Only if the state has passed a 'right to enter' law but, even then it requires notification to the property owner of when you will be entering the property. If not, then they cannot enter without the property owners permission. And yes, I'm a registered Land Surveyor.

That type of case might not be what that specific judge handles but she could have easily clued Joanne into the fact that she doesn't have a legal leg to stand upon and it would be in her best interest to settle the dispute out of court.

I'm glad she filed incorrectly and that the order of protection was dismissed but in REALLY GLAD she wasn't able to keep that "sweet old lady" demeanor when she first came in. Her true colors began showing really fast and she ratted herself out saying she couldn't put the fence on the drain line so she used your property. I can't wait for a judge to actually watch her loud mouth constantly screaming at you when she's supposedly running in the house out of fear. She can't tell the truth to save her soul

I'm glad the judge had the ability not to cave & give in to her unrealistic demands. Judge clearly sees possible mental decline on her when she stated phone & computer have been hacked but was kind enough not to state that in open court, and judge noted cameras are legal so no stalking or harassing on your part. so she showed respect to both of you in this hearing. Very honorable judge.
That's one win with several more to come. I strongly encourage you to have a lawyer going forward, even if you think the witch won't show up for court. You did a good job but lawyers are better.

You never know. It might have been a random nut, someone who acted on his own accord, or in regard to a completely unrelated issue. It was prudent to not make an accusation without clear and convincing evidence that she was to blame. I once had a tow truck vandalized because someone in the neighborhood assumed that my security cameras watching my property led to his arrest for stuff he did in front of the cameras INSIDE the apartment building where he lived.
I would say the judge fully understood what happened and as sad as it is you had to go to court, justice was served. You could sue her now, but is it worth it?

You NEVER plant trees or build a fence ON property lines, every property attorney will tell you that, most cities have restrictions on how close to the lines you can place anything. Utility "right of way" is a completely different issue.
Always know the rules. And pay all the fees. My neighbor tried to turn me in and had no leg to stand on. My fence was done perfectly to code and passed inspection. His dogs have to crap in his own yard now. The hazards and expense of having irresponsible neighbors is maddening. I never wanted the fence in the first place. But no more poop is nice.
@@NuncNuncNuncNunc MOST jurisdictions(all I am familiar with) have a set boundary you can place a fence or build any "permanent" structure in relation to the property line, fences are usually a bit less than a foot, things like buildings are in the area of eight to ten feet. Bushes and trees are not considered "permanent" but when placed close to or on a property line are a legal nightmare waiting to happen so you should NEVER do that. Doubt what I say ask any Realty case lawyer.

Unfortunately, it was revealed to us after purchase by the neighbor that he owned it. He even showed the survey, which was not the same as what we were shown. He even showed us the pins. Apparently, the woman who died in our house had kids who doctored the survey.

Judge was wise and dismissed the case, she lost. But now, you can take the record of her taking you to court and the judgement to show character, and submit the videos in court against the dispute. She will make the case for you......
I hate that you have to go through this, selling the house and moving is probably the best option, you will be much happier with better neighbors. It is a 15' wide easement for utility use. The fence needs to be at least 7.5' from the property boundary.

She does her best in court to sound like a poor, beleaguered old woman who’s just minding her own business. That day when she was weeding and spraying the grass, she was screaming such awful filth and accusing you of being a pedophile- it was shocking and disturbing.
We got our case filed. Can't wait to see how she behaves when the Sheriff delivers her papers next week.

The reason for my concern is the unknown element which she brings to you're world. She's like the wind she seems to blow one way and then turn into tornado 10 seconds later. If she appeals and no doubt she will I'm sure the same outcome will be made. The main event I refer too is of course the the boundary dispute which I truly believe is a slum dunk I think you guys would say. I just worry for you guys about what she could do or is capable of., Please stay safe and be vigilant as I wonder if the car vandalism is connected somehow to her weather intentionally or not. @Ron Fullerton well, my mother bought a house that a realtor said had a shared driveway and a parking spot on the opposite side. Unfortunately, it was revealed to us after purchase by the neighbor that he owned it. He even showed the survey, which was not the same as what we were shown. He even showed us the pins. Apparently, the woman who died in our house had kids who doctored the survey.

And WHO says you can not sell a house with a property line dispute? If there is a, 18,000 commission savings, that would pay to move the fence where it should be.

Judge was wise and dismissed the case, she lost. But now, you can take the record of her taking you to court and the judgement to show character, and submit the videos in court against the dispute. She will make the case for you......

Ok. So she obviously THINKS that she cant put a fence on an easement. The easement in question runs through the property line. So she put the fence on the far side of the easement. She THINKS thr easement grants her the part of his property. Dumb...

@15:15 Never admit/state that "your anger got the better of you". A person can voice their "displeasure with annoying antics" of their neighbors without appearing to be an instigator or a loose-cannon, in the judges eyes. When before a judge, always remain and portray yourself as a calm and controlled person, both verbally and visually. (we witnessed the judge's reaction to Ms. Webb's outbursts)
