    The Facts: My client had one shot at a bar where she works. She looked fantastic on camera and the cop testified that she blew a whopping ".165" on the Preliminary Breath Test (PBT). There was no proof (in fact, on video, they said it was ".156, 157... something like that..?" Making their determination suspect since they never preserved the number on their badge cams NOR ever photographed the number on the PBT (takes 2 seconds).
    At one point, the officer slips up and mentions the inadmissible PBT, on accident. So, naturally, I jump on it IMMEDIATELY. I try to convince the judge we can talk about it but the number can't get in, WHICH IS THE LAW. She declines. Says "all or nothing;" so I go for broke. It pays.
    Jury doesn't believe the cop. Acquits my clients who looks and talks SOBER on camera.
    They even acquit her of the reckless driving charge because as one juror later told me "all 6 of us had gotten lost by GPS and taken down the wrong way on these streets before, so we know...."

    I just did the test in my home; paused this video to do it....and I FAILED THE TEST. And I have not had an alcoholic drink in years! What sort of test is this that a sober person cannot pass? No one walks with their hands to their sides with their feet planted in front of them toe to heel. the normal way to walk is by moving the arms to keep balance. This "sobriety test" makes as much sense as most court procedures and sentence guidelines do; none at all.

      It's not a sobriety test....it's called "foreplay" as cops get their jollys from making adults jump through hoops & do stupid stuff before they cuff & arresting you!!

      I think only Americans still use this outdated method. In Australia cops require absolute proof by way of breath then blood testing.

      The sobriety tests are possible to do and have a certain meaning to them, anyone who says other wise is denying a simple truth, now, you can say that cops make it harder than what they are spouse to be, and that is a reality, unless you have fisical or health disabilities, or if you are not a athletic person witch is also a very good reason since the tests are much based on body balance and control (depending on the person keeping one leg up while keeping perfect balance without using your arms for balance can be very difficult).
      I do not agree with this tests, the only one i might agree with is the eye test and even that one is flawed for if the person has eye problems he/she will still go under arrest until proven otherwise. Now a days technology is evolved enough for other types of real tests to be placed on the line of duty. Not everyone is the same, i can do this tests, i have done it before, more than once, and so can a very large amount of people do it as well. But they are flawed and are giving a bad name to police for a long time now.

    It's so disgusting and heart-wrenching to hear the cop say, "She was resisting and belligerent. We had to force her into the vehicle." during direct exam. Then you actually find out he denied telling her what the device said her blood alcohol level is and doesn't do anything she asked after doing everything he asked. Obviously, most people would be upset by not only getting arrested, but their phone and keys left behind in their vehicle on the side of the road.

      The oath that they take when they become a law enforcer means the same to them as swearing to tell the truth…….nothing. Cops only follow their training, not necessarily the law. Most cops don’t keep up on laws, very little training after the academy.

      It’s living I guess. Cops are educated not educated in the law, rather they are trained in law enforcement techniques. This is why they make so many mistakes. These mistakes result in problems for the subject being examined by the officer.

      It's down to officer discretion to decide if you pass/fail and if a cop asks you to do the test they already think you're drunk so you've failed before you even do it.

Such people tend to be more nerds and that is not something required when handling the public. You need people who can read body language, understand human behaviour and can interact with people calmly no matter what. That requires street education, not university education.

      Except for that part where she gets unnecessarily nasty with and chastised the Defense attorney for not knowing the eye test wasn't admissible in that court. She later accepts that as her own fault, but when she assumed nobody could hear her, she was particularly rude and condescending.

      Some are suffice just doing the minimum or not smart enough to learn knowledge to become hire rank. He may have a high school diploma and is happy having a job and a paycheck. Remember it doesn’t take a degree of higher learning to be a cop. They don’t even do update training concerning case law that changes the laws they enforce.     About 17 years ago I was pulled over by a city cop leaving a bar. I was leaving early bc I missed my puppy (no lie). I did drink, but I was far from impaired. I pulled over and he told me I was swerving (I wasn't). He saw me walking to my car and followed me. I could tell bc he stopped me a block from the parking lot. He had me get out of my car and then it got bad. He never had me do any sobriety tests. Instead, he told me he could ruin my life if he wanted. He said he was going to let me call someone and that I should be grateful and give him a hug. I'm petite and top heavy. While we waited, he again reminded me he could ruin my life. He then told me that I could smoke while I waited so I did. Then he asked if I was planning on offering him a cigarette, bc he couldn't _ask_ for one. I offered him one and he took it. All of a sudden another cruiser pulled up. No one got out. I couldn't see who was in it or how many people were in it. The cop who stopped me had me get up and do spins in front of the cruiser. The cruiser left after a few minutes. The cop then proceeded to ask me if I had ever had plastic surgery (motioning at my chest). I felt like nothing. I just said no...feeling so humiliated. The next day I called to make a complaint. His lieutenant met me at a fast food restaurant and heard me out. He told me that if I made an official complaint chances were high that I would be harassed by city cops. I didn't make the complaint and left the meeting crying. I never thought of taking it any further. I was married at the time, but my then husband was overseas. I've never liked cops, but ever since, I plain hate them.

      Sooo…based off the specific, minor, and otherwise ‘non-issue’ details of your comment, I find it interesting that this interaction seems to just literally end after he asked about any “plastic surgery”…which you simply just say “no”..as if there was not a single other word said..and you both turn around without a single word said and leave. Until you called to complain the next day..but then you MEET UP with this lieutenant at a restaurant, with you both knowing it’s about a complaint at this point, and actually thought this was a good idea..?? Did you not realize that he could’ve potentially followed you home without your knowledge? Had someone else follow you? Things just aren’t adding up, and honestly don’t make any sense at all..If this was truly your encounter, than I’m sorry it occurred, but the way you structured this narrative and the level of detail that was included, AND excluded, makes it hard to not sound deceitful. But like I said, I’m sorry if this really happened, this was just my initial thought process on reading it..

      @J P Did you smell alcohol on their breath??? Most will answer "YES", then on the report there is listed (I'm not sure exactly) breathalyzer test: .01 and you still get arrested...That means if someone blows a .08 or higher when given a breathalyzer test, they're considered too drunk to drive. But that number's a bit abstract if you don't know what it's measuring. The number on the breathalyzer refers to your blood alcohol concentration (sometimes referred to as blood alcohol content or BAC).
      Acetone in the breath is one cause of false blood alcohol concentration (BAC) results from breathalyzers. ... Hypoglycemia is a significant cause of acetone in the breath. And diabetics can have levels of acetone in the breath high enough to get false readings of.
      Acetone does not smell anything like any alcohol you will consume...
      So and an officer who pulls you over asks you... "Did you have anything to drink"??? You say no (which is the TRUTH) but when asked (in court, under OATH) SAYS..."YES, I smell alcohol"... Isn't that an intentional lie???

    I came stumbling out of a bar once. Didn't notice the police car across the road waiting for drunk drivers. I stumbled to my car , dropped my keys before eventually getting in the car . After following me for a while they pulled me over. The smug looking police officer approached my car With a big smile on his face, asked have you had a few drinks tonight. I said no!. I'm the decoy tonight. The decoy can't drink or they get arrested 🤣🤣

I have absolutely no objections to the citizens having military hardware but for police I do. Police are NOT the citizenry, they are agents of the state, a corrupted, deeply flawed and biased state at that! And being agents of the state, they will look for any excuse they can find to use military hardware. And I’m speaking specifically of the 10-99 program in particular. Why do police NEED stingrays?       Same I broke back, neck, and have hip problems. I wouldn't pass the counting and alpha because im dislexic. Does having medical problems affect these test?. We don't do them here in Australia for the reason being they're not really a good way to diagnose a situation. Also cops are not doctors so they're not able to judge like this so here they just make you do a breath test, if refuse you immediately loose license min 12 months max 24 months. Our limit is .05 it used to be .08 late 80's when they started using these devices, they lowered it due to the high amounts of accidents and drivers doing wrong. They can arrest people, take them to hospital and get blood if situation needs. I also noticed all dui videos of cops being busted the first thing they say is I'm not doing the field sobriety test. They know if you lean you can go to jail, it's not a truly fair, impartial judgement manner.

Lawyer: $2500.00 Courts: God knows how much they are grifting the tax payers for? Jury? $100 a day Cop: Yep, still getting payed, and making false charges, to this day! The poor girl who has to pay for it all? The DEFINITION of both treason, and tyranny! Notice how the Judge had a slight pause at the "not smelling alcohol", question?     The most important thing here is that the morally corrupt liar cop will be unaffected by his actions and lies in any way what ever. Also on a side note I was unaware that there was a time limit on how quickly you need to provide your drivers license an insurance...

      I have a wallet and two other little purses things to put cards in. On top of that my purse is a mess and that is an understatement. It is bad. They said I fumbled getting mine out one time, when I didn't even fumble, I just said that it might take me a minute because I wasn't sure where it was. It was in the wallet and it was the first thing I grabbed out, it just took me a second to go through the various cards I had...store coupon cards, debit cards, etc. It still only took me a second to find it. They are lying assholes and that is all they will ever be, until these courts start to hold them accountable. It will probably never happen.

    It now costs 20 thousand dollars for a lawyer to represent you in Canada to fight a DUI. Many dui charges are bogus. And people lose their jobs as a result.

      I had gotten a dui 2 1/2 yrs ago it took the state wa. Over a yr to charge me I was on private property,the cop showed up cause the medics couldnt find the property and the cop was pissed at me!i was given 3 attorneys and 2 yrs later i had to jump thru hoops everything,a blow n go,home detention,assessments (3) because the courts were taking too long!! The last assessment the counselor said no treatment shes been sober 2 yrs ha!!I'm just waiting for the court to drag me back in there...Ps..while waiting to speak to my lawyer,I walked back in the court room to see the judge,and both attorney's throwing her gown laughing not acknowledging my presence no return phone calls,from 3rd attorney I called her boss to rattle her cage I'm not a # I'm a good woman and..said attorney lied in court wtf?I called her on it,she still lied I'm almost free but..I haven't dealt w our D.O.L. which is thier own mafia $$$I hope they have their shit together?theres way more to this story and NO! I dont need to lie or hide anything smh...its just a shit show. I sat thru so many days in court I know the shit show!!lmfao you cant trust a public defender,as they move up to being a judge even after serving as a public attorney,? Conflict of interest?YA THINK!!

      B.S. , DWIs are way down from even 20 yes.ago ,drunks are drunks ,they still drink and drive ,with the video today in Ontario and the machines ,cops aren't ,your such an obviously convicted drinker and driver that won't ever accept personal responibility ,it's a societal decay of values.

      Defund the police.
      I want police to have mandatory body cams.
      Defund the police.
      I want police to have more training.
      Defund the police.
      Police shouldn’t have military equipment.
      (They don’t AR-15s and shotguns are civilian weapons, and any civilian can purchase body armor)
      Police shouldn’t have big scary vehicles.
      (Most districts don’t. Primarily in large cities like NYC, ATL, LA etc. which see larger more dangerous threats.)
      You can’t have your cake, and eat it too people. Training, body cams, and equipment cost money. You either want to get rid of the police, or you want to give them more money. Make your minds up.

    This Lawyer is slick. Every time he elaborates on how well she kept her balance or didn’t miss a number he pauses long enough for the jury to really soak it in.
