Homeowners want HOA dues refunds for amenities they can’t use

  • Neighborhood pools, gyms and clubhouses are closed. These are amenities most homeowners pay for in their HOA dues. Now, some of you want to know if you will get a break or a refund for the amenities you can not use.

    I don't care how nice the house is, the area is, the amenities are, if a HOA is involved - NO DEAL! END OF DISCUSSION!

      Some of them believe that, if they (the HOAs) get a fine from the state for breaking drought laws because they want the gardens watered during drought restrictions and get fined by the state or actual law enforcement, they believe that the fine is recoverable from the homeowners themselves and not the board’s own personal coffers - even try to force court costs out of them and lawyers’ fees and suchlike! It’s one thing for them to have to pay the fine for breaking the law, but, in their mindset, they think that they should not be out the money - they believe that they can either make that homeowner who “caused” them to be out of pocket reimburse the HOA for the fine and related costs, or increase the dues to offset it - totally forgetting that a fine is a punishment for breaking the law and cannot be claimed as expenses or whatever - there’s no insurance you can get against being fined - you can’t claim off that!
      Thank goodness we don’t have homeowners’ associations here in Limey-land - most housing estates are either council ones or housing association ones - or managed by a landlord - anyone who owns their own property lives in a remote location, for the most part!

      @@arthurvasey unfortunately they are well with in their right, lot of hoas have a subclass in the contract in which you sign stating that you the home owner is liable for any actions taken against the hoa. One hoa I know of was sued when they failed to maintain a swing set on their property which they owned, they lost a 20 million dollar case which they just passed off to the home owners. Every home owner was on the hock for 80,000.

      But sometimes you cant avoid it. People cant spend an extra $10,000 just to live in a non HOA neighborhood. Especially during these times.

    $720 every 3 months, wow. Its private property though, cant they do whatever they want. HOA's suck anyway, I want to do whatever I want on private property.

    I don’t live in an HOA and my home increased by 15% over the last 7 months. I’m a grown man. I don’t need a babysitter.

    The only thing I've ever heard of the HOA board 'working with' ANY homeowner is to give them a hard time. Some may think that the HOA is a good thing. If there are any in this country, I've yet to hear about it from any source.

      Actually depending on where you live. It may not be possible to find a Neaborhood that's NIT AN HOA!!! So you may have no choice ..... Which compleatly sucks

    Our HOA literally started fining every owner for every little thing, then significantly raised the dues during and right after the Covid crisis

    We are working with our HOA and we have requested a special meeting, and a yearly audit without a response. They also would not return our HOA amenities fees.

      I know but, it's not that simple. 95% of the new properties have HOAs, so everyone can't get one without a HOA.

    Empty the pools of water. that way very little money will be needed to hire someone to come clean and do chemicals on the pool every 2 weeks.

You wont need them if you drain the pool of water. Is what I wrote. For Pools that have water, you either have to add the chemicals your self every 2 weeks on avg. Or Hire a Pool person to come every 2 weeks on avg to clean and do Chemicals.

    Thank you. My HOA kept the pool closed. In may 2023, this year they checked the pool and said it was in need of repair. . Then when it opened they locked us out. The locks are "repaired' but the gate was broken so the un housed use our indoor showers that have new locks. And probably the pool too all at night.
    So for years they've been charging us for that pool
    But yet it's been locked up most of the last five years I've been here and they keep talking about closing it down.

    Make sure when you buy the home,your told about it at time you buy it and not getingt a suprise once you close,and move in later.Especially when you never sighed the buyers to join a association.

    We don't even have any amenities and our HOA is $425 a year. HOA is ridiculous!!

    They need a percentage returned, but pools have to be maintained, lights have to be paid, maintenance worker has to get paid and property management company still has to get paid. With COVID, they will have to spend more in cleaning and disinfecting. Luckily for our community we only have a tot lot and tennis courts,

    Buying into a condominium/townhome multi family unit is a total RIP OFF with Regime Fees PLUS HOA Dues. It is like having a mortgage on your mortgage. Once you pay off your mortgage, you still have a mortgage with the Regime Fees and HOA Dues. AVOID...

    I never thought I'd agree with an HOA, but if the state has required certain amenities be closed, and the operating cost remains roughly the same, then I don't think anyone is entitled to a refund. If the HOA decides to close the amenity, then they should provides refunds.

    Most people in an HOA are being victimized. The board overpays intentionally for labor and materials to receive a kickback. Proving this is very hard but it is very common.

    HOA's simply aren't required by law to return those fees. While they should on moral and ethical bounds, they simply aren't required to. The maintenance costs don't simply go away because everything's closed and that's the one thing people don't understand. Refunds might be issued if the amenities were being denied to some homeowners but allowed for the rest but this isn't the case.

    Don't get move into an HOA ran neighborhoods and complain when they act like they have always acted. If you moved into a regular ran neighborhood and saved what you would pay in HOA fees. You could save 500,000 in 15 years

    Yes! Homeowners are required to pay monthly HOA no matter what the consequences, this is to maintain the amenities (cleanliness most specially)! I pay my HOA dues to our vacation homes even if we go on vacation, or, not!
