Unlawful detainer is considered to be a civil matter. There are laws against breaking and entering, but since that wasn't filed in a timely manner, they are protected by tenant right laws to shield them from harassment from unscrupulous landlords. Really, they're not tenants, they're squatters, but the law doesn't distinguish between the two. Laws need to be changed, like in Florida, where a landlord can swear that an occupant is not a tenant, but an unlawful squatter, and strip them from tenant protection laws

Georgia Gov Kemp already signed Squatter Removal Act into law, what used to be months in court is now only a 7 day process to legally remove squatters from your property. The problem is this owner is a private equity company and not a person who lives in DeKalb county who could go to down town Decatur sign paperwork and have these people removed. Squatter or no Squatter, that same owner could still fix the septic system. Somebody is lying... Either way, sounds like a nightmare. It always amazes me how jurisdictions will enforce trivial rules and permits but when something is really messed up and they have to actually do some work they refuse to. Like this situation. It is to a point where I live the county will not do any complaints. The complaint has to come from a citizen signing an affadavit. They do not want to look like the bad guy.

There are so many things wrong with this.. first of all, it shouldn’t be so hard for people to get help for neighbors who are literally breaking the law… second this is why out of state LLC’s shouldn’t own property in Georgia… if this property was owned by a local property owner It would probably be much easier to have this rectified and communicate with the actual homeowner. Allowing companies to buy residential property breeds situations like this where criminals will just take advantage of the fact that there’s no one watching that property.. because it’s an investment not a home.

How is raw sewage continuously coming from a residential home into the neighborhood a civil matter and not a public health risk.
The property should be condemned until all repairs and cleanup of sewage are completed.

Get a lawyer that is willing to work pro-bono and file a lawsuit against the city and or county. This is a health and safety issue. Didn't the state of Georgia just pass a squatters law. This is just ridiculous.

Give me a break! Time for adults to get involved. FORCED eviction, too darn bad. Provide temporary shelter if they have to but get some adults involved and get the squatters out, asap. Then give the home owner a break, but have them fix the septic issue asap, it is a community health hazard.

Tell them to look for a rusted circular cap in the front yard of the neighbours house. It’s usually about 12” diameter and has a square in the middle. If you can’t find it, call for a set of free utility locates from your city or the 3rd party who does it in your town or city. Ask that the water lines specifically be marked and flagged.
If they go and turn that at night. It’ll turn the water off and the sewage will stop overflowing.
If it gets turned back on… do it again, and again and again until it stops lol

How is this not a health & safety issue? How is this not a public safety issue? A public health issue? How is this ONLY civil?? Why wasn’t the house condemned & them kicked out? Especially if they’re illegally squatting after breaking in??
