You can legally make the U-turn, but it does nothing to protect you from being subsequently followed by cops until they can articulate PC. The police in this case allege he was swerving after he made the U-turn. Disputing this would have been a plausible way out had he simply pulled over, but he dug his own grave here.
I went through a DUI checkpoint once as a passenger. Thought we were done for - car smelled like weed. The cops seemed more concerned with 2 things - handing out mothers against drunk driving pamphlets and watching for people trying to duck the checkpoint. Let us through, no issue. Kinda weird honestly - that car stunk like weed pretty bad😂But yeah my take away was you're more likely to get caught turning around than going through.

They are an administrative search, like being screened at an airport. They have a specific, limited purpose for which probable cause is not needed. In most states they need to be justified, like a search warrant, and are announced in advance.

Yeah, they should wear the bodycams on their heads. The officers in my jurisdiction have some that are attached to sunglasses, which seem to work very well. Plus, you get to see exactly what the officer was looking at. I once had to watch a bodycam video from a shoulder-placed cam. The officer bumped it on the side of his patrol car as he exited the vehicle, and, after that, the rest of the video was a 60-minute-long video of the sky. 🙄

To be clear, most officers have no idea what their placement footage looks like until a high intensity crime like this happens and they play back bodycam footage. Usually, this is when supervisors help to figure better body placement on that officer for the future. I try to keep that in mind……but still get frustrated when the most important footage of the event is impeded by arms, hands, thumbs, shirt collars, etc 🤷🏻♀️😆
officer literally could have pit manuvered the car when it was turning around. instead he hesitated and a family ended up getting hit. you can see him take it out on the driver later in the video.
NMSP officers are not allowed to pit without approval or a supervisor and the pit is under 35mph. The officer was not approved to pit which is why he didn’t pit. Had the officer pitted the car he would have broken policy which could have led him to be reprimanded or fired.

Secondly, no, you would NOT be arrested for telling a cop that, because that's protected under the First Amendment. They would just ignore you and arrest you for the actual crime you'd committed, such as DWI.

NM is a progressive state, most communities ARE AS WELL, as long as they expect the citizens to be responsible, while not arresting, convicting, incarcerating they'll never understand criminal justice, he escalated his situation, after colliding with an innocent family. Perhaps one day NM will change, but the politics of the Governor seems to be her priority!

Yes, because not having a license always stops people from driving. And illegal possession of a car (you can't just forbid someone from owning a legal possession, btw) is totally going to discourage them when no license wouldn't. Try buying a car from a dealer with no license. You going to require private sellers to run a DMV check before selling a car too?
@@justforever96 More jail time, PERIOD. The problem is they don't enforce these laws, and when they do it's just a fine. You CAN prohibit someone from owning or possessing certain items by court order, it's been done. MANDATORY jail time for driving without a license willfully, no insurance, no registration, or violating court orders or probation.

@Los Angelino I live in New Mexico, and that is factually incorrect. It is completely legal to make a U-turn across a double-yellow line, unless there is a sign specifically prohibiting it in a specific area.
What are you supposed to do in the middle of nowhere, keep driving for 50 miles to the next intersection to make a U-turn?
You can legally make the U-turn, but it does nothing to protect you from being subsequently followed by cops until they can articulate PC. The police in this case allege he was swerving after he made the U-turn. Disputing this would have been a plausible way out had he simply pulled over, but he dug his own grave here.
I went through a DUI checkpoint once as a passenger. Thought we were done for - car smelled like weed. The cops seemed more concerned with 2 things - handing out mothers against drunk driving pamphlets and watching for people trying to duck the checkpoint. Let us through, no issue. Kinda weird honestly - that car stunk like weed pretty bad😂But yeah my take away was you're more likely to get caught turning around than going through.

It varies by state, where I live they’re illegal. But it’s just like an immigration checkpoint, you can just say no thanks and drive off
They are an administrative search, like being screened at an airport. They have a specific, limited purpose for which probable cause is not needed. In most states they need to be justified, like a search warrant, and are announced in advance.
They are NOT random.

That being said:
This has got to be one of the WORST body cam placements EVER. It missed EVERYTHING pertinent to the takedown and arrest. Incredibly frustrating. I hope the officer wearing it was shown how poorly it recorded important details and was helped to find a better placement on his uniform.
Yeah, they should wear the bodycams on their heads. The officers in my jurisdiction have some that are attached to sunglasses, which seem to work very well. Plus, you get to see exactly what the officer was looking at. I once had to watch a bodycam video from a shoulder-placed cam. The officer bumped it on the side of his patrol car as he exited the vehicle, and, after that, the rest of the video was a 60-minute-long video of the sky. 🙄
@@davidwilliams5407 I think on glasses or worn on the head would give the best footage too. To be clear, most officers have no idea what their placement footage looks like until a high intensity crime like this happens and they play back bodycam footage. Usually, this is when supervisors help to figure better body placement on that officer for the future. I try to keep that in mind……but still get frustrated when the most important footage of the event is impeded by arms, hands, thumbs, shirt collars, etc 🤷🏻♀️😆
officer literally could have pit manuvered the car when it was turning around. instead he hesitated and a family ended up getting hit. you can see him take it out on the driver later in the video.
New Mexico can only pit at 35 mph or less.

NMSP officers are not allowed to pit without approval or a supervisor and the pit is under 35mph. The officer was not approved to pit which is why he didn’t pit. Had the officer pitted the car he would have broken policy which could have led him to be reprimanded or fired.
