The lawyer in the studio is a disgrace. There’s no where the constitution said that it’s the court that will declare the seat of a legislator who decamped vacant. It’s because of the sit tight nature of politicians and abuse of law by the politicians that makes every matter in Nigeria now is being determined by the courts. Of course, the judiciary loves it, the lawyers collect legal fees and the judges take bribes. That’s why you see unnecessary court case fillings by lawyers and contradictory court orders by judges, even when they don’t have or lack jurisdictions.
It is quite shocking to listen to the argument of Rufus, sounding more of a politician in my view.
Unfortunately, rivers political crises has exposed how our learned friends (LAWYERS)are realy unlearned .

I'm really disappointed in R.N. Godwins, a cerebral lawyer I've always respected for years. That lawyer stated the true position of the law, that all cases of the State Assembly mustn't be before the Federal High Court.

There was never a confusion in Rivers State with regards to the House of Assembly. 24 plus the Speaker making it 25 Members defected and automatically lost their seats Therefore, the remaining suspended Members must rise to the occasion to save their State. The Speaker who should have communicated with the appropriate authority was amazing the defectors so don't blame the remaining suspended members for their actions. Nigerians must resist godfaherism

The court said that Martin Amaewhule is the speaker of England Rivers State Assembly upon which party? Martin Amaewhule and his gangs moved to APC and swear an affidavit that they have moved, so what are they saying to the court now? Martin Amaewhule and his team should go home and rest. They should come back and join the APC or PDP next time. 2027 is just by the corner, they should respect the court order.

The federal judgement by omotosho in favour 27 members .
The appeal court judgement in their favour too
We have a very bad media practitioner who deliberately evade asking compelling questions. If they defect, have they not lost their legitimacy of the platform on which they contested their election. Where do one defect from a political party and still want to continue with the mandate he got from that party without going back to his constituency to test his or her p popularity or justification of his action

By now, for heavens' sake, why can't the federal high court that has the substantive case in deciding once and for all if their sits are vacant or not, despatch this case quickly for the sake of peace in Rivers. If decided for, then let Inec quickly conduct an election to complete the house representation or otherwise the house subsist. The problem is actually with the judiciary lagging the issue, for reasons beyond my knowledge.
This is true, the federal high court should have made their own judgement on this matter quickly, if they truly serve justice in Nigeria. What is the delay for?

If NASS had wanted the FHC to have exclusive jurisdiction, it would have included section 272(3) under section 251 where over 15 matters are stated over which the FHC has exclusive jurisdiction. Where the suit does not include the Federal government or its agencies, State High Courts have coordinate jurisdiction. It's left for SC to say this. The CA has no power to curtail the powers of the State High Courts .Only NASS can do that as it's done under s. 251 of the constitution. Section 272(3) confers coordinate jurisdiction in matters pertaining to tenure, etc, of govs or State assemblies. The State High Courts have jurisdiction where the Federal government or its agencies are not made parties as in the Rivers matter.

The law is very clear and we can’t keep acting blindly and misleading the public just because we want it to favor us. The lawyer in the studio was very explicit and comprehensive in his analysis of the current situation but on the other hand , the lawyer in port harcourt was putting so much emphasis on sentiments and emotions which is absolutely ridiculous and misleading.

If the state high court has no jurisdiction to entertain state matter why is there state high court and what is their value to the state? If mr omotosho rules that the state high court lack the jurisdiction to entertain such matter then the matter should be forwarded to the federal high Court for proper filling.

Martins Amaewhule is the current speaker of the Rivers State House of Assembly as it stands, because of a judgment of the Abuja Federal High Court (FHC/ABJ/CS/1613/2023) headed by the honorable Justice Omotosho. The judgment recognizes Amaewhule as the speaker, and it has not been set aside by a higher court. The Judge directed the Governor to represent the state budget to the Amaewhule led house of Assembly. This is the status quo until a higher court set aside this ruling.
