      Check into the audits. Most HOA's are required to have regular audits by outside CPA.

    That could of been easily won in a small court. She had hard evidence that she made every payment. The bank would back her up and then she could turn around and sue the HOA for harassment.

    If your bank shows you made the payments they cant do crap. Now you go get an attorney and sue them for your wasted time. Make them pay you for stress and emotional damage.

      nah my uncle paid through his bank and his HOA did the same thing to him. he started to get mysterious damage to his property. he installed a security system and saw it was one of the HOA's kids. he had to call the state Attorney general on them.

      They need to initiate a suit against the HOA, so they can get the HOA pay their attorney fees. If the HOA sues, then they can’t get attorney fees reimbursed. This is standard practice.

      Yes you can hire an attorney to sue for emotional, physical or property damage if you can prove they did that to your property.

      I live in a neighborhood with covenants. Something similar to HOA, with special rules and restrictions, but without the members and fees. It's something the builder put in place with the county when he built up our neighborhood. What's different for us though, is if someone doesn't follow the rules, it is up to an individual in the community to take legal action against them if they don't like the rule they are breaking, such as a boat parked in yard, cars parked in street, etc. But, unless someone complains and decides legal action is needed, it's basically a do as you please type neighborhood. We have the protections in place should things get out of hand, but we also have our own leniency.

      Nobody can request IRS to audit anyone. State's attorney journal or local sheriff department probably could be of help. Send a notice through a lawyer. That works the best.

    This reminds me of what happened to my wife in the 70's. She is a veteran and was receiving a VA College benefit check every month or whatever. Anyway, at one point she didn't receive it so she called the VA and asked about it. They told her it was sent and that she was going to have to prove she DID NOT receive it. Good luck with that. So she visited our local congressman's office and explained the situation. As I recall, about a week later she received her check. That was back when our representatives cared about their constituents.

      I feel so sorry for your wife. I served with the 101st Airborne 2/502 Inf Vietnam and plus 7 more years Army before in 79' moving to Australia to teach. Fighting the VA over a the little we got for college, compared to what people got after WWII sucks. I worked with many of those WWII vets during the 70's and to hear their stories about what their benefits were made me so very angry. Now to listen to this poor veteran fighting an HOA, is shocking... time to remember those combat skills and maybe remind that HOA of them ... LOL ... one can dream.

    That happened to me. The HOA lost my check, then I repaid it with late fees, then 2 years later they found my old check, cashed it and never applied it to my account. Total incompetence!

    Disputes with the bullies running the HOAs should be settled by the homeowners suing them in court for a legal solution and transgress well as legal fees. When enough HOAs are sued often enough, they will go out of business and maybe even to jail.

    Always pay your HOA dues by check so you always have a paper copy or cancelled check from the bank account to prove it. Especially if it's an off site HOA management company.

    This happened to me although not as extreme. But our HOA treasurer called me and said he had not received payment for the association fee. I said what do you mean I hand delivered it to you. He basically called me a liar. I went to my bank and got a copy of the canceled check and hand delivered it to him. I honestly think he was in the early stages of dementia. I think he must’ve made a few more errors like that so wasn’t handling the money much longer.

    the problem here is there was no notification from either side, to the resident, that there was a technical error and it wasn't her fault.
    technology, no matter how advanced it is, will fail. this is why, once i am out of debt, ill save up for some land, and barter as much as i can for the building materials for a new home.
    no HOA bs, no city bs. county property near joplin mo or no dice!

      Nearly 90% of new homes around the Vegas region are mandatory HOAs, no other choice! Since HOAs are magnets for corrupt narcissistic control freaks, many of their abuses make the news so LV needs a special show "Hall of Shame" just for them! Proof that HOAs make false promises of raising property values, foreclosure rate in LV 2nd highest in U.S., because real estate market/economy decides that!

    The Law should be changed that the HOA cannot foreclose on a home, the mortgage lender should be the only one to have that authority and so the HOA has to contact them and only if they think the HOA has a case can they sign off on it.

    If an HOA tried to take my home I would simply be ready to violently resist their efforts. I don't recognize the authority or legitimacy of the law that gives them that right.
    Thankfully I am not enough of a brainlet to ever buy a property owned by an HOA.

      In a lot of cases they DO NOT OWN those properties< they just manage them. Don't see how an HOA can foreclose on a property they just manage? Makes no sense. Kind of like an insurance company selling your car when you miss payments!

    Listen here I have been paying my mortgage every month
    I have electronic records that show that very clearly.
    If you try to evict me I was sue you.
    An I don't have to pay HOA dues because I never agreed to pay them.
    My lease doesn't state anything about HOA dues.
    mainly because I had my lawyer remove that entire section.

    My current HOA is the reason I’m selling and I won’t be involved with an HOA even again.
    HOAs end up with people calling the shots who have NO BUSINESS being in charge of anything. And definitely not in charge of my home.

    Last year I moved from one of the wealthiest neighborhoods in the area (with an HOA) to a working class/lower-middle-class neighborhood (sans HOA) in a more central location. Barring some insane circumstance or deal, I will NEVER live in an HOA neighborhood again!

    If I pay you cash and you hand me a receipt, that's it, my responsibility ends there. I don't owe you another payment if you rip up the bills, misplace them, the lockbox is stolen, whatever.
    If your online payment system isn't set up correctly (not depositing to the correct account or whatever), that's on you as the business, not me as the customer.
    I really like bravobob1's answer: "They need to prove the payment was received? I'd tell them , 'Ok I'll have the IRS audit you. I have proof I paid , do you have proof you DIDN'T claim it on your taxes?'"

    Ok the owners have paid an done their due diligence. Now just send them a lawyers letter of intent, a trick from their own playbook, telling them to either find who received/stole/misappropriated the money sent to them electronically on your behalf in good faith. Only to be harassed constantly? That just one more attempt to collect again will be considered undue harassment and you will SUE for triple damages!

    the owners have chase bank they can print a copy of the checks cash on both sides i had same issue with my rent payment i emailed copy of cashed check to my apartment manager

    Should have filed a case against the bank linking this with the HOA notification. Let them fight each other.

    Vegas is pretty sketchy i had a rental company sell their house then when we attempted to sue they were nowhere to be found, the whole company took our money and ran
