My father won his case after taking it to the supreme court of Kentucky. The neighbor used to go to the local crooked judge and have criminal trespass charged against any of our family going to our old home, it was malicious criminal prosecution, is what the supreme court of Kentucky decided. My father, David Collins was a Ranger in World War two, got the purple heart, went through so much and such an honorable man, then to have someone come in buy property, over two hundred acres and wanted to square up their property by buying our homeplace and when my father said he wasn't interested in selling it, all hell broke loose!
It boggles my mind that not only is this fence *on your property,* it's _also_ on the far side of the easement. There's likely 10' of encroachment should the city investigate.

I have a suggestion for you as you prepare for whatever your next legal challenge may be. I would have all of the dates of the videos you have saved and or uploaded to CZcams with a brief description of the main highlights of what took place in the videos. This is how evidence is organized by lawyers for trial. This way you can easily see the date she did something and match it up with the corresponding video with timestamps for each thing she did. Judges are not going to watch every second of all the videos you have. You have to prove your case to the judge and jury. You can have a list of every day and time in the video of her verbally assaulting the survey crew, verbally assaulting you about the fence, or cussing you out in racist verbiage. For example, when she was telling the judge about the time she was spraying the weed killer from Lowes and accused your girlfriend of spraying her with the water hose. You could easily look at your discovery exhibit or evidence list and give the judge the exact name of the video with the exact date and the exact time in the video when she started spraying in your yard more deliberately and when your girlfriend was accused of spraying her with the hose. This makes it very easy for the judge or jury to pull up that particular instance in deliberations and it also makes it easy for you to come back and rebut her claim when it is your time to testify and present your case under cross without forgetting about it. It basically makes you more organized, and efficient at countering her claims and presenting your case. Don't assume your attorneys are going to have all of this prepared this way. Having a case with all of the information important to you organized and cross-referenced is time-consuming and expensive when the lawyers do it on the clock. She almost came unhinged in court, it would not have taken much more for her to get belligerent and start cussing everybody in the courtroom. You have the great benefit of video evidence to show every time she cussed you out and you responded calmly asking her to please stop acting that way. She lost it every time a police officer was called and you again responded calmly and rationally. Judges and jurors pay particular attention to one person being unhinged and the other party being cool calm and collected while being verbally assaulted as viciously as she did to you and your girlfriend. I'm sorry to be so long-winded, these are just a few things I've noticed in your videos and in the hearing today.
In Morgantown, WV I can promise you she wouldn’t have gotten more than 6ft of that fence up before Code Enforcement would’ve rolled up. They are always prowling and don’t miss much. If they miss it, you’ll sure enough have a good neighbor “make a call.” My Mom’s garage roof collapsed. The next day we were cleaning things up from the alley and they pulled up with,”Did you get a permit for this work?” 😂😂😂

Hmmm, wondering what would happen if you asked the courts to transfer the property she is trespassing on, to her, and then have your tax's lowered to show the loss of use of the property, and have her taxs raised. If this all makes sense. It does not make sense that you should have to pay property tax on property that the county is not recognizing as yours.

There are plenty of shady lawyers out there. I had a civil matter some years back, gave them $5k retainer and waited, waited, waited, pleaded for an inkling of some progress. Never did a damn thing. I quit calling because that just costs $$. Waited a few months, still nothing so I called again. MY ATTORNEY had left the firm. No notice given to me at all. We were pushing against the 2 year statuted of limitations by then. I decided to just eat the loss, I was only going to lose more $$ with another retainer.

The real problem with this is the the city/metro is so understaffed that they don’t have the ability to deal with all of these disputes! You can’t even get them to come out and meet with both parties and show each the OFFICIAL plat map and show each the pins and measurements! This SHOULD be an easy dispute to solve. Where we live there is an easement. The property line runs down the center of the easement. We can put a line fence but if the utilities need access they have the right to tear it down at your cost and any cost of replacement is up to the owner.

In Illinois you have to disclose any and all issues with a property including problems with neighbors. If you do not and the new owner starts having the same problems they can get out of the sale even after the deal has closed. Don't know if it is that way where you are.

We do not have these sorts of issues in the Philippines. If you have an issue with your neighbor you go to the local neighborhood leader called a Barangay Captain and he will listen to both sides and make a decision. Generally speaking Filipinos will avoid conflict at all costs. We live on small islands (7000) Everyone figures out how to get along. For those who persist on making trouble they are ostracized from the community. This goes for all kinds of disputes including child support, viscous dogs, and property issues. Americans of which I am one are generally self-centered and egotistical. (it wasn't always that way). I left America for this exact reason.

I've had some crazy neighbors, even have one now. I love to state my side plain and simpl. Sometimes that's enough to initiate a better mutual understanding. IT’s mentioned in the court video. After the storm drain was installed, he drove his truck over it. She was concerned he would damage it, so she put the fence up. When he asked to get a survey she became hostile.
He also stated in the police body cam footage, to the officer, that he wanted to do some construction on his property to upgrade and lengthen his driveway, and he needed a proper measuring point from the properties to his driveway to get a permit.

Why is this worth the grief? We had a fence on our property and our neighbors wanted to attach their gate to our fence … it would use about 1.5’ of our property …we just said yes. It’s not as if that was going to do anything weird to our property. We just had to disclose it in the sale of the house. This mess would definitely not be worth all this stress.

But your situation is completely different than this situation. -You already had a fence (legally) where you want it. -Your neighbor actually asked if they could attach their gate to your fence. And you agreed to it. None of that happened in this case...nobody asked and he certainly didn't agree to it. In fact. when she started building the fence, he asked her to stop until she got a survey and he basically got a middle finger to his perfectly logical suggestion. -Her fence is entirely on his property...by over six feet on one end. Have you ever purchased a property? If so, would you have purchased a property if you knew there was ongoing litigation going on due to a property dispute? Probably not because most sane people would never buy a house with a pending property dispute. In short...if he wants to sell his house, his pool of buyers would be small because most wouldn't want to inherit a legal problem. The smaller the pool of buyers is, the less competition and fewer offers you will receive.
Its a shame, looks like a nice area but I understand completely on wanted to move. Hopefully this ends soon and the next buyer isn't subscribed to your channel.

In Illinois you have to disclose any and all issues with a property including problems with neighbors. If you do not and the new owner starts having the same problems they can get out of the sale even after the deal has closed. Don't know if it is that way where you are.

We do not have these sorts of issues in the Philippines. If you have an issue with your neighbor you go to the local neighborhood leader called a Barangay Captain and he will listen to both sides and make a decision. Generally speaking Filipinos will avoid conflict at all costs. We live on small islands (7000) Everyone figures out how to get along. For those who persist on making trouble they are ostracized from the community. This goes for all kinds of disputes including child support, viscous dogs, and property issues. Americans of which I am one are generally self-centered and egotistical. (it wasn't always that way). I left America for this exact reason.

Why is this worth the grief? We had a fence on our property and our neighbors wanted to attach their gate to our fence … it would use about 1.5’ of our property …we just said yes. It’s not as if that was going to do anything weird to our property. We just had to disclose it in the sale of the house. This mess would definitely not be worth all this stress.
Unless you're brand new, you'd understand it's SO MUCH MORE than just a fence. 🤔 it's a grown ass child showing her nasty ashy arse and piss poor character for the world to see.
But your situation is completely different than this situation.
-You already had a fence (legally) where you want it.
-Your neighbor actually asked if they could attach their gate to your fence. And you agreed to it. None of that happened in this case...nobody asked and he certainly didn't agree to it. In fact. when she started building the fence, he asked her to stop until she got a survey and he basically got a middle finger to his perfectly logical suggestion.
-Her fence is entirely on his property...by over six feet on one end. Have you ever purchased a property? If so, would you have purchased a property if you knew there was ongoing litigation going on due to a property dispute? Probably not because most sane people would never buy a house with a pending property dispute. In short...if he wants to sell his house, his pool of buyers would be small because most wouldn't want to inherit a legal problem. The smaller the pool of buyers is, the less competition and fewer offers you will receive.
