    I think people don't know the full story. The woman and the 2.5 year old child along with another minor child of her's was picked up at night(4am) by police and brought to the police station. Where they were kept for 6days on detention without producing them before a magistrate and then they filed an FIR naming the woman in it, probably to justify and somehow get away with the illegal detention. Then the woman's brother filed an habeas corpus plea at gauhati high court. That's why judge is so angry. You can hear in the first part what happened b/w 26th and 31st may was unclear. Only on 31st may the woman was arrested, then how did the police keep her in police station without FIR/arrest? It's a gross human rights and fundamental rights violation. Hence judge is losing his cool. Live law has reported the case, you can find it in it's website.

      what was the judgment passed on that police officers ? human rights violation ? keeping 2.5 years kid in police station ? so many faults .... judge should fire those police officers ...... suspends all waste of time .... only if the judges fire these type of police officers ... the higher rank of police people will listen.......accordingly even the judge should punish the inspector of that police station and assistance commissioner of that police and should suspend the D.I.G OF POLICE then only these mistakes will not take place ......

      @@sandeeplondhe4835 she may or may not know the whereabouts of her husband but that doesn't justify illegal detention of a woman, an infant and another minor for 6days inside a police station. Using communal slur doesn't win you an argument, it only exposes your education and upbringing.

      Exactly. Unfortunately, our judiciary is on the ventilator because of the lack of such judges.
      We had a property case in High Court in which the petitioner appealed against the decision made by Session Court & it took High Court more than a decade to pronounce a judgement that the appeal filed by the petitioner is baseless & can't be heard anymore. Such is the condition of our Indian judiciary🤣😅. Our Indian judiciary is collapsing with each passing day.

    if FIR wasnt registered and she kept someone in custody for 6 days then no matter how honest she is and how guilty is the accused she shouldnt have done that because law and order work on precedent and if the judges allow her to do it here then it becomes the norm , and today it may have been dont to bring a guilty person to justice but tomorrow some innocent person may be brought to the station like this and he or she may not even afford to goto courts for relief like in the cases of raja kannu vs state of tamil nadu and rajan vs state of kerela

    I was seeing the same thing that there is no hatred in the first part, against whom the judge is right, everyone was calling him right and police was wrong, but in the second chapter, when his name came out as a Muslim, then everyone started calling the judge wrong.Where is our country going, on what nature is it running.

      From the first part i comment the judge is wrong,its a murder case not just some minor thing police take it seriously and do everything in their power to catch and arrest them,they work countless extra hours and here a judge shits on it by saying can't you wait 2 more hours, the court is build to protect civilians not defend criminals

      ​@@vaarunmakheejaa6924i respect our police and i really admire them..but here what's wrong is wrong, we might fail to judge in this situation but the judge is well experience and went through lots of cases with similar situation so he exactly know what he is doing and we should trust him with his decision. Its for sure that he will take the right decision and justice will be given to the victim. Here either the police or the 2nd party could be the victim.

Pollice officer is failing to collect evidence, and you want us to believe she did right by arresting a woman with her children? Shame on you! Shame on you!       They go by the evidences as presented to them. If the Hon'ble Judge appears to be sympathetic to the perceived victims, obviously, he must seen the errors & lapses on the part of the police while arresting/dealing with the alleged criminals particularly, in regard to arresting of woman in the wee hours. The judge is not commenting on the merit of the case per se but on the SOP not being followed.

      Judges are not meant to fabricate their own laws but to follow what's written in the constitution. And according to the constitution, you can't arrest a woman between 6pm to 6am regardless of your geographical standpoint. Hence, the judge is absolutely right.
      New Timezones introduction is a subject of Parliament not the Judiciary mate.

      @@deadman000 if she understood the law.. then she wouldn't have approved to take "Eye Witness " to the police custody for 6 days that too at night as per law..
      if that woman was accused of helping the murderer.. then police should have made an FIR 1st.. which they didn't.. plus they made a mistake by putting her as "eye witness" in the charge sheet later.
      That's why the chief Justice pointed out where police were breaking a rule. rest of the other's are being made up by the police. it's like he caught them cheating the law.

    Even if the S.P. wasn't right to arrest the Wife of the famous criminal before time then Judge is also not right to give suspension to all unit for such act. It's not like killing innocents. Such action can affect the spirit of young honest officers who want to uproot criminals from the society. I feel judge is inclined towards the criminal.

      It may not be like killing innocents but it is surely killing laws and regulations. Read description, the case is that allegedly they arrested the wife and kept her in police custody for 6 days along with her 2.5 year old and a teenager without registering a FIR.
      The law requires anyone arrested to be produced before a magistrate within 24 hrs to ensure that they are brought to justice while fulfilling their constitutional rights.

    the woman was accused of aiding and abetting, timing of her arrest may be wrong but children were not forcefully brought to police station and they shouldn't be, but saying because that bringing suspect one hour before 6 AM is ground enough for suspension of whole station is ridiculous, it is mostly the case of judge playing a bias because of personal reasons or bribe by the criminal, also the culprit is accused of murder and murder weapons was also recovered and the judge is saying for dismissal of the FIR, what kind of stupidity is that

      as per police report.. Wife is not the Accused. she was reported as Eye Witness.
      So blame the police officers for registering FIR 1st if she was allegedly accused.. and mismanaged the case.

    By the time of entering into service most of the police officers are very sincere and very hard working to punish the accused and make justice to the victim but after facing the situations like that they come to a conclusion that why we have to work hard and become fools, let the criminals go in their way.

    The Lady IPS officer is well read and confident....but sad that judiciary is bringing in emotions, gender, religion, etc before law....and why have soft corner for women aides in crime. Courts are full of ego maniacs...and this is why police stays away from taking strong action.

      there is a general rule that no women shall be bought to police station before sunrise and after sunset. and in this case the women is mother of 2.5 year old baby and she's not even the accused... being a woman herself she didn't uphold the law . police don't have such Powers. if the police started to behave like this what will happen to the normal citizens rights .. there are some exceptions to the rule and the situation doesn't even matching.. in most of the cases, the police made the whole story and normal people cannot even get a chance to explain themselves before the court because of the injustice from the police ..

      @@ViSHnumj788 This is incident of Assam sunrise happen in assam at 4:30 Am police arrested her at 4:15 or around same time when it was clear bright as the judge himself is saying , but the judge is making unreasonable accuse of "time zone" . The law says sun rise not specific time ozne . On ground if you reach 10 minute earlier you can't expect police to just watch the clock and let the accuse run because according to "books" its 10 minutes earlier .

    Everyone salutes this honourable chief justice and india needs these kind of professionals in all the fields. The crpc 46 4 clearly says no woman & children can be brought to police station after sun set and before sunrise for . But unfortunately here police brought mother and child to ps at 4.15 am ie before sun rise. Becoz of this in one stage hon'ble justice recommends for fir and suspension on all police. This indicates our officers to follow Constitution / procedures meticulously.

      From what we understood is, the Police officers also took the wife of the Accused at a time of the day(4.30 am) when it's illegal to pickup a women by law. The women was not even the accused but a family member of the accused.

    This video shows how hard is the life of police officers.
    points to note:
    1)Police officials are struggling on the ground facing threats of life from criminals to nab the murderer. but their hardships are not being accepted by the Judge while sitting in AC chamber.
    2) Judge is not thinking about giving justice to the victims family who was murdered but only concenred about taking sides of the accused. It means judicial system in India is accused centric and not victim centric.
    3) Now if case is thrown away by judiciary, common people will think police didn't bring justice to victims.
    4) No surprise why India has low conviction rate in India- because public pleader lawyer can't convince the judge and the judge himself doesn't want to be convinced
