Arkansas State Police Trooper displays discretion upon learning driver's story (Report Included)

On Monday, April 22, 2024, at approximately 8:58 PM, I, Trooper Garrett Byrd, was traveling eastbound on Broadway in West
Memphis, just west of the intersection of South Loop and Martin Luther King, Jr. Drive. I observed a passenger car traveling
north on South Loop disregard a red light at the intersection and continue north onto Martin Luther King, Jr. Drive, traveling at a
high rate of speed. As I turned north onto Martin Luther King, Jr. Drive, I observed the car with its emergency flashers on,
traveling over the Interstate 55 overpass. As I crossed the overpass, I observed it turning onto Interstate 40 eastbound.
I entered Interstate 40 eastbound, activated my emergency lights and siren, and began to catch up to the vehicle near the 283
mile marker, where I observed it cross from the inside lane to the outside lane in medium traffic. The vehicle began to slow
down to near the posted speed limit of 65 miles per hour as I got directly behind it in the outside lane. I observed the vehicle to
be a white Hyundai Elantra with Texas tags and informed Troop D dispatch. Rather than pulling over onto the outside shoulder,
the vehicle merged left into the middle lane, behind a tractor trailer, and passed an RV on the left side. Once we passed the
RV, and the tractor trailer merged to the outside lane, the passenger car continued traveling in the middle lane and began to
accelerate to over 80 miles per hour.
At the 284-mile marker, I began to perform a Tactical Vehicle Intervention. As I made contact with the vehicle, I observed the
vehicle began to slow down so I backed off the vehicle and gave the driver another opportunity to pull over. The vehicle then
pulled to the outside shoulder at the 284-mile marker. I performed a felony traffic stop and a female driver exited the vehicle
without incident. When she exited the vehicle and as I began to take her into custody, she was visibly distraught and was trying
to explain something to me as she pointed east. She was having trouble catching her breath and shaking, so I requested EMS
for a possible panic attack. I had her sit down on the guardrail and began to try to calm her down and understand what was
going on. She informed me her brother had been shot in the head and she was going to the hospital.
The female driver was identified as Britaney Mercedes Miles. While on scene, it was confirmed there was an
unknown male at Regional One Medical Center in Memphis, with a gunshot wound to the head. Miles was evaluated by EMS
and eventually calmed down. I spoke to Miles about the seriousness of her manner of driving and not stopping for law
enforcement. Considering Miles’ previously distraught state in addition to her cooperation and apparent understanding of her
wrongdoing, given the circumstances, Miles was released on her own recognizance after being informed of her charges and
court date.
Miles informed me she did not have insurance on her vehicle at the time of the traffic stop.
She was given a court date of May 31, 2024, at 9:30 AM, at West Memphis District Court, for the following charges:
Reckless
Driving, Fail to Stop at a Red Light, Speeding, No Liability Insurance, Careless and Prohibited Driving, and Fleeing. - Auta a dopravní prostředky

This is the same Trooper Byrd who helped an elderly man broken down on a cold night on the side of the road. He put him in his car and took him to a Hotel and got him some food out of his own pocket. These Byrd boys were raised well.

I did the same thing years ago when my son was on picu a state trooper stop me I told him what was going on an he gave me a free pass and told me to follow him all the way to the hospital thanks for that I lost my son anyway but got to hold him alive one last time

That was the only side eye I gave this interaction. Kept her too long on the side of the freeway, and didn’t offer to escort her (tho I don’t know what kind of distance we’re talking about). She just wanted to make it for what could’ve been her brother’s last moments. But at least she had time to settle down.

When I saw how distress she was I started crying even before I heard that her brother had been shot in the . I think all she was thinking about was getting to the hospital and blanked everything else out. She was definitely sent an Angel in the form of trooper Byrd. He was the right person yo be there for her and did his job right at the same time. He didn't let anger rule his emotions but was able to hear and see what the problem was but was also let it be known to her that can't ignore flashing police lights.
He should be recommended for his display of what is deemed great police work🇬🇧🇯🇲

Discretion, Empathy, Compassion, I had something similar happen with a lady speeding driving crazy etc when I pulled her over here in Australia, she told me her father was just taken to hospital after massive heart attack, she was completely out of it crying could hardly stand up. I decided to rush her in my Police Car to the hospital where indeed her father was critical, she managed to spend 30 minutes with him before he passed away. I arranged the next shift to take her car home, and to take her home when she was ready which was about 8hrs later. As to charges none zip nil, I decided her loss was more than enough too deal with. She did reach out few month's later apologised for her driving explaining she was just out of it. She understood the seriousness of her actions but in her case was totally out of character I believed her. End of the day I'm more than comfortable with my actions, we Police are human and we are here to help as well as enforce the law Without emotions we can become numb to other people's misfortune. No criticism of other officers we all deal with things in our own ways . I recently retired after 37yrs as Police Officer

Only flaw with this logic is every Tom dick and Henry would say something along those lines if it meant getting out of a ticket. That’s why there is a process.
Words of the wise:
If you’re having a medical emergency, call 911. Your life is worth that ambulance charge.
If you don’t want an ambulance and you choose to drive yourself or the patient, and a police officer lights you up, call 9-1-1 and inform them of the situation. You will either be instructed to pull over and receive BLS from the officer or to yield to the officer for escort.
People will.lie and say anything to avoid cops. He had to be sure.
As one that knows Byrd, I can tell ya he is the sweetest, most polite and genuine individual. He seriously loves his job and great at it 💙

William it may surprise you to know that the majority of us have never had a drunk driving. Many also have never even had a speeding ticket.

Trooper immediately recognized her fear/anxiety/ sense of urgency and did the right thing by talking to her instead of just being hard on her. Sucks about her brother and they showed compassion but still have a job to do for the violations.
Having a few kilos of contraband in the boot will give even the most seasoned professionals anxiety.
Care and compassion would have been not giving her a book of violations. Running the red light and speeding would have been sufficient enough charges to get the point across. Her brother was shot in the head and she was in full anxiety attack, if there was ever a time to act human, that was the time. Not trying to make excuses for break traffic laws, but come on.
@@2873lonewolf actually he left off the felony version of fleeing, from the looks of it (it would be "Fleeing over speed limit" I think) I have said over and over that de-escalation should be more common once you realize more force isn't the answer. This is exactly what I am talking about. The goal is the arrest, not the officer showboating how "hard" they can be.
Compare this result to the recent case where the driver was obviously panicking and the cop doubled down and she took off again and he gleefully PIT a brand new car. It is really too bad she did not get pulled over by this officer.

My niece was making suicidal posts on social media and I got pulled over trying to get to her. I told the officer what was happening and he let me go. Not all cops are jerks. 🙏
When my sister had a major heart attack, my husband would not let me drive because he knew I would have driven like crazy to get to her. Unbeknownst to me she was already gone before the ambulance arrived at the house. I understand her pain because I was panicking as well.
At that point, he had no choice but to charge her. The prosecutor may choose to drop some or all. Such compassion and discretion. Honestly, in the state she was in and the way she was driving, stopping her and getting her calmed down as much as possible very well could have saved lives. I know how it feels to get that call from the hospital. Your brain literally stops working.

@@danielulz1640 I'm perfectly capable of reading. She was clearly in a desperate hurry to get to the hospital but they stopped her and forced her to sit around while they processed her charges. Yes she committed some traffic offences but how important do you think that is to someone who's brother has just been shot in the head? They showed no compassion that I could see to an obvious tragedy in the woman's life. Showing compassion would be to take her to the hospital and maybe even ignore her traffic offence given the emergency situation. Who knows how long it took her to eventually reach the hospital after her release without a car.

A tip of the hat to Trooper James Byrd and the other first responders - Way to go guys! Way to seek to understand first before making a judgement. This lady was scared out of wits and not thinking clearly (for an understandable reason), and you calmed her down, made sure she was OK, and sent her on her way. Excellent work and thank you for your service to our community.

This almost made me cry. I lost my youngest brother last year to stage 4 cancer. It hurt. We are still grieving. I understand that kind of sibling love. I hope her brother survives. Poor lady ❤❤❤
It's been two years since I lost my older brother. The whole ride home I did nothing but cry. Couldn't sleep for months because every time I tried to I'd see his lifeless body in my mind. Sorry for your loss and I hope you and your family have all the support you need during this difficult time ❤

"Hands tied", she broke traffic laws and was speeding and not rational, putting others at risk; not to be unempathetic but that's extremely dangerous behavior and she needed to be pulled over. As for the time held, I suspect there's only so much an employee can get away with. Body and dash cams means everything is observed by the upper ups; sadly this means awful things get burried and good actions not permitted are punished.
I've certainly been punished a number of occasions for doing the right thing against policy; and for many that means being fired, stripped of licensure, or blacklisted locally to work for services.
I don't agree with it, I'd be a hypocrite saying I'd of done the same, but the way most services are set up, I can't fault the guys on the ground who do their best to stretch their permitted compassion.
If you hate it, call your local representatives. Phone calls work, in volume, to make change; however most people simply turn away while asking why no one else will take the effort to make a difference.

Jacob is based in Little Rock, James or Garret's report show he is based in West Memphis.
To add confusion, there's two Byrd's and a Bird working for APD.

James and Jacob graduated the same day from the Police Academy, listed as a year apart in age. Garret the following year, the Bird a couple years before Jacob and James.
So many officers wouldn't have believed her and just cuffed and drive her to jail without a second thought. Trooper Byrd you never fail to amaze us with how much you truly love your job and show how your community is important to you.

my nephew once had to have emergency surgery. My brother was traveling at a high of speed from work to get to his son state Highway patrol pulled him over. He told the officer what was happening, and the officer got in front of my brother turned on his lights and escorted my brother all the way to the hospital to his son.!! that was a good officer!! Jackson County Ohio State Highway patrol… thank you for your compassion!!
That engagement could have gone so wrong and been seen as justified. Don't drive when under distress, killing yourself and or others is not worth it. That trooper has good instincts.

It’s good to know that there are still GOOD COPS that understand emergencies & help a fellow citizen when possible. He IS a GREAT MAN for being so empathetic to this lady’s emergency.
I know I’d be the same way if one of my baby brothers had been shot. I’m from Texas, but very familiar with West Memphis Arkansas, I stop there every time I’m headed to Kentucky or West Virginia, eat at that Cracker Barrel and refresh myself, usually driving on to Bowling Green from Dallas.
I can’t imagine the anxiety she’s feeling while he quadruple checks her story. I’d be losing my mind.
Couldn’t they have given her a ride to that hospital her brother was in so she could see him before he died from that gunshots wound to the head???

My dad died at a very young age and suddenly, and my stepmom ran out into traffic. Her sister was stopped on the way over to the house. No one knows how they're going to react when they get this kind of news, and sometimes you have to get somewhere fast, and rely on the kindness of others, because you just kind of lose it for a while.

I’m sorry, maybe I’m the only one that feels this way in reading all of the other comments but I feel like the officer could have done a lot better job in this situation. If he truly had compassion for the driver he wouldn’t have kept her on the side of the road for so long and would have done all he could to get her to the bedside of her brother. For what very possibly could have been the last moments of his life. That was the rush. That’s why she was freaking out and trying to get there. Then did he really need to give her a ticket for everything possible? No break in this situation? If not this situation then what kind of situation would he give a break in? Just my thoughts. I know he’s a good and compassionate officer, I’ve seen him in other videos. Maybe that’s why I’m disappointed, I know he’s capable of compassion. Well I guess they both have a heck of a story to tell if nothing else.
She definitely needed to be checked out by EMT first. She was in no state to drive. Why have two tragedies in one family at once? I doubt if she could have seen her brother anyway, as he was probably either in a Trauma room or in surgery. It’s not worth the risk.
Policy dictates what actions he HAS to take in that scenario, officer discretion only has so much weight, with every single thing being recorded this officer understands accountability while leveraging his compassion. If he didn’t follow policy, he wouldn’t keep his job long enough to continue to utilize his compassion.
I respect all LEOs, local, county, state, and federal. Being retired, it warms my heart to see the compassion displayed by the local police, EMTs, and ASP Troopers. I watch all of Y'all's videos and have grown to deeply admire each and every ASP Trooper. I have a cousin who is currently the Troop Commander and is in line to eventually be the Colonel for the NCHP. Like the Troopers with ASP, he carries himself well and is fair but firm.

The appropriate way of dealing with this would be to have escorted her vehicle to a safe location to leave it, then the cop drove the both of them to the hospital.
IF she deserved charges or a "Speaking to" it was not in that moment.
She didn't harm anyone, if we the people delegate our authority to our neighbours whom can then drive like first responders are expected to do in an emergency, then we can do so too given the same circumstances.
I once had to do the same thing, only difference, the police that seen me run the red realized WTF was going on and helped me get through traffic and to the ER, didn't even ask me what's up until the hospital staff had the person out of my truck and in the doors of the building. I didn't get charged, I didn't get spoken to like a child, I gave my ID and in return I was given a handshake.

Compassion would have been getting her an escort to the hospital to make it there before the event that her brother dies. Not keeping her half hour+ and loading her with tickets, but I suppose in Arkansas this is compassion.

While I understand Trooper Byrd is doing his very best in handling this situation I don’t understand why four other officers need to stand around for over 15 minutes when their help is clearly not needed.
He needed those extra cars blocking off lanes seeing as they were gonna be on the side of the road for awhile given the situation. Last thing you want is some bonehead driver not paying attention and hitting you and everyone else on the roadside at 75mph. Happens all the time unfortunately

Trooper Byrd, again you show above average professionalism. This woman was greatly distraught. Her shaking was genuine. I heard her say her brother was shot in the head and she was going to Regional One (the old Med, with Elvis Presley Trauma Center). Calling EMTs was good, working with her to try to sit and calm down, good. speaking with police and other responders was good. And you confirmed her story. good. But she surely was in no shape to be driving on interstate or in Memphis to that horrible hospital. Their trauma center is truly helpful.
How is it going to help your family situation if you kill yourself or others by driving in an unsafe manner?
The answer to that question is obvious to those of us who aren’t currently in a state of panic. Reason is virtually impossible when someone is in fight/flight.

When my son was 8 years old his appendix ruptured. They had told me he was fine and the other doctor was wrong so I went home late at night planning to come back early in the morning. At 5am they called me saying they were taking him to surgery. No way until I got there!! I was flying low as the hospital was miles away at rush hour traffic. Of course I was stopped. I did stop and ran out of the car and up to the police car. Wonder I didn't get shot. I threw my DL at him and told him he could do whatever he wanted with it but I was going to my son. He would have to shoot me to stop me. He said "Look, if you smash up trying to get there you will be no good for him that way. You need to slow down and get there in one piece." he did hand me my license back and didn't even check it or call the hospital. He let me go.

Why didn't one of the officers just drive this understandably emotional woman to the hospital in her car, with his partner following in the police car? She is obviously worried about getting to her brother before he dies. Instead, the cops detained her for at least 20 minutes, which could mean the difference between saying goodbye to her brother and not. How would the troopers feel if they were in her shoes?
Trooper Byrd is one of the best. My favorite. He's business but has compassion and humanity.
They showed very little compassion with the charges there at the end. I miss the days of compassion. My dad drove just like that when my brother was headed to the hospital in a helicopter.

MEMPHIS, Tenn. - A man is in critical condition after being shot in the head by his cousin, according to Memphis Police.
Wednesday night, officers responded to an aggravated assault at McLemore Food Mart in the Glenview area.
Driver charged after men hang out of windows with guns: MPD
The victim stated he was at the intersection of McLemore Avenue and Rayner Street when he approached the suspect, telling him, “I don’t know what your mom got going, but I didn’t do it.”
MPD says that is when the suspect pointed a gun through the window and began firing multiple shots.
The victim was shot in the left side of his head. He was taken to Regional One in critical condition. Seven bullet holes were found in his car.

If you call this good then a North Carolina highway patrolman back in the 90’s was a saint! My uncle had been burned severely and my cousin-in-law was driving himself and my cousin to the hospital about 30 miles away. Had flashers on. Patrolman stopped them, asked what was going on and then told them to follow him there with blue light escort! Took all of 2 minutes at the stop. This crowd wasted almost 30 minutes of this girls time. Not very caring in my book
dad had escort after being pulled oer while i was dying in back, he got escort & right into intensive care 4 me. There are good ones.
