    Problem with ESRB, is they do just about nothing, I mean the activision straight up said that CoD is aimed at being marketed to children, despite it holding an M rating.

      The point of the ESRB is to help the parents decide what is right for their child. That's why they hold no legal value. Sometimes they go overboard with an AO, but they exist specifically to AVOID there being government regulation.

      Or games might not be released in the UK at all.
      I don't think publishers, developers etc. would leave lootboxes out of their game to release them in one more country.
      It would not even surprise me if they were to raise the cost of micro-transactions to make up for lost sales.

So in essence, you stil have a very high chance of getting practically nothing... *just like gambling.*

    Make sense, loot boxes are a form of gambling and gambling is severely regulated in many countries.
    I never thought about it but this may actually be the best way to fight lootboxes

      But that's different, i have no problem (in theory) with paying 10$ fir something if i really want that thing.
      It's a different concept to spend 10$ so that i may get what i want if i'm lucky.
      Some companies (EA) has terrible DLC policies but let's be fair, not all dlc are bad and they are still better than loot boxes that you have to buy with real money.

      Francesco the reason they put dlc in the first place was to countre inflatation and keep retail price the same. But with micro transactionsts it's about making money. Overwatch I am happy we get dlc maps and game mod without paying extra. Granted I still don't like loot box.

      Yes, but then again, America has very, I mean VERY loose laws when it comes to gambling. I don't know much about American law, but for all I can say is that each state has different laws and works different, so although in one Gambling may be forbidden (although I'm not sure about that), the others are taking profit out of it (Nevada for example). And, although they're technically part of the same country, each state would have to get a petition on it's own.

    It is interesting that lootboxes doesn't count as gambling (So far)
    Yet the "gambling" in fallout new vegas made PEGI label Fallout New Vegas with the gambling rating

      The Infamous Cloaker Videos- I think its the difference between a Slot Machine and a Gumball machine. You are guaranteed to always get a Gumball from a Gumball machine even if its a flavor you don't want. But you could play the slots all night and not get a dime.
      If there was a dedicated aftermarket for all lootbox items one could make a case for one group of items being valuable and another group being valueless. That would get you back to the slot machine analogy.
      And that type of system they can regulate as i understand it.

      No, it's not the difference between a slot machine and a gumball machine. Fallout New Vegas in game "gambling" of betting in game currency for more in game currency is neither a slot machine or a gumball machine. You cannot spend real money on Fallout New Vegas gambling. You can spend real money on loot boxes.

      The lootbox stuff that you got but didn't want is of same intrinsic value as the stuff you wanted but didn't get. Its all pixels/gumballs.
      Unless somebody can prove there's an aftermarket for those items alone. Which is the the US's stance on the matter. Except they used card games like Magic the gathering in their example.

    This is a good step in the right direction. Major gaming regions (North America and Europe) have a lot of say in what is or isn't acceptable. Pushing for regulations that may curb the virus that is micro-transactions means more in those regions than almost anywhere else. I hope something comes out of this.
    When I buy a game, I want a full game .
    I'm not asking for much.

    I just want to see that only micro transactions be in ONLY F2P games, there is no reason for micro transactions, ESPECIALLY PAY TO WIN LOOTBOXES, be in a PAID game. Its like buying a fridge with no shelves on the inside or an oven without any racks or burners, they're purposely unfinished for the sole purpose of squeezing out as much money as they can.
    Keep that shit in F2P games, its fair game THERE, its obnoxious to be forced to pay an additional 100 dollar on top of 60 to get the "complete package" (Looking at YOU, Destiny)

    I was thinking if it would be possible to make games that have in-game gambling loot boxes rated AO (Adults Only) making them unavailable to a vast portion of the gaming population. Of course you would have to make the AO rating 21+ instead of 18+ because that is the legal age of gambling (at least in the U.S.). This would force companies to stop these predatory practices because of the amount of money they would lose as well as drawing attention to the issue. Imagine if publisher HAD to put on the box that their game has gambling elements, I think a lot of parents would shy away from buying it for their kids.

    Disclosing the odds for loot boxes isn't enough imo, buying a loot box that way with in game money that's fine, I don't care, but if someone spends real money they should know what they're getting for that period.

    Definitely agree with everything you said in this videos,I often share videos like yours discussing topics like the toxic loot boxes,most people I know are highly on the defence but some have also admitted if the publishers can’t regulate their own Microtransactions properly from the beginning than none of this would be happening.

    Perfect World, a game I used to play regularly, started introducing click-bait loot boxes into your inventory. You couldn't get rid of them or even sell them; they stayed there until you opened them (with a bit of cash). I stopped playing it and will never go back. That kinda put me off it for life. I hope this does gain some momentum.

    I’d love to hear what video game devs and exects have to say about this. I know an ex-Bungie dev was quoted giving the “but people have families, THINK OF THE CHILDREN” speech when asked what he thought about people’s negative feelings towards micro-transactions, and I kind of got a kick out of that.
    Most everyone has a family to feed, buddy. Even before loot boxes were a thing.

    This is all because of mobile phone gaming. And the way this activision system sounds, who’s going to play? Why play against people that over power you and vice versa? Where is the fun in that. Mp games need to return to how the original halo was. Every one starts the same, every one has the same chance to get power weapons. That’s how it should be.

    UK citizen here. The gambling commission will only have skin in this if the content of the loot boxes can be traded back for real money. To my knowledge this is rarely something the game actively allows. Currently loot boxes work more like buying a mystery toy. Something that's pretty big in kiddy sections of shops in the UK (a sealed bag containing one of a variety of toys, you have to buy loads to get the full set of toys) Loot boxes can contain a variety of things but so long as the game publisher can give a bullshitty reason why the worst thing the box can contain is worth at-least the value of the box then again it's not going to be something the gambling commission will be able to regulate.

    Good, I'm glad this kind of thing is starting to reach the ears of at least one government. It is gambling, and should be treated as such. And if governments start passing laws requiring it to be regulated as such it will no longer be as profitable to these companies to do this. If even one region, like the PAL region, has governments start passing such laws such as this it will still cause a lot of trouble for its worth to game publisher. As that would require them to pour more money into the games to change them for just those regions.
    Of course, I'm not naive. Such a thing happening is a ways off, and it's not guaranteed. But at least we're seeing movement in the area now. Because it IS gambling, and in a lot of cases it IS targeted at children too. Heh, even if it were just something as minor as requiring the games be rated something like AO (Adults Only in the ESRB rating system, and it is rarely used) would be a huge dent in these companies' profits.

    I hate lootboxes, but getting the government to regulate videogames is a horrible idea. The best thing to do is inform consumers and get them to spend their money elsewhere.

      Pedro, that "free" content was severely lacking, as in missing. Dunno what rose-tinted glasses you're wearing but there was almost no customization possible in the old games, no alternate skins for the playable character, no skins or shaders for the weapons and so on. Look at CS 1.6 , Assassin's creed 1, Mass Effect 1, Left4Dead, Batman Arkham Asylum and so on.
      The old games you hold in such high regards, were quite limited in the customization department. Mostly because the producers/devs had little incentive to allocate more resources for extra skins and vanity items.

      +asher taz Look at Ratchet & Clank 3. There were like 15 different skins all collectable in game. Look at San Andreas' Mod Shops. Look at the hat stand in the street fighter movie with each hat based around an alternate pallet for M. Bison, that's a lot of hats. Look at any of the Tony Hawk's Pro-Skater Games.
      There were absolutely loads of customization options back in the day in loads of great games, just there's more now thanks to the financial incentive to bleed people's wallets out over the internet.
      Also actually look at Mass Effect 1, There was a shit ton of different looking and different playing equipment in that game.

    Another thing that has to be keep in mind is that real life gambling give you the opportunity to win something of value, while lootboxes give you only digital items that most of the time can't be traded with other player or be sold in any manner.
    Also, those digital items does no belong to the player at all, but you get only the license to use them in the game, like you do not really hown gamse but just have the license to use them. So, basically a loot box is a gambling that cost real life money and don't reward you with anithing of some sort of value!

      Trouble with that thinking is you end up with games like Starwars Battlefront 2 where they are forcing lootboxes down your throat, yes you don't need to buy them but good fucking luck leveling up or being on par with someone who wants to buy stuff in that game.
      End of the day someone needs to step in and do something at this point, end of story.

      +steve bussemi Hmm. I see where you're coming from; if someone does something that only harms themselves, it's not necessarily a problem (legally). The issue is that companies specifically target 'whales' (impulsive sorts; typically children or those with addictive personalities) and exploit them for all they're worth; thus, it's a company harming people, hence the cry for regulation. It's a little more complicated as a whole, but that's the gist of it.
      Personally, I doubt this will go anywhere legally, but the publisization of the issue will at least make more people aware of what's happening, allowing more people to pressure self-regulatory bodies, which I reckon is great.

    Just as a government body should not have the right to decide what is suitable for different ages to view/play, i don't care for them expanding the definition of gambling.
    Especially not for moralistic reasons like "think of the children". Please stop treating children like retards and they probably will learn some valuable lessons that will make them _Informed consumers_ .

      No i would make games with gambling elements for Adults only (18+). That would hurt their financial interest so much that they most likely think twice about it.
      Think about Forza for example. That game has no age restriction because its a racing game. With an AO rating they would loose a lot of potential customers. I'd rather pay 70$ for a good game when that means i don't have to deal with this random number generator bullshit.

      There is a difference between gambling for free (inside a game) and gambling with real money. Only the latter releases high amounts of Dopamine which makes the whole thing addictive. There is no reason to forbid gambling if there is no risk to loose something real. It doesn't have the same effect on the human psyche.

      There will always be a market for micro-transactions, and a market for games with no micro-transactions. Fears that microtransactions will infect every game, like a pandemic, are overblown and unfounded.
      There are hundreds of games with microtransactions that failed completely and utterly. Devs and producers see that already.

    If they label lootboxes as gambling, wouldn't that actually require them to mark the game as AO if it involved real money? You can't legally gamble (AFAIK at least) until you're 18 in the US.

    ""can be traded or exchange outside the game platform" - so only CS, DotA (maybe, unless Valve presents Steam as part of the platform, since it's required to run the game proper) and a few other titles are affected. Aside from that, as long as the items stay in game [Overwatch, Destiny, Forza], they will not act.

    Loot boxes, when you think about it, can be extremely fun in games. If acquired through gameplay only and with enough variety in prizes it can drastically change how everyone plays from each other.
    The way they’re implemented nowadays, though, is extremely disgusting.
