By the way, some of you are saying that this is more trouble than it's worth. And you know what, you're probably right. That's more or less what I thought going into collecting this final 25%.

Is it more trouble than it's worth? I don't think so. So far 13,876 views which means that many people are a bit more aware of the Mexican legal process than there were before. Under normal circumstances perhaps (though going after a bully when you're completely in the right is a good thing regardless) but in this case it's part of a service :)
You just have to take care of yourself. People in mexico know justice doesn't work, so most of the times they try to solve things the bad way, if you know what I mean.

I love the attitude. Do nothing will change nothing. BTW, I have ran into this Mexican social influencer that wants to reveal the ugliness in Mexico. He said the most horrible thing for Mexicans is to get used to live in a country like this.

IN small claims court in the US, if the defendant doesn't show up at the court for the hearing, the judge automatically awards the plaintiff their money. However, collecting the money is another story.
You are right. There are no alternatives for actually collecting the money and it's as if everything was for nothing. Small Claims court is a joke.

Its a default judgement in the USA, if the other party does not show up . However, its usually impossible to collect
Actually, the procedure for serving process that you nave described is very similar to that in the U.S. If personal service cannot be effected, you can resort to service by publication. If the court deems that effective service has been accomplished, including by publication (if done properly), and no response is filed by the defendant, a default judgment will be entered in your favor for the amount claimed in the lawsuit. At that point, a judgment will indeed issue, but it's up to you, not the courts or the government, to collect it. There are some tools available to help you access the defendant's assets in order to satisfy the judgment, but they are fairly limited. Many, many judgments are never collected. In the U.S., a judgment can, if properly filed, serve as a lien on any real property owned by the defendant. But even with this remedy, there are limiting factors. If the defendant owns the property along with one or more other persons (such as his spouse), the judgment may not be enforceable (because only the defendant, and not the co-owner) is liable to you. The short version is that you are likely to have a long road ahead of you, even if everything works like clockwork (which it rarely does). And, unfortunately, at each stage, you are likely to incur additional legal expenses. For this reason, many plaintiffs with meritorious claims ultimately conclude that the costs of litigation, coupled with the expenses and frustrations attendant to any judgment eventually obtained, render the entire effort more trouble than it's worth. I hope your experience is better than what I have described, but in 44 years of legal practice in the U.S., I have seen all too many frustrated plaintiffs winding up without any recovery, despite having obtained a judgment in their favor. ¡Buena suerte!
That is what I thought. You can get a judgement in your favor if the person cannot be found or does not show up at the court proceedings, but it is up to you to get the money. As you described, it can be impossible to get paid in many cases.
As another US lawyer, I agree with what gschell99 has said above. Still, it is good to have that judgment out there for ten years so that you can collect on his assets if you find them. I have seen cases where a judgment that seemed like it might never be collected on does get paid years later.

According to a Mexican law firm: In the event that the judgment orders the delivery of real estate, money, books, papers or any object/thing, the judge will make use of all the means of compulsion within their reach - such as the use of fines, seizure and withholding of goods, and even arrest for breach of court order - to achieve the payment of what is owed. The judge may grant a term of up to 60 days in which to vacate real estate.
There are a lot of hoops to jump through, but Mexico's legal system is not exactly the same as the US.
I would not be bothered to file a lawsuit for a few hundred bucks but I guess it's the principle of it. Good luck!
In civil lawsuits in the USA 🇺🇸 if the defendant fails to file a written answer to a lawsuit within a certain period of time (usually 30 days), then the plaintiff can file for a default judgment and collect damages.
But I guess for the 30 days to start he needs to be served with the lawsuit first.
This is quite interesting but could you mention what fraction of the amount owed is expected to be recovered, after taking into account the legal fees you're paying? At any rate, good job not letting that scammer get away with the money so easily!

I would, of course, just rather gotten my money owed right when I asked for it. But with a good lawyer, it has been a pretty painless process and I'm glad the court system exists to resolve disputes.

Be careful, your easy to find in mexico. When people are getting sued in mexico it is different than the usa, many people take it to the streets, your newly married, move on
Take the loss. A foreigner in mexico causing problems for locals will end up bad no matter how well you think you know mexico.

F that they will pay idc. I'm not getting robbed you forget the sun goes down and you can do the same thing 💯 not condoning anything but don't be scared of hustlers. I've lived in Mexico for almost 3 years and no way I'd let anyone do that to me. Haven't been put in the ground yet.
From your comment you side with scammers taking money from foreigners. Are you a local thief scamming on foreigners too.? This guy shouldn't have to take a loss and play victim. 99.9 of Mexican people are honest, hospitable, and have the biggest hearts. I bet they would side with this foreigner..

How much have your legal fees been? I think this would be very valuable information for expats to have to know what to expect in situations like this.

I have a little bit of advice, from 30 years of being an Attorney , Entrepreneur , Investment Banker and business consultant. Always convey that you will do whatever it takes to collect on any judgement.including filing a formal complaint with the Real Estate Board seeking his license be revoked, the depending on the laws in Mexico file attachments to whatever assets he owns or controls. Getting the judgement is great but getting PAID is paramount. I would never say, you hope that drastic measures are not necessary, they are and you should always convey that.

😮 How do you serve someone under the Hague Convention?
The general process service through the Hague Convention is as follows: A special “letter of request” is completed along with the necessary documentation and is sent to the appropriate central authority in the country where service is being completed.
Having lived overseas for many years, I'm so happy to see that you are actively going after this guy. I've seen so many ex-pats just take it on the chin and eat the loss. This type of behavior sets us all up to be stupid victims or stooges. Full marks to you all around!
It seems he has taken drastic action to avoid paying a very small sum, unless there were many more actions against him.

It’s definitely the case in the US (and mostly elsewhere) that if you don’t answer a lawsuit or show up to court, the other side will win a default judgement.
As you righty point out, the issue becomes what happens next and how far do you take it after that.
Lawyers usually frame the choice this way: the principled approach versus the practical approach.
A principled approach might look like following through with enforcement of the default judgement, even though the costs will be more than the debt you’re trying to recover, because it’s about more than money-it’s about standing up to bullies, for instance.
The practical approach might be considering whether the costs are worth it, especially since a judgement doesn’t equal payment.
Enforcement of a judgment is a whole new process which costs more money, and depending on the tools available for enforcing a judgement, it can takes months or years to recover some or all of a judgment. Or you can spend money and never recover a single cent, dime or peso.
There are ways to avoid enforcement, too. Like the old saying goes, you can’t get blood from a stone.
Either way, the choice is always a personal and contextual one.
At the very least, you’ve brought lots of attention for expats to this common practice and to the legal process there. Well done for standing up to them and good luck 😊 ⚖️

Thanks for the details. I guess the ultimate question if it comes to it, will be getting a judgement enforced. At least in the U.S. this is not always that easy and is often more costly/time prohibitive than it is worth. Would be interested to see how the entire experience plays out in a different country. To start, no. They owed me over 40,000 pesos and it cost me a few hundred bucks in attorney's fees to collect the first 75%. To collect the final 25%, it will likely cost more than that in attorneys fees but we are asking for all attorneys fees in the lawsuit as well. Anyway, at this point it's not really about the money, it's about fighting a bully.

Wow Jordan that sounds how the legal system should work ! My husband and I had a similar situation here in Montana and won our case and the guy hasn’t paid. He worked under the table so he had nothing to garnish. We gave up because our system wasn’t very helpful at all. It was expensive and nothing seemed to work in our favor.
And everyone bashes Mexico for their legal system, forgetting the US is not much better and your lawyer fees are more than likely 10 times more than the lawyers in Mexico. Americans excuse our faults but love to take aim at other countries. Let's face it: Corruption is everywhere. Sad that you had to just give up but been there done that. Too many corrupt Americans find the loopholes and take advantage of it all.
Jordan, as someone who has sued someone in small claims and won a judgment. It doesn’t matter at all if the person is slimy and just keeps moving around and won’t pay the judgment. I even tried garnishing the wages of the guilty party but they kept quitting jobs and and every time I’d have to refile paperwork with the sheriffs department. So I eventually gave up.

In real estate, at least here, I learned that the agreements aren't worth the paper they are written on and to *never* put any more money down than you are willing to lose if the deal doesn't work out because regardless of what paperwork says, whoever is holding your money is in control of it. It took me 7 years for a real estate matter to be "resolved" which it never was completely and fairly resolved to my satisfaction.
I proud of you Jordan. I 'm sure that guy ripped off MANY OTHERS... karma will also get him... but don't give up on him... MAKE HIM PAY!!
The thing that upsets me is that you were gracious enough to give them a couple of weeks to come up with the rest of your money! As a process server in Arkansas, if we are unable to serve them directly, the court can authorize service by warning order. This is exactly what you described, so yes… it’s the same process in the US, in Arkansas anyway.

I hope the best for you. I lived in Central America and the court system is similar where your lawyer does everything and all you have to do is sign the documents. Even in criminal cases, if for example you don't want a jury to see you because you are concerned of bias (e.g. racism, sexism), your lawyer can do the whole process. Again, even in criminal matters. In the U.S., if you don't appear in court, your case will be held up indefinitely until you show up in court, where the judge or jury will see you and possibly draw whatever biased inferences from you appearance. I don't want to say that one country's system is better than the other, but your ability to defend yourself in court without appearing in court and having a lawyer do everything is exceptionally good in my opinion. In the U.S., even if you take the fifth amendment (right to remain silent), you will still have to be present on the first day when you make a plea, in most states. So it is what it is. I'm not saying either one is better or worse, it just depends on your situation and preferences. Another thing that I like about Latin America is that when you are pulled over by police, rather than the officer approaching your vehicle, the driver is expected to get out first. We've all seen those videos where an officer (in the U.S.) approaches a vehicle only to be shot through the window, or vice versa, the officer shoots into a vehicle because he thought that someone reached for a gun, or at the very least, the driver floors the gas pedal and speeds away. All of this is less likely when the driver steps out of the vehicle first.
Not being critical - just offering the other possible option, but that person that exits his vehicle could immediately take aim at the officer while he sits in his patrol car, and here in the US with so many assault weapons being owned, could be used and used to get away.. From my understanding the glass in the patrol cars are not bullet proof. Difficult to second guess the end result, seeing the criminal's face or not. What I am thinking - either way- the criminal can get away if he truly has to. As you mentioned, the officer does save himself from reacting too quickly.
@@MR-pr8tp What they are proposing now is to have officers copy a vehicle's license plate and mail the ticket to the owner of the vehicle. The idea is that high speed chases will be reduced.
Don't count your chickens before they hatch! The guy could just skip town and then there will be no money.

The proper forms and payment are sent to the Central Authority in Mexico. Once the documents are sent to the Central Authority, you will not receive any updates until the proof of service or non-service is sent back to your office.
Yes you can do that is the US. It is called Serving by publication.

How much money is this lawsuit over? If it’s a quarter of a month’s rent, I would have to believe it’s less than $1,000. In the US, if the other party doesn’t show up in small claims court, you get a default judgment, but they won’t collect it for you. In some states, you can garnish their wages, but it’s a hassle. Doesn’t seem worth it for a few hundred bucks, but I guess you’re getting some content out of it.
At today's exchange rate it's like $640 USD + attorney's fees. Collecting this final 25% isn't really about the money. It's to show them that if they don't honor their contracts and do business in an upstanding way there will be consequences.
@@TangerineTravels Yeah, I hear you. I once took a landlord to small claims court over a $500 security deposit he was dragging his feet returning after I moved out. Sometimes it’s just the principle.
Actually, as to service by publication, it works the same way in most states in the US if the Court allows you to serve by publication after doing due diligence to acquire personal service, although you may have to publish three or four times. Yeah, if they don't show, you will get a default judgment.
Speaking from experience in this type of matter, I hope that when they gave you a portion of the deposit back, you received a signed receipct stating that they paid you this amount and that they had a balance owed you..
Because I did the same thing and when i was given half of my deposit back and when i never received the other half, and when i took it to court they wanted proof from me on how much i was paid back, like a signed document and I did not have that to show so the court did not rule in my favor or the agents favor they just dismissed the case.

My Mom got ripped off by a Real Estate agent in Cabo San Lucas when buying her property. She's now pursuing legal actions. Still waiting the outcome. It's been a few months now. Her lawyer also told her that she's in the right and they'll do everything to get her money back.
In the US for serving it’s a similar process. You wouldn’t automatically “win” you’d file a motion for default judgment and then you would “win”
And hope you really get the money as there is no way to actually collect even though you "win".. A person that loses can still not pay and nothing happens to him or her. American justice system is as broken as any other country.
Most likely, the situation puts Jordan in a position of privilege because he´s an American foreigner, and a foreigner whose voice is listened by thousands of of other Americans (and thousands of Mexicans also). The Court wants to look fair and just nationally and internationally, and this is a clear cut case of abuse by a thug who needs to be punished.

Guarantee you’ll never get that money back and will be the one stuck paying all those legal fees, not him. Plus all the wasted time and effort over potentially years for what? Principle? Let alone the stress and anxiety from having this hang over your head on a daily basis. I’d cut my losses and move on, for sake of mental health and well being
You have a lot going for you, i worry that the juice isnt worth the squeeze. Be careful, and stay safe.
Usually in a civil case if the defendant doesn;t respond or appear they will loose by default and have a judgement ; with prejudice ; for the plaintiff. If the person can't be physically served, some jurisdictions can use the mail, letter, or internet as the way of serving a subpoena.

For me this the raises the question of it's a few hundred peso or a few thousand pesos. I'm thinking about moving and of course getting my deposit back a concern. If it's just for a few hundred pesos then it seems like the cost of lawyers and increased stress in my life is really worth the trouble. I have good relations with my apartment manager and have lived here almost 5 years, so I don't really want to burn any bridges with him or his family for a couple of hundred pesos. I told him a couple of years into the lease that one of the neighbors said I would never see my deposit back, just to let him know that I'm expecting it back when I move out because I have taken excellent care of my apartment. He just laughed that nervous laugh that many Mexicans do when they don't want to address a confrontational issue. Any suggestions about this kind of situation? Having that deposit back could mean the difference of being able to put down a deposit on a new place or not. Been a subscriber to your channel for years and have enjoyed watching your Mexico experience as my own has been unfolding.

Mexico has amazing laws, people speak from ignorance because they’ve never lived and or are unfamiliar with Mexican laws! I love Mexico for that and many other reason and would chose to live in Mexico Vs anywhere else in the world no questions asked.

Just subscribed to your channel. I've never seen civil litigation in MX. So how are you entitled to legal fees? Is it pursuant to a Mexican law? Maybe a consumer protection law? Do you know if this realtor has any assets that will satisfy the judgment and legal fees? Did you pay your lawyer his legal fees up front? Given the guy couldn't be found and he's already demonstrated that he doesn't care about the law and has disappeared, I have a feeling you may not be able to collect on your judgment because he either has no assets or is nowhere to be found. Just so you know, defendants frequently fail to respond or actively avoid service in civil cases, and the plaintiff gets a default judgment. Then comes the difficult part of collecting on the judgment. Can you let us know how things go?
A default judgement happens all the time in Texas. Pretty sure in the rest of the US

But for clarity, does a default judgement happen in the US when the defended has never physically been served the lawsuit like what would happen here? I am aware that if you don't show up to court in the US, you're going to lose. But do you lose if you were never served?

Service by publication when done properly is deemed an effective substitute for actual service. But first actual service must be attempted after a good faith effort to find the defendant.
Sounds like projection when they called you both children. That said ... WOW. Yeah this is very different from how these things work in the USA as far as I know. The petty person within me kinda likes the bit about "If he doesn't pay I can take drastic actions over the course of the next 10 years" I'd love to hear more about that 😈

At this point, since I've already collected about 75%, it's no longer about the money. It's the principle. And I'm okay with paying a little bit of money to a lawyer to fight the bully and force him to do what's right.
But do you know how much lawyers cost in Mexico? Or are you thinking "American" and our justice system? While you have a point, perhaps Jordan has the bulk of his money, and just having to make a statement to hopefully get the "bully" off the streets from harming others. (if Mexico works like that) As he said, damages to the property were not shared with Jordan, and still being "for Sale" to others dishonestly. .

lol if you get on a table and start dancing on it because you're drunk and you fall and mess yourself up, you cannot sue the bar or restaurant you did that at. now in the usa, you can sue them for serving your hot coffee! lol!
I have no idea what it's like in Mexico, but my guess is that you will wind up getting less than 10% of your judgment amount (so even less after recurring fees). I suspect that you'll eventually have a video talking to a collection agency and finding out what that "paper" judgment is worth.

If the respondent fails to show up after being served, including service by publication, It is very common to get a default judgment in the United States as well.
Getting the judgment is often the easy part.
Let's hope this real estate guy doesn't have cartel links. Those guys do nasty revenge

It is up to you. Life is way too short IMO. Been there done that.
Did the seller ever agree in writing to refund the deposit?
It wasn't the seller, it was the real estate agent. At the time of paying the deposit, he signed a form saying the deposit was fully refundable if I asked for my money back within 5 business days of receiving the rental contract for the house. Him and I both signed that form.
Lawsuits in Mexico are tough, better to just get a couple of enforcers and get the money that way. Unfortunately this is the way here.
I once had an issue. I decided it wasnt worth suing them, because they didnt repspond to my lawyer.

In usa, they can cpose company and you lose out on money.
In some ways Mexicans and permanent residents of Mexico have more rights than Americans do in their own country, better property rights, better attorney client privilege ect. even the right to free speech is respected more in Mexico as you generally don't need a permit to hold a political rally.
I have heard of people being screwed over by construction companies in Mexico and finding it very hard if not impossible to get their money back but in America people get screwed over by chemical companies that poisoned local water supplies and caused all sorts of health problems and these things are in legal limbo for 20 plus years so it's all relative.

In California, you pretty much have the same procedure. It's called a default judgment. This will go on their credit record for 10 years.

In the US in most cases you can win by default as long as the person/entity in question was properly served or notified of the court date.
Winning but one still has to collect and even in small claims court someone can not pay what they are supposed to and then what? Nothing. Winning means absolutely nothing. Been there done that. One would have to go through the process of placing a "lien" on his/her property and that is very tedious and time consuming and worthless when the person has nothing to place a "lien" on.

Yall need to stop being scared 😂😂😂 I've lived here 3 years and don't fear anyone and believe me that's my mentality and personality. Not one person steps on me and I've been all over the world. Be scared and you will find yourself in trouble because weakness draws snakes.
I would be concerned that winning could be losing. Every step costs you more Jordan and ultimately costs the guy trying to rip you off more if he ever pays the piper. Same here in the US. I’d be concerned that you will just keep paying your lawyer and get nothing, or worse,,,, you become a target of some kind that is cheaper to deal with, another way? Sometimes theses disputes never settle. I am looking at a life/retirement in a different foreign country, too, Thailand. They have an expression, “tit”. This is Thailand. The best thing to always remember, is that we are will always be foreigners. We have to pick our battles. The best play in war games was not to play the game. I’m guessing you are fighting over 1/4 of $2k. You may choose to let it go, rather than stand on principle for that kind of money. Between the money and saving face, they may feel backed into a corner and not play fair. They already were trying to take your money white collar style. It could be more crude. I’m not them, threatening you. I’m a lay low type that has seen too many American travelers lose disputes in foreign countries. I see some of them fighting for their rights too much and wishing they hadn’t, especially when the law is on their side.
They real estate scammers are Chilangos. (originally from Mexico City).. most likely they'll just pick up and go to another city and restart their scam there. They would have to get permission from the 'plaza' to pull any kind of cartel style action and it would not be approved of by the plaza. It's not enough $ for the heat such an action would result in. The attorney involved is also quite aware of this as my information about this comes from attorney friends of mine.
The Chilangos aren't even sweating it and probably want to get out of Queretaro anyway. The market there is saturated. They'll have more success in Guerrero after the hurricane with all the property that's damaged and ease at which they can capitalize on scams over there.
