. Khajiit are forbidden to enter Skyrim's cities and Argonian are forbidden to enter Windhelm. Not applicable Last Dragon and their companions.
So all khajiit are not allowed in the cities? I heard only khajiit in the caravans are banned but individual khajiit are not
Some say j'zargo can be found in the college so khajiit are allowed but others say the college is not part of the city

@@saadmohameed8340 I believe they are not allowed according to Ahkari's claims. Winterhold College however is independent enough that they can shelter Khajiit and a Thalmor agent (Ancano) in Stormcloak-allied hold at the start of game.

How's Heimskr an example? I've never seen him being sent to jail no matter which side I choose in civil war. Also, poisoning is a crime, sentence - unknown amount of time in jail (Sabjorn).
It's honestly incredible how if tes 6 was announced to have half the features in daggerfall we'd STILL be hyped. Sure was a game ahead of its time.

One thing I would like to add, in the land of Skyrim, sticking your hands in someone's pockets is not a crime as long as no items are removed. What are these nord n'wahs doing with their inferior lives? At least they know how to treat farm tools.
And leaving someone surprise gifts in their pockets is also a crime

The loophole in Morrowind is that a guard attacks you first becuase of a death warrent, you can kill it with impunity as it counts as self-defense. So an OP character can basically get away with anything by right of might. Also I got plenty of free ordinator gear to pawn off to the mudcrab merchant by triggering their auto aggro by wearing their armor.

A well-constructed justice system is fantastic for gameplay and roleplay, almost necessary even
Maybe a new crime could be added in ES6. Public indecency, for people who walk around with no clothes or armor on.

Make it depend on the location and the guards. Some people might be okay with a good view.
Turning into a werewolf in town in Elder Scrolls Online will get you KOS status with guards as well.
One thing Dagoth Ur forgot to mention about ESO is that the guards are harder to kill than the false gods of the Tribunal

Those Ordinators deserve the suffering of seeing me in their armor, that’s what they get for not honoring the Sixth House and the Tribe Unmourned.
There is one instance of a death penalty in Oblivion but only in the final mission of the Thieves Guild. If you're caught trespassing in the upper floors if Whitegold Tower, you're sentanced to Death.
I could have sworn in Arena you can still get chased by guards if you murder somebody.
I know that breaking in houses or stealing also warranted them chasing you. You can get them off your tail by simply entering or exiting a building. Deadra Dementia is real 😔.
I hope there is a justice system of some kind in starfield. In the elder scrolls games there is some kind of due process in place if you commit a crime, depending on the crime and if it's petty enough you can bribe your way out of trouble or sneak out of it. In a fallout game if you accidently pick up something off the floor that belongs to somebody the whole town is just going to open fire on you whether or not they're a guard or even saw you do anything and it just takes you out of the game to reload a save. The elder scrolls games have something going for it when it comes for crime, sadly the fallout games didn't. I hope that there is something for crime in starfield.

Oblivion introduced me to the Imperial Guard and they follow you into oblivion for a 40 gold coin fine. Say what you want about the Empire, but the discipline of their soldiers is exemplary.

If you are not a member of the faction so you get kicked out, 5 gold is half the price of a bed in an inn, totally worth it. If you made sure the guards like you enough in Oblivion they sometimes pay your fines.
Got arrested in Skyrim just because of bad attitude.
In Daggerfall I can't show my face in the regions Daggerfall and Northmoor without getting arrested.
Have a low bounty? Just agree with the guard that it isn't worth pursuing and they will look the other way
