    Im at 90% (86%) and Im going for migraines 2nd to depression and sleep apnea 2nd to depression. I didnt have either of these conditions until I started medication for depression.

    I am now 100% disabled! It took 9 weeks and out of my 4 contentions, they increased 2, but either way it got me to 100%! 🎉

    Dwayne, thanks for another great video. Question for you as a previous rater. I am currently at 70%, (10% tinnitus and 70% MDD), that said I was just granted SSDI as well. When I first submitted for my SSDI I was not approved and I appealed it and it went into reconsideration. While in reconsideration I was awarded the 70% MDD from the VA and my attorney uploaded to the VA the granted MDD rating of 70% for it. Within 1 week of him doing that the SSA granted my SSDI and he told me the MDD pushed it over the top for me. Now the question I have is I am currently fixing to file a migraine claim and request TDIU at the same time, will a copy of the verification letter from the SSA granting SSDI help in anyway to get my TDIU since the MDD was also a deciding factor in their decision? I know that both are separate from one another and SSDI is actually harder to get but I was just curious if it may help my TDIU journey. Thanks and keep up your great work

    Can I file for a secondary if I have not been rated for a service disability. I want to file sleep apnea secondary to sinusitis but I haven’t been rated for sinusitis yet. Can I file both at the same time or do I have to wait until I’m rated then file the secondary.

    I submitted an "intent to file" and i am working my case. I want to file for Tinnitus as a service-connection. I also want to file a secondary to Tinnitus for peripheral vestibuler disorder (dizziness with slight staggering), as well as Migraine as secondary to Tinnitus. My question... should I file for Tinnitus for service connection and then later file for secondaries or should I submit for every condition at the same time?

    I had a 50 rating which was for cervical spine and tenitus to 80 as of today for sleep apnea . My cervical spine condition has worsened and I now have lower back and sciatica issues. I am looking to file for ptsd secondary to these new conditions. Is this the best way to go about filing?

    Wonderful Information. I'm New To Your Channel... I'm Retired Now From The U.S. Army After 22yrs. Of Service (Field Artillery = 13B4X). I've Been Rated 100% P & T With No Future Exams Scheduled. My Question Is; If I Still Have Service-Connected, Secondary Condition, Or Presumptive Conditions Such As Cervical Neck Issues That Were Not Considered During My Rating Process To 100% P & T; Which Are Worsening Everyday That Goes By. Do You Think I Should File A Claim For Those Conditions? or Continue Seeking Medical Treatment And Getting Them Documented or Should I Move-on With Being 100% P & T?...💯

      It would be up to you but get educated before you dive back in. Understand under the 5 ways of VA service connection. Where does the conditions fall and do you meet that criteria.

    Dwayne, I'm submitting back increase, do I file the radiculopathy separately or put the symptoms in my personal statement for the back increase.

      During your C&P exam, just state you have pain shooting down your legs. The examiner suppose to check the box for radiculopathy. The severity of it depends on your pain and how it affects you.

    Thanks for the video. My neurologist said she doesnt think my headaches are from tinnitus but loud noises in the military 😳 are there any conditions i can connect loud.noise too in order to have headaches as a secondary?

      Loud noise is the main cause of tinnitus, therefore, your headaches should be secondary to tinnitus. Are you claiming migraines? I don't believe there is a diagnostic code for headaches. There is some Internet medical literature for migraines, secondary to tinnitus.

    I have lower radiculopathy and they refuse to give me my back. I have explained every way I know how. Now back to HLR. Makes it seem like they don't want to give it to me because then I can claim 3-4 other things. Now a lot of Regional offices don't want to give you your results over the phone, You have to fill out a fioa request and hope that you get it within a year. But you really should be able to know if the denial matches the C&P exam. I have been denied twice saying I did not have a diagnosis when I did.

      This is why I call out the vba raters because they overlooked medical evidence. Get sn VA accredited attorney. The raters hates attorneys because the attorneys can argue your cases. Thus the raters don't have a leg to stand on. Medical evidence is what you need. All the other is extra. Medical records don't lie and still raters deny claims. Improperly trained and incompetent of giving a proper rating. To many vets should be p and t and they are denied when they should have been granted.

      @@cassiuswilliams6633 I thought if I gave it a year and drown them with medical info and literature I could win. But it does not even matter in the 38cfr or what ever they are using even match what the are saying. I will have to get a lawyer. It is truly a shame.

      It's the examiner stating you don't have a diagnosis if you had a C & P exam. It shouldn't take that long to get that information but the VA does not put a priority on getting veterans the VBA Claims folder.       @@DewayneKimble I had the diagnosis in my healthevet. And most of the time I still send them in because no matter what I do sometimes even highlighting it sometimes it seems to get ignored. Then I have to do a higher level review. They find an error I do another exam and wait. I know that 2 out of the last 4 were positive. But it is up to the rater in the end right?

      Yes, when I rated, I seen many vets do that. I would look them up (most raters today will not do that) and sometimes it gave me what I needed to grant the benefit.     What are the name of forms that I can use to request every single piece of medical documents (prescription/procedures) that you have obtained since the 1st day of your enlistment?

      On the FOI, section-1 #9, if I agree to receive electronic correspondence, will they only send it electronically or both? Also section-5 which box would be the proper box to check if I am the veteran requesting it?

    Is there a glossary for all these acronyms you talk about. It's very frustrating because I have no clue what they all mean. Also, how do I get a copy of my VA claims folder. I know I have secondary issues from my knee and neck injuries, so I would like an increase from these. Also age is a factor in my case. I am 72. I had a retired VA adjustors look at my records and he said would have rated me 60 percent. I currently have 30 for my knee and 10 for a ganglion cyst removal. I think I have some rating for my neck, but not being paid for that. Think I should be with secondary issues. I also have secondary back issues due to my knee which I have a brace for, uneven gate has caused back issues. I have had the rating of 40 percent for a very long time and believe I qualify for an increase. Any help is very appreciated. I have your book which I received today. Thank you.

      You can try looking on the VA's website, I provided several in my book. You have to submit a FOIA request to VBA. Where does your conditions fall under the 5 ways of service connection and do you meet the criteria for an increase. The adjudicator should have asked those questions.     If the relevant CFR rating description has multi criteria and all are separated by the word “or”, does it mean all are equal and it only takes one? Example being astma. I meet one but not the others for a 60% rating. It’s confusing.

    As of today I'm 90% with my back and ankle pending. I did a C&p, service connection, a diagnosis, and an actionable DBQ for the ankle but they want another C&P 🤔...why?

      I can't say why that VA employee requested a C & P exam. What about the nexus. Also, we have been seen some VA employees disregard veterans DBQ.

      @@DewayneKimble DBQ came from the VA's third party examiner 😂😂😂. The Nexus was pes planus to Achilles tendon spurs. Diagnosis and X-rays came from the VA as well.

      Keeping you posted...they canceled the c&p (as I have already completed one) and they're just reviewing my records as per VES.

    First Rater granted my uppers secondary to my cervical - Second Rater denied my lower with the same symptoms as my uppers higher level denied my lowers to so i got a radiculopathy diagnosed for my lumbar and for dizziness that a prior examiner that SC my headaches and associated with dizziness to my headaches in which the rater and higher level rater still denied plus i got over 30 plus years of medical evidence to support a grant for my lowers and dizziness so they are on the docket waiting for the judge to grant them - When you looking at 12 years of retro backpay with 15 claims to grant from 10-50 percent vary few raters will grant these claims no matter what the evidence say or a CP examiner because the raters are told what to approve on certain claims only person granting these claims is the judge period the judges go by the law raters don't my claims and other claims that i have reviewed prove this without a doubt - When you got a diagnosis and a IMO or DBQ that support the grant and the raters still deny over and over there is a major problem going on lol i just one of thousands with this problem lol !!!       If you had a C & P exam, the rater didn't say no, the examiner said no. I've done videos on raters denying claims when vets have DBQs but why go through the trouble of getting a sufficient DBQ and go to a C & P exam.     PLEASE HELP ME!!!
    On July 13th I filed a claim for stage 4 throat cancer based on my MOS. And then on July 27th I filed a claim for my flat feet. Well I received a letter that my cancer claim had been denied, which I thought would be. But when I signed into VA.GOV they attached the letter to my flat feet claim and closed that claim instead of my cancer claim. And my cancer claim is still showing as open. I don't even know where to start to try and get this corrected. I am 99 percent positive that my foot claim would be approved, that is if it was open. But if it isn't even in the que how is it going to get worked? Will someone please give me some guidance?

      Please review our website to see what we do. Someone would have to view your VA claims folder to see what you have done. also, you have to figure out how you claimed the cancer under the 5 ways of service connection.

    I’ve been rated for sleep apnea secondary to PTSD. I had a current diagnosis for sleep apnea. I wrote a lay statement explaining why I felt it was due to my PTSD. Went to a C&P exam and was there for 10 minutes. The examiner asked me how it was connected to my service and I just said PTSD. She said, “OK”. That was it. I had no idea that so many people are denied for it.

    I have a rating of 10% for allergic rhinitis.
    Submitted a intent to file for PACT Act.
    If I get a C&P Exam should I say I want PACT Act or achieve for sleep apnea?
    I was in Djibouti and now I only get 4-5hrs of sleep
    Someone please help?

      If you claim it that way, you can inform the examiner you are calming it that way.
