Yes, one can leave if they want to. Basically abscond without serving the notice period. But there is another problem to this. The hiring company always demands and needs an experience certificate which one receives only after serving notice period. I'm pretty sure if one leaves the next day, the present company won't provide any certificate and that could cause an issue.

Everyone knows those clauses are not legally enforceable, but companies don't give seperation/experience certificate and may give negative feedback and that's why employees still stay for 3 months. In no other countries, the notice period is so long. In most places it is 1 month for permanents and 2 weeks for contractual employment. These same companies in India when there is a downturn, lay off by backdating resignation by 3 months so as to prevent losses and if employees don't agree, threaten to mention they have been fired in seperation certificate. India needs strong labour laws to prevent this practice.
My friend got an offer from a competitor firm. Because there was no clause with the current company that you can't choose to work with competitors after resigning, he quit without serving notice period. In order to get the experience letter he had to pay two month's sal to his present employer which again the competitor firm paid on his behalf. End of the day, he got the experience letter and a better job.
I did the same. I was served legal notice after a week by company through a lawyer stating I violated 90 days notice period and I signed three years contract. I had studied law and my dad is a lawyer as well. So I drafted legal reply and sent to his lawyer through my dad. They never replied back. The point is if company has invested money and resourced on you and then you violate by leaving them without serving sufficient notice period, which universally is 14 days but can be stretched to 30 days in good faith, then they can claim from you in court. But that is also highly unlikely given the time it takes for court to bring a case to judgement and the expenses the company will incur they don't find it feasible. So don't be afraid to resign. Do it now. đ
But compensation can be claimed by company...that's a different aspect that company will never file a case against employee for souring litigation expenses

Bro Legally speaking, any bond that any organisation signs with an employee stands null and void as per the Constitution of India. The company might stop your relieving letter at the most for the 2 months tenure which I feel has little or no value even if you get that.

As you are saying that if any employee is good then company will not go for background check then you are 200% wrong. Rules are same in every company for every employee whether he is talented or not.
What about Experience letter, LoR, FnF settlement, leave encashment ? You'd lose these things if you don't serve notice period and also your next company will get a bad review about you once they do a background check with your previous employer.

@@chebellipavankumar649 you need to do 2 things 1. Ensure that you have not given any original certificates like degree certificate, passport, 10th marks card etc. 2. Just don't go to office and block their number and if they keep calling you tell them that, they can go to court if they want. If they go to court tell them that you will also file a harassment case against them. Return the id card and laptop.

They never called me as well. I have kept the resignation request in July. And I got a mail saying i need pay for notice period in Nov. After that they haven't mailed me anything. Can you please help me in this. I joined for a company for just 10 days after that i wanted to leave and joined other company but the previous company wanted to me to do notice period for 90 days. I said i don't want experience letter and said them to keep me in absconding. The HR agreed during that time but now they are asking me pay notice period pay. Why i should pay because i was not even assigned to project and i didn't provided any background check also? I am working in the other company for 8 months . But i am still scared about the previous company which i have left and they didn't gave any release letter as well. What should i do in this?
If you donât need exp letter ignore them if they told you they will go to court ask them please go

1. Ensure that you have not given any original certificates like degree certificate, passport, 10th marks card etc.
2. Just don't go to office and block their number and if they keep calling you tell them that, they can go to court if they want. If they go to court tell them that you will also file a harassment case against them. Return the id card and laptop.
@@sandeshtg3289 I didn't provided any physical certificates of my final degree and last year memos. Actually they stopped sending mails. I only mailed them that why i should pay and all. They never called me as well. I have kept the resignation request in July. And I got a mail saying i need pay for notice period in Nov. After that they haven't mailed me anything. I only replied to them recently why i should pay and all. And I don't have ID and Laptop as well. Because I literally wanted to leave after joining the company for 10 days and it was still in onboarding process only. In the notice pay they mentioned 9th sep as my leaving date. But they didn't gave me any release letter.

If you want to loose everything and sit in your home crying listen to this. There have been many cases in court and companies have won that. So, please don't ruin your career by just listening from someone who have been terminated from his company for corruption. Always consult a legal office before going crazy.
It's differ matter that co. Doesn't went into court for the same but as per Indian contract act companies have right to do so..
