  • This is the third video from when the Surveyors came to reset and concrete the pins back after Karen removed them. No the fence has not moved, I need to get new lawyers. I'm working on it. Lawyers are expensive and I have a job and a life.

    A $2000 fine for removing a surveyors peg and costs to replace the peg here in Australia. It "is" a criminal offence to tamper unlawfully with any surveyors peg.

    Been following this for months. I really look forward to the court case. it's all been on film. Sad they don't realize they are in the wrong. Hopefully it cost them in the long run.

      bought a house in a nice. older neighborhood...gave the kids some chalk so they could draw on my driveway and the neighbor flipped out telling the kids they could not do that because he was trying to keep the neighborhood nice...,, we got glow in the dark chalk and invited lots of family and friends to draw in the driveway....then he started on the husband mowing our lawn, stating it was his land...had it surveyed...neighbor removed the sakes saying it was wrong....we pressed charges, neighbor brought the stakes to court in a bag and the judge kind of flipped out on him and made him pay for the survey, and installation of permanent markers.... then came the tree work, husband had some of our dead branches taken down along with neighbors overhanging branches....that was a hoot and neighbor called the cops...cops said too bad...we had the right to do it.... just a cranky old man....i started leaving the radio on and my car windows open and would use remote starter for the car, 10 mins before i had to go anywhere....WAAF worcester Ma...he didn'tt like to motion spot lights on our garage either, too bad.....

      the only time their going to accept their LOSS , is when joanne is told by a judge to remove her fence , by force , or the city/state is going to remove it and fine her . then shes going to lose whats left of her mind and do something really nuts !

    I've flipped 30 - 50 homes a year for 20 years and have dealt with property line issues before.
    Your neighbors will learn that there is no point fighting a boundary survey with closed corners, because it's definitive and doesn't care about their emotions. Removing the markers and harassing the survey crew are criminal offenses.
    Shame that instead of being adults they instead are acting like 70-year-old toddlers and will have to learn the hard way.
    You can get a lien against them for all costs and if they refuse to pay, you could conceivably foreclose and get rid of the problem forever, though that's an expensive way to go about it.

      I had boundry issues when I purchased my home in Alabama. Had an encrouachment of a shed addition ranging from 3 - 12 feet. Tried to show them the survey and they refused to listen to reason. Hired a lawyer, encroachment was removed within two weeks. On the other side of the property, that neighbor believed the real estate agent on lot lines. He was trying to claim a 40' x 250' part of my property. Same thing, but no lawyer. I put stainless steel spikes by the rerod and one in the middle. He pulled them up within a day or two. Cannot proof that. I did start cutting my own grass and make sure the 40' x 250' is cut 1/4 less than the rest of the yard. The later neighbor has been okay with everything, but the first refuses to acknowlege me at all.

      PLEASE PLEASE after ALLLLLLL of this go after them for EVERY single thing you can! Every lien for the full amount and don't stop-foreclose if you must! Make an example out of them! This video will then stand for all others who think it cannot happen to them. Update: didn't consider both to be in a state of dementia... changes things like the you tuber taught me below.

      No, I think that's where you're wrong. Neither of these two will ever expect where the property line is, unless its in there favor. Or where they believe it is. Ive watched all this from the start, And at one point I thought it was Her (Joe Ann) that was the problem. Now its him doing all the bitching. I suspect one or both of them are starting to have some "Cognitive Functions Issues" All the signs are there. Anger, Easily agitated, Easily Confused about common sense issues. Making claims about things that they believe is correct in there favor. Not willing to except what these professionals are likely to tell them. And believe that everyone is out to take something that they believe is there's away from them. Dementia is a UGLY Disease, And your likely getting a front seat view of the early onset of it.

    Noticed that he's muttering about the "mapping department."
    The last issue I had with a lot line dispute came about because our architect used the map that the county had on record but the HOA had an actual survey. Guess who won? The survey won, we lost, maps that counties have are often not accurate and you cannot rely on them for construction.
    In our case, we were flipping a house adjacent to South River in the Annapolis area. Our property was right next to the water but the HOA owned the shoreline, we wanted a big deck as close as we could get to the water. Our architect used the map on record at the county for the permit, the county approved the permit, the HOA challenged the permit, we had a hearing and the HOA survey was the prevailing document because it was the ACTUAL boundary of the property.
    We talked with the HOA president before the hearing and as soon as our architect saw the survey, she said that the survey was correct and that her drawing was wrong. The HOA agreed to allow us to build the deck right up to the property line but not over it. We didn't hesitate and took their offer, they could have forced us to abide by county setbacks which would have resulted in a deck that was much smaller.
    Your neighbors have NO idea what they are talking about and are too stubborn and stupid to figure it out.

    They have been down to the "mapping department" that's where they get their corners they have to go off of to replace the ones these morons keep pulling up. Removing those markers is also a crime. In most states I've ever heard of land surveyors have every legal right to be on whatever land they need to be within reason to perform their job. That includes going over or around their stupid fence and digging in the middle of the front yard if there is a marker there.

    That man is drinking the same Kool-aid, that JoAnn has been chugging. He was a little bit reasonable when this all started, but oh man has gone just as bonkers. Are they eating or drinking something for "health" reasons that isn't prescribed? Because dementia is showing at a hugely fast onset.

      There is DEFINITELY some "Cognitive Functions Issues" going on here, With BOTH of them. And im afraid that when the Court decides that they are wrong. Thats when this will escalate to the next level. Early onset of Dementia can be the most DANGEROUS time in the illness. Why?? Because the family usually doesn't see it, or denies it. The person with it is highly confused, and believes its a conspiracy to take something away from them, that there 100% positive is there's and always has been. And all of this can go HORRIBLY wrong on a bad day and they feel they have no choice but to resort to VIOLENCE. Plainly, Its how people get shot and killed. And why Domestic violence calls are law Enforcement worse nightmare. More Officers are killed every yr on Domestic Violence calls than anything else. Emotions are pushed to the edge, And its taken a HUGE jump since 2020 with the Covid-19 restrictions and lock downs.

    After seeing the last video of the new survey finished, it’s really obvious that those two shrubs were planted just inside the property line, I’m assuming by the previous owner. So someone once knew exactly where it was, although there was no fence.

    I recommend that you quick baiting him for comments..... first it does not have help the situation as it makes the job of the surveyors job harder , second in court it could lead to a counter suit for harassment and third if something were to happen to them.... lets say a medical incident or injury, it opens the door for a suit. I know you have been through a lot with this, but beyond providing the contact info for the survey company or idenifiying who they are, I would just stay quiet and keep recording for police/court purposes. If the survey markers are correct, you will win the day in the end.

    Neighbor next to my Father's place put in a central heating and air system. The properties were so close the exterior unit went over the property line by three inches. My Dad just asked to be invited for cook outs when ever they had them as compensation.
    It's so easy to be easy going. Those people are just angry that their hate wont fill the hole inside them.

      I beg to disagree with you. Ive been in this EXACT same situation. The city doesn't care because its not there problem. Same thing with Law Enforcement, This is a civil matter. And as long as it doesn't turn into a "Domestic Violence" Or a case of "Assault" They really don't want anything to do with it either. This is for a Judge to decide in civil court. And with the courts just now starting to get caught back up from the last 2 plus yrs of Covid-19 restrictions and delays. This hasn't and will not likely be rectified very quickly. I truly believe that Jack and Joe Ann will likely tell the court they don't agree with the outcome. And will likely REFUSE or NOT COMPLY with the Courts finding. And will continue to drag it out until there found to be "In contempt of Court" And thats if the Judge really gets sick and tired of the nonsense from them. In our case ( Not in the time of C-19 Delays) It took almost 4 yrs to straighten it out. And more $$$ than it should have. Yes, We tried to recover those costs. But that civil court Judge felt sorry for this family and there alligator tears. And told us, Be happy with the outcome we got. It was the cost of doing business. Which lead me to be sure that when she came up for re-election, She ran into a BUZZ SAW and lost by a 6-1 margin. And I told her that to her face afterwards, She said "I hope you are happy with the $$ you spent to get someone else elected" And I said do you remember what you told me??? "Its the cost of doing business" And it was well worth the $$$ to retire a worthless corrupt Judge.

      Oh, please! Property line disputes are not uncommon and rarely end in violence. If there is violence, my perception is that it is the aggrieved party more likely to initiate and it is more likely to be property damage than physical violence.

    I live in NYC and I want to sell my multifamily and part of the proceeds will go to a country home. Somehow, I'm finding out who my neighbors are before I purchase anything. Somehow... Because I would not be a happy camper in a situation next to this kind of people. I'm glad this man can laugh at it all. I've had bad neighbors in the past and it sucked the life out of me.

    I will be watching. Similar thing happening on my property. No other houses involved with neighbors. Thank goodness. But the old coot farms the land and put torn down buildings junk on my property. He just cannot accept the fact that he no longer owns the property. He owns over 40 acres. WTH? Is he that damn greedy?

    I had a property line issue on one of my rentals in Buffalo, NY. My neighbor insisted his property line was 6 ft farther than it actually was. When I got ready to put up a fence, I had it surveyed and I was correct on where my property ended and his began. He was pissed about it, but didn't fight me on it. He never talked to me after that. Later when I moved to Colorado Springs, I sold my rental to the neighbor on the other side of me. The day after we closed and they took possession, neighbor #1 tried to tell the new owners that the fence was on his property. They showed him the survey that I had left with them and shut him down again. I have a feeling that every time that house changes ownership, neighbor #1 is going to try and claim that 6 ft.

    One more thing. I agree with others who said to go after them for EVERYTHING you have a legal right to, because they have raised the bar so high in aggression and digging in their heals they will NOT respond reasonably NO MATTER WHAT, even if court rules in your favor. There are legal remedies and punitive remedies for a reason, their behavior is exactly why these remedies are there. Some people have to learn the hard way how to be a respectful civilized person. They obviously don’t care about you and yours AT ALL

    Boy now I see how close they put that fence to your new construction in the back of your house. My neighbors on both side of my property pulled out the stakes in less than a month after I was surveyed. Best to cement them in and use rebar post. I was young and dumb and didn't know that was a thing .

    Had a home yrs ago..neighbor claimed property line was 20’ from where I believed it to be..kept bitching about my horse pen and mowing my section of grass..when I sold and moved,a survey was done..property line was where I thought..5 feet from his home,not 25..😎🤣🤣

    Had same thing happen on my father’s property. I checked with surveyor for details, then cut the wooden fence posts with a power saw.

    what is needed is a law that states anyone with legal proof of Moving, covering or removing a surveyors Pin should be automatic be fine with the cost of re-Surveyor's cost Plus a Fine. This fine triples each time and the only way it can be moved is by the court and or a mutual agreement between property owners. The law keeps it a civil matter but makes the marking a legal matter until settles in court

    As soon as he walked back up the hill and then over to the fence, I would have been like "I need you to get off my property, I've asked you nicely, you need to stop trespassing." just would have thrown his words back at him anytime he crossed that line that the surveyors were confirming. Then tell him "don't touch MY fence."

    I don't understand why you would need a lawyer. Take down the fence, it is on your property. Let them sue you. It will never get to court because their lawyer will tell them they are full of $$$T. If they do get you to court, THEN take a lawyer, two surveys, and recordings of the harassment, and the judge will ask them for their non-existent survey, tell them to leave you alone and take down the warning bull$hit and pay you for your lawyers and trouble. Why on earth would you need a lawyer if you are in the right and nobody is suing you? If the cops come out when you are demolishing the fence, tell them it is on your land and here is the survey. Cops love to tell you to do nothing and get a lawyer, so they don't have to file reports, but even THEY cannot stop you without getting sued. It's your damn land!

      I have a cousin that owns a Surveying business. Believe it or not, (at least around here) He doesn't see or deal with to many pissed off land owners. And those that he does, Are usually the elderly with cognitive issues. The worse one was back in 2007 in SE Ohio where a 86 yr old male fired 2 shots from a 12 ga. Shotgun into there parked trucks windshield. He agreed to sell his mineral rights and have the Oil and Gas company drill on his land. Then 5 months later forgot and it got ugly. After he was arrested his family had him put into a full time care facility. Mental illness/Dementia can be such a treat to deal with.

    It just mystifies me why they didn't discuss the desire to build the fence before the first time the shovel broke ground.
    You had said you were friends with them before all of this but even if they were complete strangers, common decency says they should've knocked on your door to tell you the plan as a courtesy.
    That would've nipped all this boundary line dispute in the bud. Heck, you fuys could've split the survey cost 50-50 since it benefits both of you to have things accurate.

    First off if he thinks that the surveyors are on his land then maybe he needs to pay for a survey. Second for a lawyer check with colleges around you that teach law, here in Chicago many people will take their cases to the school to see if the law students want to get some practice in law and their professors will assist them.

      The fencing company took the couple's word for where to put the fence, EVEN THOUGH they were told by our host here that the property lines were marked based on a recent survey. They were told to verify the line, but they ignored him and kept installing the fence anyway. As Chad and Joann have said; "We ain't got no guy."

    All ya armchair legal experts haven't been paying attention. Redzot's previous and current legal counsel have given solid legal advice. Such as DON'T remove the fence ... let a judge rule on that.
    Sorry Redzot isn't meeting your entertainment needs. Everything you armchair lawyers recommend is exactly the opposite of what Redzot should do.
    Courts move slowly. That isn't Redzot's fault.

      In the State of TN its illegal for me to remove the fence as it is considered THEIR property even though its installed on mine. Feel free to call Metro Nashville Cops if you want. They will tell you the same thing and yes they would arrest me if I did it or at the very least charge me with vandalism/destruction of property/ect..
      If I were only an Antifa member.. then I could get away with it but sadly I am just a dude.

      @Kirk Cameron Huge difference between a tree branch and an entire fence. When there's an issue with a tree you can cut it back vertically along the property line. There's a chance that a tree can do damage to your property whereas a fence in the ground cannot. Tree branch can fall on your house, garage, shed, pool, fence (ironically), and do damage. A fence is just sitting there minding it's own business. Hahaha

      My lawyer took care of it with omne letter to the home owner. Of course they hired a lawyer who I believe backed up my lawyer as the encroachment was removed within two weeks.

      @@bryanhoffman8782 if you have them dead to rights, a lawyer letter will usually work. I paid $150 for a letter to my neighbor saying when either piece of property changes hands, the boundary will need to be restored (the soft option). Six months later his shit was off my land.

    Here in mo a friend got a surveyor out to plot the property line the previous owner put up a fence with out doing a survey he was 24" inside his property set back
    But the negibors figured it was his property line and added to it to close in his yard, well the fence had been done very sloppy so the current owner with the true property line took the fence down and moved it 24" over onto the line
    One house had a very big yard, the other house had a small yard that got even smaller.
    Just goes to prove you can't trust the fence is on the property line.

    As the fence is on your land, take it down. When Chad calls cops and they arrest you (let them do that) you will be taken to prison. The police may then try and prosecute you for damaging the fence which you will be able to proove that the fence is on your property. Thereby saving you the expense of having to take Chad to court lol

    ARe there any "official" maps on record that corroborate the neighbor's perception of the property line?

      Sort of. The subdivision map shows a utility pole as the corner near the street, but the ultimate location of the pole may not necessarily be the same. From the other videos, the neighbors seem convinced that that is the property corner at that end. Down the hill you can see that the concrete is somewhat recent, meaning that it has been either replaced or installed since the couple moved in. I believe that the couple is basing the lower boundary off of whatever was there previously which may not align with what is there now.

    MAN!!, That's jut too freakin funny. That old man better watch out, he's going to give himself a heart attack. I wish I had neighbors like that, I'd fuck with them every chance I got. And film it for CZcams. I'd bring my work crane home, and screw in those power pole anchors in on my side of the fence. They would have to dig deep holes, about 18 inches in diameter, to get them out. Then string them up with strobe lights. Or use the pole we use, to reconnect the power circuit breaker, to rip that speaker right off the wall. Just to name a couple of cool things to do. I would just have a freakin BLAST!!
