    It's comforting to know that the grounds for appeal are so narrow. Definitely amusing that "common sense" is only a dirty term when the defence uses it, though.

    Didn't the same injustice happen to Gion Ghomeshi? It's bad enough that false allegations can and will ruin your life and that you can't adequately defend yourself in many cases due to the rules of evidence, but then they can keep you in court for extended periods of time, draining your finances and wasting years of your life.

    In my country the prosecutor can appeal for pretty much any reason they like, including sentencing. And they often do.
    We also have "counter appeals" because the law says that the new decision can't be worse for a lone appellant so that means if one party appeals, the other must also or the verdict can change only in one direction. If both appeal, the new verdict can be anything.
    But common sense and human experience is often the basis for assessing credibility... and your pizza guy would have been in trouble by that standard.

    This flies in the face of double jeopardy, but you are Canada, I get that. But apparently you have laws about how evidence is to be analyzed and what weight certain facts are to be given or taken away. How do these laws not restrict the judgement of the judge, who is in the courtroom and looking at the witnesses? If I was a juror and you told me that the complainant and the defendant's testimony must be considered in this specific way I would wonder why I was there. Especially this case which looks to me like the prosecutor is looking for a do over. It is wrong because the judge failed to come to the conclusion the prosecutor wanted. Now you see why we don't like Double Jeopardy.

    Bugger. No matter what country you are in and how well you might know someone, one should get video or, at least, audio evidence of consent before doing the deed.

      You can't use that as evidence in Canada, AFAIK. So even that wouldn't work.
