    I'm 5'6, weigh 125lbs, I've had multiple concussions with previous eras of amnesia. I'm not being drawn into anything mutual. There is no mutual combat for me. If someone assaults me with the intent to harm my brain they have chosen to be shot. I hope they survive, but they will be stopped. I've been knocked out for hours from punches. They're deadly. Im older now and have chosen to not be assaulted.

      I'm 6'7" and a solid 260 lbs. I also have MS and can no longer go hand to hand. Some days I can barely walk. If someone assaults me with intent to do harm they have made the conscious decision to be shot.

    I'm 75 years old and mind my own business. I can't run and my fighting days are long gone. My choices in a fight or flight situation are to get beaten and hope for survival or stop the assault the only way possible and risk going to jail depending on the political beliefs of governmental players. That's a pretty messed up list of options.

    Do your best to de-escalte walk away but if pursued defend yourself. Never let a threat get close enough to assault you, if you do you have lost and will be badly hurt or killed.

    Morally speaking - you don't owe an aggressor a foot chase or a fist fight for an engagement you didn't start.
    This is not an endorsement to shoot someone that is simply, verbally confronting you or not to attempt de-escalation if possible, but duty to retreat is a morally reprehensible philosophy.

      Nothing in this video said "in any way". The bottom line was, don't bring a gun to a verbal fight, because you'll be seen as escalating. Remove yourself from the situation however possible and use your weapon to defend yourself if that fails and you are in danger of real physical harm.
      Dude: You looking at my girl?
      You: No. Sorry for the confusion.
      Dude: Looked like you were staring at her across the bar.
      You: Sorry, didn't realize that. I'll leave (begin to walk out)
      Dude: (Follows you to your car)
      You: Stop following me please. I'm leaving. I don't want any trouble.

      Cops: So what exactly happened?

    I have a very bad back and was partially paralyzed in a wheelchair for 3 years and can walk again with 7 years of intense rehab. I simply can’t take a impact or afford to get into a physical altercation. I have no choice but to use deadly force. I can’t afford to be back in a wheelchair again or be paralyzed. I am older now, I couldn’t care less what a politician or judge says! Besides, I have a God given right to defend myself. I don’t need anyone’s permission. It’s my life on the line, not theirs!

      Right ... but .... you more than likely have more to lose than some methed up crackhead, and the civil aspect is something to consider if you like having your money stay with you. You may never be charged, but there is the family that will sue, especially if you're worth anything.

      @@hunterws These violent encounters happen in just seconds, and trust me your natural instincts kick in and there is no thought process weighing the consequences of just defending yourself from a violent crime and a predator that has every intention of killing or maiming you for life!
      When your survival instincts kick in and the rush of adrenaline flows I assure you money will not factor in the heat of the moment.

    1. Weapons, guns, knives, etc., aren't magic wands. Producing one has as much chance of escalating as deescalating a situation.
    2. Turning away from an raging fool may escalate the situation. I prefer to not get struck in the back of the head by "insulting" the fool.
    3. Not getting into a situation may not be an option. One may be minding one's own business in a "safe environment" and be confronted by a fool who has wandered into that place.

      @@alexwalker2582 Or use gel, it's way better for most situations. I just got two for my very liberal neighbor after she expressed concerns about security following a workplace incident where a disoriented stranger found his way into her office on campus. We did some training using bananas to simulate knives and a couple cans of dollar store silly string as a gel simulator.
      I made it very clear to her that if someone is angry enough or high enough, the gel won't make a difference, because nonlethals rely on pain compliance, which requires some degree of voluntary cooperation on the part of the attacker. But I do believe she is better off now than she was before when she was willfully ignorant of the reality of the situation.

    I'm 63, 155 lbs courteous and polite in public by default. If a 200 lb Alpha idiot comes at me I'm not taking the first punch. I don't see a jury in Open Carry Arizona convicting me on that. He got his warning right there on my hip.

      Real or fake, you need to call the cops. If it's a real cop, they'll understand, and they'll appreciate you doing your due diligence so they know there can be some mutual trust during any following interactions. Dispatch will know where they are or at least where they're headed so they can confirm the legitimacy of your visitor. A fake cop will get belligerent at this point, and by that time you're already on the line with 911 and you have your CYAs in order when you have to defend your home.

    But if someone is larger, says more than would like to fight, but that he is going to kick your ass, translation, cause you serious bodily injury... and starts moving aggressively and quickly towards you, I think you can reasonably believe you are in imminent danger of serious bodily injury warranting the use of deadly force for self defense. Now Tom has another video in which he say 98% of the time you draw and don't fire, the attacker flees or stops. But I think in this situation, you can articulate a reasonable need to draw. Then win the race to 911.

    Guy came into my work. Started cursing at employees, we asked him to leave and he started freaking out, shouting that he was going to shoot everyone in the store multiple times, but never presented a gun. He left and came back 30 mins later and stared through the doorway with his hand in his pants like he had a gun, saying nothing. Stood there for a min or two then left. I always think back to that situation and wonder if I could have fired shots at him initially or when he came back.

    During my 16 hour ccl class, my instructor gave us 3 questions to always ask ourselves if we're in any situation where we just might consider brandishing or drawing our weapon..
    1. Am I willing to die for this?
    2. Am I willing to go to jail or prison for this?
    3. Is my ego involved in this?
    4.(I added an extra one) Can this argument/discrepancy be settled with talking later on?
    Yes I agree if someone is screaming at you, maybe shoving you or something and threatening bodily harm you should act appropriately...but if their hands are empty...it's just empty threats and I'd put distance between you and your pursuer....9 times out of 10 once they see you back off they'll go away....it's that 1 out of 10 that would possibly escalate it and put you in a position where you'd have to make that choice to draw your weapon....because if it's just arguing...once you bring that gun into the situation...even if it's just lifting your shirt or pulling your jacket away to show you're armed...that's a whole new dynamic that might escalate the situation...and it might not be in the way you wish it'd turn to...

      Just putting this out there, you grew up in a very safe or middle class area right? Because I will tell you 90-95% of the time backing off means you will get attacked from behind. The places where a fire arm would be a useful tool does not include many folks who will let a fight go.... and the never EVER come at you 1 at a time if they can.

    As of this month I have carried for 50 years ( work, & personal protection).
    A few times I had no options. The other decades of carry, I avoided, descalated. And avoided taking someones life.
    It can be done very sucessfully...

    My dad started teaching me about guns, safety and how to shoot at 7 yrs old and as I heard then, I have always followed the 'rule' that you never pull out a gun unless you are prepared and need to use it. Especially in today's climate where the people who are defending themselves or others are the ones being arrested and charged. As a female who was attacked and beaten while he tried to drag me from my car and as people crowded around, not one person did anything, not even calling the police. It took a long time for me to even go out in public and to date, in this climate, I still try to wait until my husband can come with me. We have constitutional carry in Ohio which is great, but I still fear doing so with laws being written where they can be stretched to fit anything they want to use against you. What advice would you give to women who are very capable and comfortable with guns, but fear carrying anyway? This is a big reason I joined USCCA and love your videos and training.

    I think the biggest takeaway from this is not whether or not you will get charged with a crime but whether the jury would believe you when you say you feared for your life.
    If you're small and old and a younger, stronger guy is threatening you then I think a jury would find in your favor.
    If you're Dwayne Johnson and you say you feared for your life against one unarmed person that is clearly smaller and weaker they probably won't side with you.

    Without watching, I'm going to say best practice is only draw if you intend to fire in self defense. Brandishing/intimidating actions are usually considered criminal acts.

      We do have the privilege to threaten, and it can end a confrontation on the spot. I know, as I have done it to stop a road rager. Cops charged me for following him a block (disorderly - dismissed after 6mos), no gun infractions.

    The problem is if you get beat by someone violent and you are knocked unconscious, now they have access to your gun. It seems like they don’t care about committing violent crimes-now they have the option to finish you off. Will they go to jail? Yeah, but they probably didn’t care about that in the first place considering they were willing to go to jail the moment they attacked you.

    If one waits to get punched, stabbed, or shot before brandishing or shooting at a potential attacker, one typically loses one's opportunity to draw and fire one's gun from a position of advantage and safety. Laws that bar one from pulling out a gun preeminently when an attack is imminent are ignorant laws passed by ignorant criminal loving politicians who know nothing about actual combat or self defense. Attacking criminals can be lethally dangerous even when they turn their backs or only have their fists and feet available. No good person should have to justify shooting a criminal in the act as long as the only one shot is clearly a criminal in the act.

    I'm not taking a chance with anyone willing to do to me or my family bodily harm. They're getting the business end of my firearm. Period. I'll deal with the legal repercussions. This is the whole point of self defense. If we aren't allowed to defend ourselves then what is the point?

    The standard for self defense remains the same. Reasonability! If you have a reasonable fear of great bodily harm or death, you can protect yourself from it. How you protect yourself is up to you!

    The question was "can I draw my gun if someone is threatening to fight me and I do not want to (or can't)" not drawing or brandishing during an argument. The fact is not every argument leads to a fight (physical threat); so answer the question not your personal idea of the question. All of these "answer a question" things are getting just about alike - "check your local listings" ! I don't think that is much of an answer.

    If you say "no", you can exit the situation. There is NO duty to "fight" and if engaged; they are an aggressor. Swallow your pride and walk away.

    I can’t believe some of these people question. If you do pull it and pointed at him you could go jail for pointing a gun at someone. I’ve seen some DA charges you with aggravated assault.

      ⁠@@MansaXi agree with you to an extent. Though, the term “fair fight” can really only be applied to a combat sport. You never know if someone has a knife on them and use it because they didn’t want to get beat up.
      Other than that, I also don’t ever want to use a firearm for self defense. You’ll never fully recover from that moment.

      I'm in excellent physical condition - a lean muscular 5'11" at 170lbs., in the gym a couple of days a week for weights and cardio - plus regular bike riding.
      I'm still 60 though.
      Am I supposed to go hand to hand with a 6'2" 200 plus pound 24 year old?
      Is that fair?

    I'll take this question to the next level; What if it actually comes to blows and the other person clearly has the upper hand; bigger, stronger, younger, maybe even a male on female....would drawing the weapon THEN be warranted? At that point, the person would most likely actually be in fear for their life.

    Wait a minute..... If someone wants to "on the surface" beat me, wouldn't I be defending myself against grave bodily injury? Things can happen fast, I'm saying if the other person advances towards me after I tell them to stop, I would likely fear for my life. I'm 60 years old and likely could not fight back very well. Maybe your answer could address a few different circumstances. The question that was asked did not indicate a mutual combat scenario, but rather during a heated discussion during which time the other person advances on you under circumstance that an ordinary person would feel threatened. It's easy to say, well if voices get raised just leave. That is not real world. Most people are not thinking about the firearm they are carrying every second.
    You guys usually do a really good job on these question, but this one was a little lite. I understand that there is no simple answer and there are many circumstances, but give us a few of those circumstances. I really do appreciate you guys even addressing these questions. But surely there must be a scenario like this that happens so fast that ones safety should take priority......

      Unfortunately, when it comes to this channel or any channel they cannot give firm answers as there are legal consequences for them. They cannot tell you what absolutely will happen and most lawyers avoid extrapolating on what if scenarios.

    that’s why in the situation that’s clearly described in this video I think it’s a great idea to carry an LTL alternative like pepper spray i myself do that just in case the situation where ever arise because no matter how much you try to de-escalate the situation some people will just keep pushing the envelope

    I see a couple of people posting comments about the law as it pertains to those of us who are disabled. Are there any special considerations given by the law with regards to disabled individuals and when we can draw our weapon? I am MORE than willing to avoid ANY confrontation but I now lack the ability to effectively defend myself.

    Legally the only time you should ever draw your gun is if you or someone you see is in clear and immediate danger of losing their life. It’s that simple. No you shouldn’t have to take a beating before you use your weapon but not every court case will turn out as good as the rettenhouse case did.

    NEVER let someone know you even have a gun. If they are dumb enough to attack you, that's their problem. If you show them your gun, they quit often back off and go get their gun. Its just a bad idea to show your gun.

    When you are confronted with threatening circumstances you may notice that neither law enforcement officers or lawyers are standing by your side. At that point it is your job to save your own a$$ first. Understand that during that moment in time you are on your own. This is not when and where you wring your hands or mull over legal technicalities.
    Consider this very fundamental choice when your survival is threatened. You can have your day in court or become one more statistic at the morgue.
    Are you fearful during this theoretical confrontation? Then it is time to extract yourself from the situation. Leave if you can. If you can’t, act to remove yourself from the encounter by any reasonable means necessary. If that means introducing a firearm to save your life, so be it.
    Your day in court, if it comes to that, is the better choice. There is no future in being subjected to autopsy, reduced to lab samples for analysis, and ending up a post-mortem report.

    Folks just my two cents, but more than once my firearm has talked someone out of something stupid! Know ing that you wont or cant pull it, gives morons a false sense of security. I think the law in this instance(and a lot of others) is stupid and just hamstrings your ability to defend yourself. As for "swallowing my pride", it's that stance that brings out the idiots who know there is no consequences in the first place!

    Well, I think the question is, at what point are you legally within your rights to pull your gun in order to keep it in your possession. I think if you are actually attacked while carrying, you are obligated to shut down the attack in order to prevent a nut case from acquiring and using your firearm. That's the dilemma of carrying, you are trying to prevent great bodily injury but may be compelled to cause it.

      Even in nutty states like California, if someone attempts to deprive you of your legally-carried firearm, you are justified in using lethal force to stop him because it can be assumed the assailant intends to cause death or great bodily harm with it.

    If you are disabled or handicap person, and someone bigger than you or more violent than you is threatening you, then you honestly don’t have a choice.
    Also, what if the weapon of choice wasn’t a gun, but a stun gun instead or maybe just a taser?

    I get it, a gun is never to be used as a weapon of intimidation. As I every day carrier, I wonder this, when a person has threatened me with physical harm and I truly believe they are about to do it to me, can I show them I’m armed? It’s not pointing, it’s not telling them I will shot you. It’s simple lifting my shirt to show them I can and will protect myself. Is that legal in Texas? I think I know the answer, just curious if you actually read answers question.

    What about multiple persons and your feel out numbered? In Nebraska in most cases it is my understanding you need to show that you initially retreated if possible. If though it is one person, I see that New York couple on a bench after a wedding and another guy is creating mayhem and then picks on them and the guy is stabbed with a knife and dies. So much for feeling safe in N.Y. City.

    Going on the premise of death or great bodily harm, I would say it would depend on who you are - and who they are.
    Are you a much smaller, perhaps older and or physically disadvanteged person up against a much larger opponent?
    Perhaps a woman up against a large male?
    Does the law expect you to fight that person by hand, possibly to your own death?

    Isn't there a law that has something to do with close proximity in a threatening manner? Why wouldn't people be able to protect themselves in this matter or someone else if they are just caught up in an aggressive conversation?? There are so many scenarios that could play out here, but I think law enforcement, and society need to understand that someone may need stand firm to protect themselves or loved ones in any situation! Without becoming the "bad guy" because you were defending yourself or others... so much emphasis on if you are a law abiding citizen that has a gun and deters loss of life or something else, that you are deemed the bad guy..it's out of control!we as a society need to start remembering that this is out right. This is what our history is. This is how we stop the criminals.( Within reason, or sense)..

    Don't "brandish". "Allude". I think this channel had a video months ago with a restaurant owner de-escalating a potential conflict by just raising his shirt slightly to show a guy harassing another guy his holstered grip and the guy causing issues left. If you need to de-escalate, be subtle, don't draw and make a scene. No one else ever needs to know what happened. Subtly reframe the severity of the situation for the aggressor, then move on.

    Disparity of force and reasonable risks to your life. Medical conditions among other things may make use of deadly force acceptable.
    Disparity of force simply means that the force being deployed against you is over your ability to defend yourself other than with deadly force. Are you a woman being attacked by a man outweighing and more of them than you?

    I am legally and permanently disabled. In my state, there is a 'disparate force' allowance for the use of deadly force. One question I have never been able to get answered is: given my disability, if threatened, am I allowed to use potentially deadly force to protect myself?

    When i carry, i avoid all possible confrontation. If someone tries to provoke me, for no reason, I'm going to keep walking away, while staying alert.
    Whether pulling my hardware is legal self defense deed l depends on many factors. I'm over 60, and i can not run.
    If the person looking for a confrontation like a school bully, and he is 20 or 30 something, very fit and seemingly angry with roid rage, then drawing and, if necessary, shooting, is proportional force in self defense. Sure, i earned a black belt when was 47. But arthritis forced me to stop training over a decade ago. Only a firearm is going to stop an attacker who intends to harm me.
