  • Since our new friend in the white Lexus showed up there has been some activity. I have a feeling he is new representation and told them to get this one. If so that is kind of shitty as this is the THIRD survey that has now been done on their land. I mean... 80ft is 80ft. Not sure why this is so difficult.

(By the way, two other brainiacs and quote attractors, Ben Franklin and Mark Twain, are also credited with coining this idea.)

      ​@@clydeleigh3266possibly maybe. The surveys are the property of land owner and the company that did the survey in my state at least. I am not sure if a judge can force them to produce the survey. The judge may be able to require a survey though. Maybe she will be forced to pay for a 4th survey of she's not willing to provide the previous 3 lol.
      But either way no survey is going to give her the result she wants. Hopefully by the 3rd time she accepts reality.

    Perfect survey from that company. They used established reference points from different angles and they appear to match the plat map perfectly. That's why keeping survey pins on your property clearly marked and visible is important, for as long as you own it. If a small metal pin isn't visible enough for you have it made of concrete about 3 feet deep. You will never get an apology from them. Being clearly wrong doesn't work for some people. They have never been told they were wrong and accepted it. All those surveys and attorney fees are not done cheap.

      The first survey was like this as well. 3 guys and all the GPS/Measuring equipment you can fit on sticks. The second one was just 1 guy so not sure how accurate his was, however he could measure 80ft and came up with the same conclusion.
      I am thinking in total all 3 were at least 10 grand. I called my guys and said just come verify this line on the plat, they did. Reset Pin. + the replacement pin was all under 1k. Same conclusions every time.

      @@redzot The three guys just save a bit of running around. One man can easily and accurately survey a plot with an electronic theodolite. He just tells the total station he's in place, and gives the place a name. The station seeks his retro-reflector and records where it is in reference to itself.

    I don't understand throwing good $$$$'s after bad things!!! I thought that they are living on a fixed income, guessing that they have money to waste, and waste it they are doing!!! Hopefully their Lawyer is going to give them straight up facts about "the fact that they are not going to win this one"!!! That's why they set property lines and set corner posts, or at least they used to do so. With neighbors that decide to pull up the property markers and just decide where the markers are supposed to be, it's a silly mess of her own making!! Such a shame that it's taken so long to get her Lawyer to actually look at the case and take the time to understand that his client is WRONG!!! I wonder if her Lawyer will be able to convince her to give up???

It's just that simple, this isn't rocket science or complicated psychology, she just wanted to take what was yours because she thought she could. Five fucking feet! I can't wait to see how this all goes down, and you're too nice of a guy to laugh in her face like I would. I have absolutely wonderful neighbors, we all love each other. We all look out for each other, this wouldn't even be an issue with us. Sorry you had to go through this man, you seem like a good dude.

    Watch, when she's forced to remove the fence, she'll have it rebuilt directly on the property line in the middle of the easement. It would be hilarious if the utility company came out the next day and tore it down to dig a hole.

      @@TheStobyReport No, it’s not. The easement is there because of facilities that are buried underground between the two properties. Her usage of that easement is limited.
      She can put a fence there, but if the city needs to access those utilities they are just going to rip it up and may bill her for the extra work required.
      Around here, if you put a fence in that type of easement, you’ll get cited by codes and if you don’t remove it you’ll get fined.

      @@SeanPat1001 I assure you that I know what the easement is for. Her usage is limited, but not so much that a fence can't be erected. She couldn't erect a garage; that she'd be charge for. And the easement is irreverent to the issue and shouldn't even come up in court. The issue is the property line.

      @@TheStobyReport The platte map is shown at 0:15. The easement is 15 feet wide, half on each side of the property line. I have easements on my property. I can’t put anything in them, except grass.
      The reason she put the fence where she put it was because she could not put it in the easement. That came up several times.
      He can’t put a fence in his side of the easement, either.

    So her argument is basically that since you can’t build a Boundary Fence down the centre of the Easement, the Fence should be on your side of the Easement and not her’s, thus giving her yard the appearance of being bigger.

      I'm still wondering about the length of the two yards. We know the 80-ft width, but how long? This is what can calculate Square Footage so rental-fees can be applied. And I don't forget the 'hit on the car' that occurred.

      Hard to say. With the contractor coming by, they may be getting ready to have the fence moved and needed the correct property line marked. Technically you are not supposed to build on the easement, but I am guessing no one is going to say anything about that fence. They will just tear it down if they need to get to the drainpipe.

    The neighbors lost all credibility with their attitudes. Innocent people don't react like they did. They don't become passive aggressive or even outwardly aggressive like they did.     Poor soul, she thinks the easement will change in her favor whenever she hires new surveyors they are not cheap. You gained about a foot more property.

      Very unlikely on the gain of a foot. The stake they put in was merely a witness to the old marker. Any error between them would only be on the order of a 1/4".

    The RE agent may have insisted on the survey because there's a dispute. They'd know it's going to be an issue getting title insurance. The agent may refuse the listing until it's resolved.

      Not for sale. This is a property line dispute. She built her fence several feet over the line into his property. She kept pulling out the survey stakes that were put in. They finally set it in concrete. He's tried everything to resolve this. They used to be friendly neighbors but she's gone squirrely and will not listen to anyone who doesn't see it her way. Been hell for this guy for MONTHS.

      Don't ever believe title insurance has ANYTHING to do with boundaries. It is STRICTLY for defects in title, ie; a provable claim by an heir that they held an interest in the property that was not properly cleared, or a similar claim.
      Title insurance WILL NOT cover ANY problem could have been found by the due diligence of a land surveyor and you will have NO recourse. Period. Read the policy.

      Your actually not far off. once you factor in the easement its only about 4ft off their house. Mine is the same way on the other side with my other neighbor. I was a little bummed when I saw that but made the needful corrections. I also have a very good relationship with that guy.

      That WAS impressive. That's what I was used to. We subdivided our new block into 20 yards with a giant park 'in back' of all of them. These costs were well about $4k for each yard BUT they sent a team back after original landscaping (because it effectively destroyed some markers) and we just wanted to be careful. Of course, that was 2018-2019.

      I have this rule that my wife never liked. I told her not to get to friendly with neighbors to close to where we live. Make sure they are a few houses down the street at least. It has worked well for over 30 years. When you step out of your home, you don't want to see your enemy day after day. This is what is happening here.

    I am curious how much Karen is paying for these surveys. We had one done years ago as a neighbor moved their fence onto our property (by 21 feet). That was 20 years ago. That cost almost $800. 😂😂😂

      @@dwaynemorris3079 the current estimate is from 150 to 800. If I remember correctly redzot said his was a couple hundred so as a wild ass guess I’d say 500 or more as it was more thorough. But that’s just based on what I’ve seen in the videos.

      @@eschultz19661 That is if you don't live in one of the fastest growing counties in the US with the #1 town right next door... They are in very high demand here and they charge for it. That survey was at least at minimum 4k. I was quoted 10k by a couple of companies when this all started.

    If she is thinking that circle is the telephone pole on that old hand plotted old sight plan, she will NEVER believe she is wrong even with 30 or more surveys. I hope they are paying DEARLY for each and every survey they get. I hope you are getting a list of all these contractors so you can call them in to testify. Normally if they know a litigation is involved, they will not get involved.

    So now it’s clearly on your property and built on the easement. I’ve got a feeling that this crew were sent out out by the utility companies or town hall as they walked in, done their job and your neighbours never came out to see what is going on or to tell them where the property lines should be, not where they legally are.

    Finally it looks like you will get your yard back. And get access to the land you have been paying taxes on all this time. Sad they acted the way they did. This could/should have been resolved 2 years ago. I remember her pulling out the permanent survey stakes/markers. Her bull headedness cost her a lot - multiple surveys, legal fees (hers and yours that she needs to reimburse), and the cost of moving the fence to the correct location. Also, it cost the friendship you had with them. I’m glad I have great neighbors. But you make a lot of CZcams followers.

    Please post when the fence comes out. I live in MA and when my ex and I put a fence up around out property, it was to keep our kid in our yard. We had to put the fence one foot in from the property line so that we could maintain it on the good side which faced the neighbors. Well, our neighbor on the right decided to extend "the wooden fence" with a white plastic fence to keep their dog in their yard. They also decided to plant all kinds of flowers on that foot. It has been like that for 35 years. Meanwhile, the neighbor on my left decided you wanted to widen his driveway so he could park 2 cars side by side. He asked if he could take the bushes out. I told him fine, as long as he replants the grass and he did. Then he planted pin trees right next to the fence and now I cannot maintain the fence on his side. Oh well!! Then he put a plastic shed about a foot from the fence and threw all his crap between the fence and the shed. Again, cannot maintain fence and ground cover. I should have sold it to him. Live and learn!!

      Both of my neighbors did the exact same thing, I tell them the State has a 6 inch setback for fences but I guess I must pay extra to have them educated. I'm sick of interacting with the police but I never tell them that it's actually illegal to use intimidation to get me to buy my neighbor a fence that he never installed on his land(he used my 6 inches of neighborly-easement). In my State your sheds/barns must be 3ft from the property line, homes must be setback 5ft, car parking must be 10ft b/c they contain tanks of flammables, & inside of the cities your dog-house or chicken coop must be 25ft away from the property line.

    I just recently had a survey done and the cost was close to $900.00!!! No neighbor issue, this was for new construction in my yard. I hope your day in court comes soon. But your right that house cannot be sold with a property dispute in play. BTW who wears the pants, he seems to disappear when contractors come out. Oh and one more thing ,you always keep your cool even when she's raving. Kudos to you!!!!!

    Part of me believes without a doubt that she will SUE the fence installers for not getting a survey done :) They took her word for it and I bet it bites them in the bum.

      My point exactly. Why did the men who first put up the fence not do it right? Did they not have property survey lines to go by. It looked like these men were good ole boys doing the job cheaper than anyone else and did not know what they were doing. I would blame it all on them and sue them.

    That was one heck of a survey! It looked a lot better and more expensive than the one you had done. I wonder how much it cost.
    When I was in seventh grade, I joined the surveying club because George Washington and Abraham Lincoln were surveyors. Then when I lived in Iowa, my next-door neighbor was the chairman of the surveying department. The University of Mount Knox has a very active surveying department. I found this whole thing very interesting. Hopefully, this will finally get resolved.
    Maybe someday you’ll find out why she was so certain of where that fence was supposed to be.

    They're trying to pick which expert they'll use depending on which surveyor gets closest to what they want. In your Requests for Production, ask for copies of any and all surveys and/or reports from any surveyor or third party source done regarding the disputed property including any opinions regarding same. Eventually Karen must disclose any expert's opinion that they plan to use, but the other surveys give you a lot of ammo to shoot holes in that expert's opinion during deposition.
