    Fair use. You should consult a lawyer because a DMCA Takedown is actually a legal action taken by the party issuing it under the penalty of perjury. Whoever did this likely just broke the law in order to prevent free speech. You should hold them accountable.

      Very true. They do not have a case at all. They have these videos on youtube, which people can view for free and you made a video about them which people can also see on youtube for free. They can therefore make no claim that you are unjustly monetising their video or causing them to lose money by letting people see their content for free. Your video is a critique of their material, which is completely normal and falls under fair use.

      Not applicable here, you have to play by the rules of youtube/google. 1st amendment doesn't always apply on a commercial platform.

      @@jcarney1987 While the 1st Amendment does not apply on a private platform, copyright laws do.
      CZcams may take down a video on its own, but it does not randomly issue copyright strikes or accuse people of copyright infringement. They do it in response to a DMCA takedown notice so the law is completely applicable here.
      This is because in order to file such a notice, you have to file submit an affidavit under penalty of perjury that you are the owner of the copyrighted work and that your intellectual property is being infringed upon. As per the law, you are required to consider fair use prior to issuing a DMCA takedown notice. A lot of people are under the mistaken impression that because CZcams is a private company it's no big deal to have someone's video taken down with a false copyright claim, but CZcams's automated copyright system is actually in response to legal action that you are taking by reporting the infringement. Doing so under false pretenses is illegal.
      I suggest that you go through the copyright reporting system on CZcams and read the actual text involved in making a claim. You might be surprised.

    Getting your video taken down is such an aikido thing to do. They are becoming the flat earthers of the martial arts community, and just cannot handle anyone having a view that clashes with their own.

    Time to get on The Joe Rogan Experience. More people need to speak up on this issue who have been in both camps of martial arts training; both the fundamental and the idealistic. This is right in his wheelhouse, and he needs more people for his MMA talks. If you get some serious press (and have your own website to throw traffic at), you won't need CZcams anymore, as an aside. As you say we need "critical thinking" in aikido as well as in each ans every area of our lives. I am sorry for your channel, and I stay very close to you.

    I am an aikidoka, but I do agree that the art is far from practical usage. Aikido is a self-development method in a martial art packaging, I joined iaido for the same reason.
    Currently, I am mostly doing boxing/Muay Thai as part of my occupation, while I’m not training any athlete, I always try to get my approach as close as possible to boxing training.
    I detest aikidokas that overvalued the art, the art has been stagnant for a very long time, it has its place, it has its benefits, on a certain degree, it has certain practicality, but definitely far from what modern martial arts or other progressing arts out there has to offer.
    I do aikido, but that’s because I personally need it, not because I want to use it for fights.

      I watched a video of a guy who's primary martial art practice was aikido. And he made a video of himself sparring with an mma fighter for comparison. Honestly that video can really clear alot of the practicality part of aikido.

This strike is unfair and tries to prevent you from expressing your opinion on a subject. We are not in a dictatorship and for freedom of speech we should fight together.

    I think this is totally unfair. Regardless whether someone agrees with your comments or not, doing this just draws negative attention to themselves. As you said its not the way to go about things. I also find it quite ironic that given the "forgiving nature" that many Aikidoka talk about, this chosen solution is probably the most damaging for you...

    You look a lot different now, than when you were an aikiddo dude. Good on you bro. You are a lot more different than some of these traditional martial artists. You have something many of them don't have. They have built their whole life around something that has many aspects that don't work. How do you admit you're wrong in those spots? It's a tough thing to do. On top of that it's also humbling for anyone to go and try to fix what they are doing wrong. Many people can't do that. So you are pretty unique in the martial arts, but it's what a true martial artist does. You use what works, throw away the ego and try as much as you can.

      I don't know how many videos of his you've watched but he never used to spar. That was about 7 years ago. He just started sparring about 2 years ago.
      Why do you take things so backwards?? lol
      When you do BJJ your whole body changes and he got a lot bigger. You just become thicker and your core gets incredibly strong. It's the same with wrestling or any other functional martial art that uses real sparring. You can tell also by his confidence, how he holds himself and if you actually watched many of his older videos, you can see it in his older videos and sparring. Go watch his very first video 7 years ago, and then watch 2 years ago, where he steps in to the ring to test his art and then compare that to his sparring today.

    This is what I find so surprising about Aikido. For all their talks of inner peace, blending of the spirit, harmony, etc they get super salty as soon as a criticism rears up. Its almost as if training with aliveness does a far better job at training people to fight better and character building.
    EDIT: but at the same time I understand why there is such a reaction. Japanese culture is all about respecting the 和 or harmony of that group. Probably from the students and the teacher's point of view, the criticism disturbed the 和. Which is a big no no in Japanese culture. This is the reason why I ultimately stopped doing more traditional based Japanese Martial Arts and stuck with Judo, which has a strong element of aliveness as part of the training.

      @Dr Diablory I think I over simplified Japanese culture a bit. It's not that there is no criticism. But criticisms are done indirectly and never overtly. The person giving the criticism has to take care not to hurt the receiver of the criticism or make them "lose face". And at the same time it is the responsibility of the recipient of the criticism to pick up on the indirect criticism and change accordingly.
      I am not condoning it in any way. I think it's a really bad way of giving and receiving criticisms. But it helps to understand why the previous video might have been taken down if the person who made the request was Shirakawa.

      Having left a McDojo and joined a kick boxing gym I have to say that most times its because they feel threatened, that they will lose students thus money. Obviously in some cases they might REALLY believe that their system works, which is even worse.

    I am sorry this happened. I myself left aikido to train in traditional jujutsu and judo as one is great for self defense and the other live pressure testing. The politics in aikido are insane. When it was discovered I was cross training I was banned from testing. All the nonsense they fill their students heads with is just crazy. Unless they have cross trained in a striking system and a real grappling system like judo, BJJ or wrestling they are utterly worthless in a real fight. For an art that is supposed to be about peace I personally find it full of nothing but inflated egos and petty politics.

      In what coutry do you live? I never met such problem in Poland. More, in my dojo muay thai and mma are also trained and sensei is fine to anyone who wants to mix trainings.
      I do not think it is problem with aikido, but with some part of aikidokas. First sempais of Ueshiba were good in other martial arts, same as O'Sensei.

      United States under the USAF. Iowa more specifically. A friend of mine also had to change dojos after cross training in jujutsu and posting and article about his experience on an aikido site. He was 1st kyu and after the article was posted they refused to test him for 1st dan.
      The sad part, is as I’m sure you know the founder of Aikido promoted cross training. Himself, Kano and the founder of Shotokan would send students to each other to train.

In my Aikido Dojo in Queensland, Australia we train with all kinds of grabs, strikes and kicks - Kung Fu attacks, BJJ and Judo attacks, Boxing strikes, Karate and kickboxing kicks etc. This is real Aikido training. I actually think this guy has never trained in an Aikido dojo that does this and is misinformed as a result. We need to be less critical of particular arts per se, and more critical of individual dojos and teachers/sensei around the world. This is where the quality is really evaluated.

      Aikido Yoshinkan Sunshine Coast I had the same experience in my Aikido training here in the US. Rokas definitely practiced an extremely soft version of Aikido.

    Rokas, I admire your resolve to spread the truth. In my 45 plus years of training in traditional martial arts I have witnessed much of what you shared in this video. Censorship is not right. I applaud you for taking the time to produce this video. I believe you should pursue this further. I hope you will prevail.

    This happened to me once with one of my "MMA Fighters Try Women's Self-Defense" videos. The guy who made the original video actually sent me an email first and asked me kindly to take down the video because he felt it misrepresented him and made him look foolish. I agreed to take it down, because I'm a nice guy. I pulled the video myself, and I thought we were done. The next day, BAM! I got a strike on my account because he filed a complaint to youtube anyway.
    At least Master Wong had the decency to just shout angrily at his camera for 20 minutes straight as a response when I made a video about him.
    I watched your video before it was taken down. It was a good one. It was a positive message. It was a really interesting discussion about the merits of the non-combative but cool looking martial arts systems that exist today. How sad that Shirakawa Ryuji' missed the point completely.

    I would petition CZcams to actually establish a to process to where they would temporarily take down the video while the claims are reviewed and ask for response or justification from the CZcams channel instead of automatically removing the content and punishing the channel owner

    Go for it!!! I see this with music related contend all the time ... And most people either don't know better or are to afraid to dispute the takedowns. This kind of bullying has to stop! In this case the fact that they file false contact information should be enough to withdraw the strike and revert the takedown! But since CZcams is a company making up their rules as the go along, that might not be enough ... Anyway, if against all odds this ends up in courts, I'm sure your community will find a way to make it nothing more than an inconvenience for you ...

    That completely sucks. I enjoyed that video. Is it possible to reload the video without the example videos? I know it is more time and effort on you part and you may need to film a quick opening explaining the lack of video, but the commentary on that video was valuable and should be on your channel at least.

    Absolutely fair use, and not hard to prove. The good news is, a lawsuit is very expensive for them, and lawyers don't like taking cases they know they'll lose. Plus, they run the risk of penalty for a fraudulent claim. I say you fight it.
    Legal crap aside, how sad that they can't handle a little honest critique.

    Sorry dude, but you may be in the wrong here. The problem with Fair Use is that you monetized your video. If you had kept the video unmonetized you could fight the Fair Use clause, but by monetizing you were making money off the other guy's content. Once monetized, your video critique was not educational anymore, was for profit, that changes the whole game. Also, this is not unique to you; it happens all the time to movie reviewers for example. I know you may feel wronged here because you are on a hell-bent mission to defame Aikido and promote MMA, but that had nothing to do with CZcams Copyright laws.

I'd say though to be careful on how you interpret Fair Use and hope you have an attorney that can advise you before you fight this. I agree the video should've not been taken down. What they should've done is file a copyright claim, which would've demonetized your video (take your ability to profit for it) but still keep the video up. Ads would've still run on that video but you make no money of it.

    The tanto waza is flawed maybe it wasn't in the 15th century but it is now. And I agree be honest about what aikido and self-defense is + not the same thing Aikido should evoleve into Hatenkai now i guess ;)

    Sorry to hear about the strike, Rokas. The politics/cult like behavior of aikido, along with watching your videos has been a major influence on why I left aikido 2 years ago to start training MMA.

    I saw that video, I liked it and thought your idea was interesting. It was also my first exposure to the teacher in question, and he does some cool stuff. I would never have found him otherwise. As a result of the takedown, now I've forgotten him. Good luck with this.

    Agree with you about folks needing to be willing to discuss the art--including potential criticisms. Lack of communication helps nothing. Glad you got the "strike" resolved; sorry the situation came to what it did.

    So typical...
    This is exactly the kind of attitude I lived with all my Aikido life. They can't handle critiques! No questions! Masters can't be wrong! They are unable to perceive positive feedback... everything is cause of shame! Fuck that!
    How the fuck can you search and know yourself without putting yourself and your reality in check constantly? So much for AIKI philosophy...
    Which brings me to something you addressed sometime ago in the video "It's the martial artist's fault, not the martial art". It got me thinking... on the pratical/functional/reality side of things, the Martial Art should hold it self up. But in regards to the values that the Martial Arts in general uphold, then the responsibility is completly on the practioners shoulders, there's nothing to do with the Martial Art! And this is amazing!
    With that said, seems to me that there are "practioners" that are not willing to take that responsibility... they just want to look pretty...

    I'm sorry to hear this. I can't believe someone would be so petty. When you and the two BJJ instructors reviewed Tomiki tournament footage, I thought it was very insightful. It never crossed my mind that the Tomiki critique video should be taken down. Actually I was surprised that they were not condescending at all. You were not condescending in the Aikido video that was taken down either.

    I will just say that Japanese Fair use laws are diffrent and really strict (like you need permission to use other peoples work in any way) , so I don't know if this is just ignorance rather than malice.

      Except they had to go through CZcams to get it taken down, they never thought to read through what they were doing along the way before submitting the claim?
      More likely someone was super angry at having to face some criticism and this was the result.

    That aikido master knows that aikido’s perceived weakness compared to other grappling and striking martial arts has wreck havoc with aikido’s standing as a legit fighting Style. Your videos makes some aikido practitioners panic and salty.

    They should not have taken the video down, you had good intentions, trying to help with your ideas and opinions, you were not trying to hurt someone for revenge or cause of hate like they did just cause they don’t like what you do or say and can’t take criticism, you’re right, I’m on your side, I agree and support you

    It is a cowardly move for them to do this without first reaching out.
    I have viewed the video you were talking about regarding knife defenses and someone would definitely get hurt/killed if they attempted those in a real situation.
    One would think they would have the humility and integrity to take honest criticism and really look at what they are doing.
    Seems rank and titles go to the head though and they feel they are above most people.
    Absolutely shameful.

    Some people can’t take the real facts, you tested it in a real scenario, and noticed that it wasn’t effective against a trained fighter giving you resistance, and you had the balls to fight inside a cage. Good Job so far man, thank you for what you do, you’re a real martial artist.

    Sorry this has happened. And I would imagine that you are correct - whoever claimed a copyright infringement for you using the footage probably felt personally criticized, and is reacting by metaphorically lashing out (ironic, given the philosophy of Aikido).
    In terms of the future, another way of you going about these things would be to film a video showing the wrong/dangerous way of doing things, with just a general verbal reference ("I have heard that there are some people who advocate doing this this way..."). You could then follow up by showing (what is in your opinion) the correct, safe way to execute the technique.

    I was able to watch your video before is was taken down and I agree that CZcams wrongfully took your content down especially since what you were saying wasn’t bad just critical of the practical use of their Aikido. Unfortunately free speech is under attack and those who cry offense are getting their way more and more which leaves a dangerous ground for a lot but especially martial arts! You and Ramsey Dewy are the two who showed me that traditional martial arts and the way they are taught and talked about are not accurate and that the training they do doesn’t teach what they say it does so for that I thank you and if there is something we can do as your viewers please let me know and I will stand up for free speech and what is write!

    Look, you are clearly in the right here. But being right actually doesn't matter at all. Like in any fight, you know to never expose your fear to an opponent. You made a mistake by saying you don't want a law suit. That only emboldens them to do just that! I am no great martial artist, but I am an old guy who understands weakness and bullies. These guys are weak and they are bullies. If you have to, let them have a law suit you can't control that. I am really doubting they want a legal confrontation any more than you do. I like your videos and your courage to look at yourself honestly. Keep it up! You may get bruised in the process but if you are persistent you will prevail!

    Your move was responsible, and your critique was right. I wouldn't worry too much about what they do and say. Fair Use law is a very loose field, so sometimes people will win poor "cases." You are right that is so important that we don't let ourselves start thinking of ourselves as something superhuman. No, no, just normal people learning martial arts. Since you often tackle controversial topics, you might want to back up your videos if you haven't already.

      I dont get it I watched the video that was taken down, I thought you were very kind towards it, explaining both the positive and negative about all the flips, defence aspects,etc. I cant see what they can complain about, you were respectful and did not slag them off, just gave your honest opinion, which as you say, should be freedom of speech

    That video was definitely fair use because you used the video for an educational purpose - in this case, trying to show effectiveness in technique. Discussions like these are very important in order to get better in their skills and think more critically. Plus a number of people may be feeling the exact same way but don’t know how to or get nervous about expressing it.
    You’re walking and talking the aikidoka spirit authentically. Don’t let this stop you from talking! :) I understand that in some traditional martial arts, displaying techniques in public can be in violation of a lineage’s/master’s permission to share. Someone else also talked about the wa (social harmony), which is another valid argument. But on the other hand, considering that it’s social media and martial arts secrets are starting to drop by the wayside in exchange for sharing effective techniques, it’s a huge loss from learning from each other.

    I saw that video; it was absolutely fair use. As others have pointed out, it is illegal to issue a DMCA claim in bad faith like this.
    You should challenge the claim through CZcams. I don’t believe that you will be sued over this; as I said, the claim was made in bad faith, or at least was issued improperly, and they will not want to go to court over this.
    Challenge the claim, get the video back up, and leave it there as commentary. It didn’t sound like you took much other issue with their demonstration besides the knife defense, so there should be no further issues.
    If they do decide to sue, remember that most claims in the United States (where CZcams is based) do not go to trial; there is almost always a preliminary hearing where a judge will hear the complainant and the defendant and decide if the complaint has sufficient merit to go forward.
    Alternatively, if they do file suit, you can always just say to them, “Neither of us wants to do this. I would like you to withdraw the complaint. What would you like me to do in exchange?” This is how most civil cases are settled.

    CZcams didn't want to get sued for libel, or facilitating libel. That's about the only reason I can think of for CZcams intevening like that. Sad, but that's where things are now.

      No. The way this happens is that someone issues a DMCA takedown notice and CZcams, by default, will take down the video and issue a copyright strike on the offending account because a DMCA takedown notice is a legal action. In issuing the takedown notice, the person is claiming under penalty of perjury that they are the owner of the copyrighted material in question and that they honestly believe that the offending material is a copyright infringement after taking into account the possibility of fair use. This is why I suggested that Rokas consult a lawyer about the matter. People are under the false assumption that it's all fun and games when they attempt to abuse CZcams's copyright system, but it's not. They are taking legal action and it should be met with legal consequences.

    I’m not surprised. My wife referred to this as the “Cobra Kai Syndrome”. Bullying has no boundaries. These people who did this have the SHOW NO MERCY type attitude.     I saw the movie "Fighter in the Wind". It's about the founder of Kyokushin Karate. Kyokushin means "the ultimate truth". You prove "the ultimate truth" by going around and beating the shit out of everybody. That's how you prove the ultimate truth. Oh by the way, in the movie Karate was becoming a dance.
    Time to go Highlander and prove "the ultimate truth". Cus D'Amato was challenged to knife fight to the death, and he accepted. He wasn't a knife fighter, but he was a boxer and he showed up with ice picks. He other guy never showed up.
    Let's recreate that. Take a boxer, give him ice picks and challenge that school to a knife fight. First blood rule, whoever draws first blood wins.
    "In the end, there can be only one."
    That's how you figure out the Kyokushin, the ultimate truth.

    Dear Rokas Sensei, I think you're the one who is not fair...you said the aikidoka's techniques were crap and irresponsible without including a footage of yourself demonstrating the techniques showing its uselessness and danger while providing an alternative effective techniques. You yourself had not applied the budo that you still lived by , and that is the "respect" or "rei" of your hakama.
    Though youve kept it away, I always see you wearing it in all your videos. I believe it is so, because regardless of all other trainings, you are still a master of aikido and in your heart, the principles of the 7 pleats can be found beating with life because you believe it is good and worthy. You had only just freed yourself from the organization, hierarchy and tradition but not the art. I believe "O Sensei" would be proud of you, because of your journey to find truth and by improving the art thus SHARE it to propagate peace and harmony.
    I myself is nidan of far Shioda & K. Tohei Sensei branch but not aikikai and had felt pain of censure from aikikai dogmatic practitioners regarding certain techniques. I am also on a journey to seek truth and had added striking methods to my defense techniques. I practise regularly in aikido for purifying my heart to avoid using the deadly striking methods i have learned and continued to train in; for the purpose of protecting myself and persons I care about, against unforseen-no rules-unlawful confrontations.
    Keep on your path and have the courage to continue the struggle. I wish you more strength and wisdom.. Osu !
