    Incorrect information. Based on employment contract an employer usually forces employees to serves 90 days notice period. And the early relieving with financial compensation for the unserved notice period is taken with a pinch of salt as "Employer's Discretion". So the employer using the "employment contract" forces employees to work like a bonded labour to serve the notice period completion.

    My HR told me I cannot leave by buyout & w/o serving notice period. So I questioned her with the policy or clause that's stopping me to do so. She had no answers
    So guys do question your employers if they throw any bullshit to you

      @@apz7645 first you ask them if they have mentioned anything in your offer letter or bond. Bacoz most of such things are usually verbal and without any written proof. So if you challenge their verbal statement with the solid proof and they have no answers, you can walk out clean

Everytime my HR replying me after discussing with her. I have already mailed them and all seniors including HR head that I am not able to server 30 days notice period I will compensate against it

    Agar contractual appointment hai, aur contract mein contact period mentioned hai, aur contract khatam hone ke baad renew nahi hua hai, to bhi notice period applicable nahi hoga

    If pay from organisation, than they count 1 month basic salary for termination or leave encash etc. Please check and updated if wrong.

      There is no definition in particular. Your contract defines your notice period. Usually max 3 months notice period is there that too for specific and complex work positions where it takes time to train new comer in your place. Otherwise 2 months is very common these days.
      Even in govt job there is 1 month although no one ever serves notice as it is govt job so no one cares that much. They let you go immediately if you want to leave.

    Forced labouring is illegal in India even if there is a contract or bond still it has no legal effect. Taking compensation from employee is sole discretion of Company

      @@ManishYadav-qe6lk if it's written in their hr policy they can file case. You need to pay. You can quit from a company without serving notice period because it's completely employee's decision but you are supposed to pay the compensation as written in hr policy.

    I my offer letter 30 days notice period is required while anyone on resign but after mutual discussion with manager he allow me to not serve notice period and he acknowledge on my resign -OK now the HR deducted 60% amount from my salary and said you didn't serve notice period what to do in this case

      Bhai aisa nahi hota bolo legally pursue karunga main agar buyout nahi doge toh apne aap line pe aajayenge. Mere friend ko bhi 1 lakh pay karne ko force kar rhe the jabki contract Sirf 6 months ka tha Kehte ki nahj aap 1 year se Pehle chod rhe ho lakh dene padenge. Bahut ghumaya jaise hi legal recourse bola turant ho gya mamla settle. 😂

      Take Follow ups for the updates. If you don't, the company will simply forget and close your case.
      Even after follow ups, if there is no result, then you can warn them for suing

    My previous company has asked me to put down the papers with immediate effect. Blocked my mail as well. After regular follow ups they have paid the salary but it has taken 4 months to do so. My PF deposit is still pending from them. Few months back, by mistake they have done a txn into my account of some money and few days back they have identified that, now they are threatening me to return it back otherwise they will be go legal. Seeking your help

    I want to resign immediately but i am not able to serve notice period. And my HR force me to serve 1 month notice period. And i also sign contract that i will serve 1 month notice period if i am not able to serve than i have to pay all my salary which i get in my whole time. What can i do plz help.

    @lla,
    I have a 3 month notice in my contract.
    Now i got a opportunity in a new company which is paying me the double what i am offered here and my company is not allowing me to get relieved.
    I am ready to serve 1 month notice and pay for 2 month for whatever the company wants to charge. But still they are denying. I need a help on this.
