The Facts: My client had one shot at a bar where she works. She looked fantastic on camera and the cop testified that she blew a whopping ".165" on the Preliminary Breath Test (PBT). There was no proof (in fact, on video, they said it was ".156, 157... something like that..?" Making their determination suspect since they never preserved the number on their badge cams NOR ever photographed the number on the PBT (takes 2 seconds).
At one point, the officer slips up and mentions the inadmissible PBT, on accident. So, naturally, I jump on it IMMEDIATELY. I try to convince the judge we can talk about it but the number can't get in, WHICH IS THE LAW. She declines. Says "all or nothing;" so I go for broke. It pays.
Jury doesn't believe the cop. Acquits my clients who looks and talks SOBER on camera.
They even acquit her of the reckless driving charge because as one juror later told me "all 6 of us had gotten lost by GPS and taken down the wrong way on these streets before, so we know...."

I just did the test in my home; paused this video to do it....and I FAILED THE TEST. And I have not had an alcoholic drink in years! What sort of test is this that a sober person cannot pass? No one walks with their hands to their sides with their feet planted in front of them toe to heel. the normal way to walk is by moving the arms to keep balance. This "sobriety test" makes as much sense as most court procedures and sentence guidelines do; none at all.
and i can pass it with flying colors while drunk. it's clear the test is completely unfair and cannot be applied universally to all people.
It's not a sobriety test....it's called "foreplay" as cops get their jollys from making adults jump through hoops & do stupid stuff before they cuff & arresting you!!
I think only Americans still use this outdated method. In Australia cops require absolute proof by way of breath then blood testing.
The sobriety tests are possible to do and have a certain meaning to them, anyone who says other wise is denying a simple truth, now, you can say that cops make it harder than what they are spouse to be, and that is a reality, unless you have fisical or health disabilities, or if you are not a athletic person witch is also a very good reason since the tests are much based on body balance and control (depending on the person keeping one leg up while keeping perfect balance without using your arms for balance can be very difficult).
I do not agree with this tests, the only one i might agree with is the eye test and even that one is flawed for if the person has eye problems he/she will still go under arrest until proven otherwise. Now a days technology is evolved enough for other types of real tests to be placed on the line of duty. Not everyone is the same, i can do this tests, i have done it before, more than once, and so can a very large amount of people do it as well. But they are flawed and are giving a bad name to police for a long time now.
@@zhou_sei That is also true, ive seen drunk ass people pass that...
If a cop ever says, on the stand, under oath, “I do not remember.”, the case needs to be thrown out.
Most definitely absolutely Yes!!!!

Messing with a body cam should be the equivalence of tampering with evidence.
Absolutely!
It is, it's just legal tampering.
Heck yea !!!

@@mikejohnson5491 You misspelled "prosecuted".
It's so disgusting and heart-wrenching to hear the cop say, "She was resisting and belligerent. We had to force her into the vehicle." during direct exam. Then you actually find out he denied telling her what the device said her blood alcohol level is and doesn't do anything she asked after doing everything he asked. Obviously, most people would be upset by not only getting arrested, but their phone and keys left behind in their vehicle on the side of the road.
Cops= arrest=promotions = pay increase. That’s all they care about.
How can they lie on the stand when they swore an oath disgusting human beings
There's a term for it: testilying
Same way they lie to themselves violating ppls rights daily though they swear an oath to uphold & protect the Constitutional rights of the ppl
The oath that they take when they become a law enforcer means the same to them as swearing to tell the truth…….nothing. Cops only follow their training, not necessarily the law. Most cops don’t keep up on laws, very little training after the academy.
It’s living I guess. Cops are educated not educated in the law, rather they are trained in law enforcement techniques. This is why they make so many mistakes. These mistakes result in problems for the subject being examined by the officer.
A paramedic as an example, has far more knowledge in medicine than a cop has in policing and the bar to be a cop is low indeed.
When your pulling night shift patrols after 19 years... You know you’re a terrible police officer..

It's down to officer discretion to decide if you pass/fail and if a cop asks you to do the test they already think you're drunk so you've failed before you even do it.

I have come to the conclusion that our society cannot afford to hire high school graduates who were jocks, or inattentive. Society needs more education police with an associates or bachelors degree to cut down on the knuckleheads.
@@jduncan48 Some of the dumbest people I have met have masters degrees, so I don't think this will help. Our colleges basically give degrees for dollars, so this just ensures the wealthier "jocks" would get the jobs.
@@jduncan48 No, we need people who have proper social skills. That means people who DON'T have degrees. Such people tend to be more nerds and that is not something required when handling the public. About 17 years ago I was pulled over by a city cop leaving a bar. I was leaving early bc I missed my puppy (no lie). I did drink, but I was far from impaired. I pulled over and he told me I was swerving (I wasn't). He saw me walking to my car and followed me. I could tell bc he stopped me a block from the parking lot. He had me get out of my car and then it got bad. He never had me do any sobriety tests. Instead, he told me he could ruin my life if he wanted. He said he was going to let me call someone and that I should be grateful and give him a hug. I'm petite and top heavy. While we waited, he again reminded me he could ruin my life. He then told me that I could smoke while I waited so I did. Then he asked if I was planning on offering him a cigarette, bc he couldn't _ask_ for one. I offered him one and he took it. All of a sudden another cruiser pulled up. No one got out. I couldn't see who was in it or how many people were in it. The cop who stopped me had me get up and do spins in front of the cruiser. The cruiser left after a few minutes. The cop then proceeded to ask me if I had ever had plastic surgery (motioning at my chest). I felt like nothing. I just said no...feeling so humiliated. The next day I called to make a complaint. His lieutenant met me at a fast food restaurant and heard me out. He told me that if I made an official complaint chances were high that I would be harassed by city cops. I didn't make the complaint and left the meeting crying. I never thought of taking it any further. I was married at the time, but my then husband was overseas. I've never liked cops, but ever since, I plain hate them.
dude I'm really sympathetic that happened to you. Maybe if you feel brave enough to tackle it, with the support of your hubby and others you could request the FOI if it exists regarding the stop. If not I'm hoping you all the peace in future to put it out of your mind. I hope LEOs renew your trust in them one day.
Sooo…based off the specific, minor, and otherwise ‘non-issue’ details of your comment, I find it interesting that this interaction seems to just literally end after he asked about any “plastic surgery”…which you simply just say “no”..as if there was not a single other word said..and you both turn around without a single word said and leave. Until you called to complain the next day..but then you MEET UP with this lieutenant at a restaurant, with you both knowing it’s about a complaint at this point, and actually thought this was a good idea..?? Did you not realize that he could’ve potentially followed you home without your knowledge? Had someone else follow you? Things just aren’t adding up, and honestly don’t make any sense at all..If this was truly your encounter, than I’m sorry it occurred, but the way you structured this narrative and the level of detail that was included, AND excluded, makes it hard to not sound deceitful. But like I said, I’m sorry if this really happened, this was just my initial thought process on reading it..
No, you are right. That story is total and complete BS.
A cop would assume he was drunk the way he fumbled on his words. Weird, being nervous makes you mess up!?
For a guy so obsessed with the fact that this lady wasn't able to follow instructions, he sure has a hell of a time comprehending and answering some very basic questions.
😂😂😂😂😂
I mean we pay thousands of dollars for those cameras that are supposed to hold them accountable yet they get to turn them off and mute them at will. Why?
While asking about the statement “you could be charged with resisting arrest”, I wish the defense attorney reminded the officer he could be charged with perjury.
How did that nice lady get to be a judge? She's actually a human being!
Reminder that if the judge makes a joke, you're pretty much obligated to laugh
Thats Judge Karen Thomas, she teaches trial advocacy at Chase School of Law in Northern Kentucky. She is a fantastic judge and a fantastic human being.
She’s a sweetheart.
Loved her making the mood of the court comfortable.
Lizard people
See how humble they seem in the courtroom but in the street it's a different story.
Dude was full of shit, like every power tripper.
If a body cam is muted or shut off intentionally, the case should be automatically thrown out. If you're doing nothing wrong as an LEO, you have nothing to hide
Isn't lying under oath, PERJURY???
Not for cops. If they're a mason their back is covered.
But they aren't lying they are just mistaken.
Only citizens are convicted for perjury.
Exactly,it don't matter if a cop lies under oath, they just kinda brush it off. But not if a citizen dose it oh my look out because your screwed. It's completely discussting how an what cops can get away with, with no repercussions at all. No wonder why everyday more people can't stand the worthless tyrant cowards that they are!
@J P Did you smell alcohol on their breath??? Most will answer "YES", then on the report there is listed (I'm not sure exactly) breathalyzer test: .01 and you still get arrested...That means if someone blows a .08 or higher when given a breathalyzer test, they're considered too drunk to drive. But that number's a bit abstract if you don't know what it's measuring. The number on the breathalyzer refers to your blood alcohol concentration (sometimes referred to as blood alcohol content or BAC).
Acetone in the breath is one cause of false blood alcohol concentration (BAC) results from breathalyzers. ... Hypoglycemia is a significant cause of acetone in the breath. And diabetics can have levels of acetone in the breath high enough to get false readings of.
Acetone does not smell anything like any alcohol you will consume...
So and an officer who pulls you over asks you... "Did you have anything to drink"??? You say no (which is the TRUTH) but when asked (in court, under OATH) SAYS..."YES, I smell alcohol"... Isn't that an intentional lie???
Not to mention: Not having any reasonable suspicion, to conduct a field sobriety test...The whole system is corrupt!
I came stumbling out of a bar once. Didn't notice the police car across the road waiting for drunk drivers. I stumbled to my car , dropped my keys before eventually getting in the car . After following me for a while they pulled me over. The smug looking police officer approached my car With a big smile on his face, asked have you had a few drinks tonight. I said no!. I'm the decoy tonight. The decoy can't drink or they get arrested 🤣🤣
It sets people up for failure. It's sad
People have to pay the other lawyer fees in all kinds of situations when they are wrong, the city should have to do the same.
Actually that scenario is extremely rare and a common public misconception
@🐞Somar Chimon🐞 I imagine they mean that it's not that common to get your lawyer fees covered by the opposing side. They have to be more than just wrong. They usually need to be malicious or frivolous lawsuits.
Amen! Most people get outta lawsuits because a ' commoner" cant afford to go against them, i think if you win, they pay ALL, not limited to and not excluding, even daycare...
Another example as to why we should all oppose allowing cops to have military hardware. Most behave like an egotistical child on a power trip. When you give a child a hammer, everything becomes a nail.
They can have military hardware when American citizens get a 50 to 70% off all military hardware because of the constitutional right to own said military-grade Hardware.
@@MinisterRoy205 like I said a year ago, “when you give a child a hammer, everything becomes a nail”. I have absolutely no objections to the citizens having military hardware but for police I do. Police are NOT the citizenry, they are agents of the state, a corrupted, deeply flawed and biased state at that! And being agents of the state, they will look for any excuse they can find to use military hardware. And I’m speaking specifically of the 10-99 program in particular. Why do police NEED stingrays? Why do they NEED MRAP’s? When was the last time police encountered IED’s??

I have watched a lot of his videos he always ask them a question and the says let me back up a little bit. I love his mind games lol
This officer's slow and painful demise is one of the most beautiful things I've seen...🥲....a tear just came to my eye. In the world of verbal judo the DUI guy is like the most savage ninja out here on these streets....finish him.....fatality...lol
The only thing 80 hours of training makes you an expert in is being a "know-it-all".
And no refresher courses in his whole working life as a cop. He is definitely someone who think he knows it all and most likely doesn't.
Training is for animals, not human. Training never replaces education.
@@NeverTalkToCops1 Very well said.
There just might be a reason that other countries take 18 months to two years to train and vet their cops.
@@ohauss Exactly. A higher standard of service requires a higher standard of education and training, law enforcement in the USA hires by way of quantity, not quality.
Im new to Ohio … moved here from Oregon TG lol. As an older lady (73 ..don’t mind say’n) I have been watching many of ur videos as it is helping me learn how people think ..thx for ur contributions
DAMNNN 😮 I don’t like to be in court BUT I would have loved to had been in that court room and watch him go down
He humiliated HIMSELF with his own behavior that got him onto the stand.
Doesn't really matter; It cost that poor girl $5000.00, to beat a $12000.00 false charge against her. Guess who was the only "loser", in this scenario? Lawyer: $2500.00 Courts: God knows how much they are grifting the tax payers for? Jury? $100 a day Cop: Yep, still getting payed, and making false charges, to this day! The poor girl who has to pay for it all? The DEFINITION of both treason, and tyranny! Notice how the Judge had a slight pause at the "not smelling alcohol", question? Because, it's SUPPOSED to cancel out the traffic stop!

This is why you need to know the law. Know your rights or you have no rights. They do this shit because they get away with it!
@@raccoonchronicles5134 💯💯 Rights are like muscles - you have to use/flex them or you lose them!
@@burtburt2263 damn, KY pays jurors way better than PA. Its like $9 a day here.
Every arrest that officer made while on patrol should be investigated after this.
I love to watch you work, YOU'RE THE BESTEST! I couldn't pass these tests so I'd get jailed. Scary! Those camera angles really suck. It gave me a headache. I know it's not your fault. Bless you!
The cop came down from level 11 to level 2 real fast.
The cop is heartless tyrant
Yeah, he's a real power hungry control freak. He even thought that he was in control of the attorney. (For a very brief moment) 😎
@Nakia Irvin
Really?
The only win for her is, the policeman kept turning off his body cam. That should not be an option.
When cops act like this lunatic, and does highly suspicious stuff against the rules, then maybe he needs a sobriety test. If she has to test, because of, highly suspicious behavior, then so should he for his ridiculous lies.
And why did he not document the reading on the camera.
He should have told her exactly how much was it there and then.
Dirty Coppa
That, surely, defeats the whole purpose of it?
You think that's the only win? You are either sadly mistaken or you watched a different video then I did...
This officer sure seems hostile. It’s like he’s hiding something.
So nowadays anyone throwing up in public can be charged with a DUI?
Anyone throwing up should be asked to do a breath analysis test for alcohol.
It keeps innocent road uses safe.
Peaches Page you dumb ass do you know how many chronic illnesses make you vomit on an hourly basis? Why burden someone with possible undeserved jail time like this videos shows that is battling just to feel ok on a daily basis?

This Attorney is the best I’ve ever seen on the job. We need you in Faulkner County Arkansas.
And Johnson co Arkansas!!
And St Francis County Arkansas 😳😳😳😳😳
Who "isn't paying attention" when being questioned by the POLICE!?!?
I love how the two women in the front are chatting among themselves during most of this, and not paying attention to the proceeding!
The most important thing here is that the morally corrupt liar cop will be unaffected by his actions and lies in any way what ever. Also on a side note I was unaware that there was a time limit on how quickly you need to provide your drivers license an insurance...
I have a wallet and two other little purses things to put cards in. On top of that my purse is a mess and that is an understatement. It is bad. They said I fumbled getting mine out one time, when I didn't even fumble, I just said that it might take me a minute because I wasn't sure where it was. It was in the wallet and it was the first thing I grabbed out, it just took me a second to go through the various cards I had...store coupon cards, debit cards, etc. It still only took me a second to find it. They are lying assholes and that is all they will ever be, until these courts start to hold them accountable. It will probably never happen.
@@MissMolly3377 only the courts are probably worse..... More money, more flesh on the line, lol. Like piranhas.
You don’t think it’s more important that people don’t drunk drive and crash into other people ending their lives?
You have got that right jack. Watching this clown makes me wanna blow my breakfast. Nauseating

Why can’t judges be like this woman btw?
I have just discovered you page and I loved it. I had to subscribe straight away. Thanks you. Best wishes from London.🏴
The only reason a cop has to turn off his bodycam is to try to hide evidence.
By all their own logic, that cop was drunk in court, even in the direct examination, he stumbled, had slurred speech, even did some words wrong while trying to explain how he does his usual tests on people...
if she was so drunk, where is the patrol car’s video showing her driving erratically?
Editing, and anything visually- can be visually be omitted.
It now costs 20 thousand dollars for a lawyer to represent you in Canada to fight a DUI. Many dui charges are bogus. And people lose their jobs as a result.
Close to the same in the USSA. However, it's a couple thousand less than the conviction: The state? Gets paid either way.
If they that. Nobody would ever get charged.
I had gotten a dui 2 1/2 yrs ago it took the state wa. Over a yr to charge me I was on private property, the cop showed up cause the medics couldnt find the property and the cop was pissed at me!i was given 3 attorneys and 2 yrs later i had to jump thru hoops everything,a blow n go,home detention, assessments (3) because the courts were taking too long!! The last assessment the counselor said no treatment shes been sober 2 yrs ha!!I'm just waiting for the court to drag me back in there...Ps..while waiting to speak to my lawyer,I walked back in the court room to see the judge, and both attorney's throwing her gown laughing not acknowledging my presence no return phone calls, from 3rd attorney I called her boss to rattle her cage I'm not a # I'm a good woman and..said attorney lied in court wtf?I called her on it,she still lied I'm almost free but..I haven't dealt w our D.O.L. which is thier own mafia $$$I hope they have their shit together?theres way more to this story and NO! I dont need to lie or hide anything smh...its just a shit show. I sat thru so many days in court I know the shit show!!lmfao you cant trust a public defender,as they move up to being a judge even after serving as a public attorney,? Conflict of interest?YA THINK!!
Goddam that's outrageous
B.S. , DWIs are way down from even 20 yes.ago ,drunks are drunks ,they still drink and drive ,with the video today in Ontario and the machines ,cops aren't ,your such an obviously convicted drinker and driver that won't ever accept personal responibility ,it's a societal decay of values.
You mean to tell me all these counties make money and still can't get 4k cameras
@Johnny Guillotine The fuel cost alone for a 7,000 lb Hummer should not be taxpayer funded. If the chief wants to fill that sumbitch up he can pay for it
WOW HUH!!!!!
They have to "seize"( steal), some first...
Defund the police.
I want police to have mandatory body cams.
Defund the police.
I want police to have more training.
Defund the police.
Police shouldn’t have military equipment.
(They don’t AR-15s and shotguns are civilian weapons, and any civilian can purchase body armor)
Police shouldn’t have big scary vehicles.
(Most districts don’t. Primarily in large cities like NYC, ATL, LA etc. which see larger more dangerous threats.)
You can’t have your cake, and eat it too people. Training, body cams, and equipment cost money. You either want to get rid of the police, or you want to give them more money. Make your minds up.
The money they get goes into salary not equipment.....
How do these cops not come to court prepared
If this cop is smart, he will learn to have answers to all your questions. He will probably do a better job on his future DUI cases but I have the feeling that he is lazy. Thank you for doing what you do. Blue Sky's.
This Lawyer is slick. Every time he elaborates on how well she kept her balance or didn’t miss a number he pauses long enough for the jury to really soak it in.
