    Hello Ms. Nancy,
    My current employer has 90 days notice period. As per my employment contract it says " In the event of your giving a notice of termination shorter than the above period, the Company shall have its own discretion to
    adjust any leave due to you or recover from you such amount from your dues towards the shortfall in the notice period."
    I want to exit in 30 days. How should I approach my manager with this. I'm ready to provide refer my replacements for my position

    Hi, I want to quit to do my masters and I have no spoken to my manager about this. I plan to resign only when I have confirmation of my admission for masters. but in that case, i won't be able to even serve notice period for a month since college will start within 3 weeks. will the company understand and relieve me within 2 weeks?

    Hi madam, I worked one of the company for 8 days and formally have tendered my resignation nad handed over my laptop to IT team and got confirmation receipt of Laptop.. i am in probation period supposed to serve 1 month but i had worked only fir 8 days.. please advise will they recover the salary or fail a case on me..

    Thanks for information.
    In my offer letter, It mentioned a 3-month notice period. When I applied workday, it showed 92 days. My joining day in new organisation clashed for 2 days. What is standard 3 months notice? 90 days or 92 days (30+31+31).

      Hi Tirthankar,
      Standard is 3 months but you can always discuss to to leave a few days here & there based on your discussion with your boss/ HR department. In my opinion 2 days should not be a problem.

    Hi Mam,
    I am facing notive period issue . My company has 3 months notice period.but i am not able to serve more than 45 days as my family stay in north and i am currently staying on south of India. There are some medical issues bcz of that i want to leave early .but my manager they are not approving besides i gave pay out option of my notice.
    In my contract its mention
    "Subject to the remainder of this clause, your employment may be terminated by either party by
    giving notice as set out in the Heads of Terms, or payment in lieu of that notice."
    What to do i am mentally feeling depressed due to my family issue. What should i do

    Hello Maam, I have notice period of 2 months, I have completed 1 month now and iam going to serve another 15 days, For remaining days 15 days my manger will approve for leaves. Now if i join new company after 15 days(the day from iam appling leave in present company), present company exit date and new compnay joining date will create any problem in future.?

      Congratulations on the new job. I suggest you check about the exit documentation that you need to complete which will include your release letter with your HR department. Additionally check with the HR of new employer what documents they need from previous company. Hope you have a smooth transition. Let me know if you have any questions.

    Hi Nancy, I have been in Infosys for 1.7 years and I am in a project from last two months . Now I am going to resign at the end of this month . The reason is to join govt job at the end of august. So will I have to serve the notice period of three months. Can I ask HR to give 1 month notice period or will they allow me as I will not join any competitor or any other IT company further.

      it mostly depends on your role in project if there aren't many dependencies and your manager is okay with it , you might get an early release . In service based companies your release is mostly dependent on your project manager unless you are on bench

    Hi mam my condition is similar to the 1 comment you answered but company don't have any replacement and they are not hiring as well and they are telling to serve full 2 month notice period and i am agreeing to serve 1 month and buy out remaining. Please advise how to proceed?

      Hi Himanshu,
      Make sure all communication is in written. Write a polite email requesting them that you would like to buy out your notice from which date to date. If they don’t respond visit them, understand the reason of disagreement and change your approach.

    Hello Mam, In my current organization notice period is for 2 months but I got good offer from other organization and i have accepted that offer. And i informed my current organization that i can serve only one month notice period and gave buy out option but they rejected my option and said you will have to serve 2 month notice period. Tell me here what I can do?

    During Notice Period BuyOut does payment happens on LWD or in FNF

      It is generally deduced from FNF but if the payment is more on employee side, he/ she needs to discuss this with HR based on the policy.

    Hello Maam !
    I got an offer from a company but they want me to join within 30 days only and cannot wait more than that because of immediate requirement. But my employer is telling me to serve 90 days only and that early release or buy will not be possible. My Employee contract Terms & Conditions states :
    "You may at any time terminate your employment by giving the
    Company ninety (90) calendar days prior written notice. Upon you providing such notice, approval of any request for early release and/or any kind of waiver will be granted at the sole discretion of the Company and will be subject to terms and conditions of the Company, including and not limiting to the recovery in lieu of notice period not served."
    What can be done now Maam pls suggest?

    Mam, employee resigns with shortfall of some days instead of full notice period. Company ignores the shortfall and pays full 3 months salary during 3 months notice period but withheld relieving letter.
    After one year, company changes mind and asks employee to pay for notice shortfall. Is legal action possible as company itself has paid full 3 months salary during 3 months notice long back

      With all necessary documentation/ proof labor department should be approached in this case.
      In another situation if the employee is working in a stable organization at present he should ignore any demands of previous employer & save the hassle.

    Hii we have a buyout option. My colleagues had used buyout for 17 to 30 days to get early release. But when it comes to my case. Now I was the only developer available for them and the project is going on. I asked the practice director for 15 days early release (notice period: 60 days). But he is denying it saying he could release me before a week of last date of my notice period. How to handle this situation. Please help me

      Hi Mahesh,
      If you are eligible to buy the notice and same is mentioned in the contract, you must try it again. The company’s response as of now is based on their convenience not as per the policy. Be firm and follow up on professional grounds. I am hopeful that you will be released early.

    I have joined a bank 1 month back and now i have submitted resignation as per appointment letter i need to serve 1 month notice and i am serving it.... But my supervisor sent a mail stating that untill we hire your replacement we are not going to releave you.... Can they have a rights to do so ...... On last working can move and can they clear my salary dues....please suggest me mam

      This is not ethical of any company to not abide by the rules set by them. They cannot extend your notice based on an issue from their side - which is your replacement. Yes they may try to hold your salary or release letter so handle the situation diplomatically. Be kind and offer support at the same time show your needs to leave as per the last day officially.     My current organization is having 90 days of notice period . In the offer letter they have mentioned about buy out option but in that they have also mentioned that If the exigencies of work so require, the company may not relieve you earlier than the expiry of the entire period of notice. It shall, however, be open to the company to accept your resignation with effect from any date earlier than the one offered by you in your resignation letter. The company shall at all times retain the right to exercise waiver of notice period. The Company in such situation may choose to pay salary till the last working day of the employee.
    I have a better offer in hand even I have requested my current company to match the new offer but they are not ready for anything. I have few pending annual leaves also but they are not ready to adjust those dates. Even they are not hiring someone who will be replacing me. I have shared few profiles who are perfect fit for the role but my manager is saying he is not satisfied with these profile.
    Now what should I do ?

      Maam in service rules we have provision of paying out three months basic pay or serve three months notice period. I have made it clear in my resignation that i can't serve three months notice period and I want to buy out that. They are saying it takes time to get clearance from different department and asking me to serve three months notice and they are also saying it takes time to find the replacement.What should I do??

      Your replacement and clearance is both company’s problem not yours to worry. You have done your side of agreement to pay as per your contract. Ask the company for an early release softly but firmly. They must agree to let you go.

      You are on notice period already, It's your right to deny any additional work beyond your work hours.

      Hi Rohit,
      I would say simply resign and move out. you must be still on probation. If you have a better opportunity you must leave and the company should not torture a one month old employee. At the most you can totally forget this employment episode and remove it from your resume.
