    I agree with that, Nintendo should focus on the actual root problem of piracy instead of just stopping piracy. It’s like when governments just try to hide and shove away homeless people instead of actually helping and fixing the problem that is causing them to be homeless in the first place.

      Exactly, the Gabe Newell quote very much shares that sentiment. It is unfortunate and shows other games companies that following in Nintendo's lead is a viable strategy.

      I think the problem relies much on putting too much focus on restrictions for things that shouldn't happen than making solutions to, what unbelievably, happens.

      @WuAgent Piracy is not theft. Theft implies that something is stolen from one party by another. A stolen possession is inaccessible to the party it was stolen from until it is returned, and replacing it will always have a material cost.
      Piracy is copyright infringement. It is making/using/distributing an unauthorized copy of a work protected by copyright. Unlike theft, when a work is pirated, the creator does not lose access to that work, and the material cost of producing another digital copy of that work is essentially zero.
      Think of it like cheating on a test. Theft is like stealing the smart kid’s answer sheet and submitting it as your own, whereas piracy is like copying the smart kid’s answers onto your own sheet.

    I agree, and very informative, I like that you spread awareness to people, different emulators and fan made games will be able to break some policy, like emulating fairly recent games or violate the copyright terms , there nintendo has clear motivation to take them down, but imagine paying 40 bucks on games of 20 years ago that with minimal effort put in, you can play them directly and for free on your phone in higher quality lmao

    There's a lot of scare about Nintendie taking shots at Ryujinx and other emulators after this and while I do agree that's possible, and that they are definitely extremely relentless for no good reason, I don't think being scared that emulators will disappear completely is logical. Like you said, most of them didn't do shady stuff and profit off of their software.
    Yuzu was also allegedly putting out beta versions of the emulator behind a patreon that were specifically fine-tuned to run pirated copies of games before their official release. So yeah, add that on top and you have your reasons on why Nintendo was the angriest at them lol

      Thank you brother. I definentally agree, but I don't believe that even the special patreon builds were able to play games before official release. If I recall correctly that was part of yuzu policy to not allow unreleased games to run.

    Nintendo isn’t as good as it was in the 2000s and 2010s back in the day. We got so much great games and tons of stuff like that. It’s too bad nowadays some of the games are just kind of bland like Princess peach showtime I miss the Nintendo of. The past. The best thing they did recently was making a Mario movie and some remakes but they still do bad decisions

    Nintendo is the most greedy game company ever. They want you pay 60 bucks for a game and dont even lower the prices for their games, plus they want you to pay 40 buck a year for online and for a trash N64 emulator.

    What an excellent video. I couldn't agree more. I love Nintendo, I really do, but I'm really upset at the crap they've pulled in recent years. I'll always buy the next Mario game, but I don't regard them quite as high as I used to. I just want them to be better. They really have everything they need to be the best / most highly respected game company, they're just incredibly fricking stubborn.

    4:30 okay one little gripe, ARES is NOT friendly on older hardware, I have a older Ryzen 5 from ~2020 or so, ARES runs N64 like actual garb on that lol, but yeah,

    I think the main reason that citra/yuzu got shutdown is that they were promoting piracy/downloading roms of games not released yet. This is from my knowledge though so I’m not entirely sure

      i understand, because a lot of people have been spreading misinformation that they were, but every policy of yuzu was to prevent piracy. Thats why you couldnt just download keys straight from the yuzu website, it was to prevent piracy.

    0:33 the yuzu vs nintendo lawsuit never reached court, they settled out of court instead
    0:38 no judge has ever ruled against or in favor of yuzus practice of soliciting donations to work on the emulator, so absolutely no legal precedent has been set at all. other paid emulators are still just fine until a judge rules against them in a case that actually goes to court

    Seems like Mario Kart tour never improved the racing part of the game instead has turned to aggressive AI that’s allowed to cheat. no item options for the AI. Just messing with badges so you have to guess their difficulty instead of just letting the players choose the difficulty they want.

    nintendo isn't cool. not sure how it was with iwata still being alive, but from what i know iwata did a lot of cool stuff that would never have happened otherwise. i think mother 2 - earthbound SNES is part of that.
    like every other company, nintendo is also a company. they want our money. and companys aren't our friends. companys aren't "cool"
    on my end, i can't deny nintendo makes cool games. the mario games and even luigi's mansion games are some of my favorites. and i know i am part of the problem to keep buying nintendo's shit.
    nintendo is like a very selective petty child. it can be nice and playful but don't you dare piss it off. you will regret it

      @@wyaPUNK i suppose i just picked the wrong side then. the coolest company i can think of is valve and how they treat their customers/go about the piracy problem. but when i think about the other big ones like EA and Blizzard for example it doesn't seem to be that much better. though i am not the one to talk about them since i am not familiar with them. what companies would you consider "cool" if you don't mind me asking?

      ​@@N3Selina The problem is not everything was beautiful and pretty when he was still around and the same thing with Reggie, There were also fan takedowns and weird decisions that fans didn't like during the 3DS and the Wii era, However, Nintendo did actually pay tribute to him in the Mario movie credit scene, which is proof that they still care about his legacy.

      i think i know what you mean. i am not one to talk about company PR and IP decisions - but i agree that nintendo's decisions have been rather hard to justify on a moral level. i am not too knowledgable about reggie either. he seemed like he had the best intentions and seemed like a person that tried very hard to do the right thing~

    Nintendo didn't shut down the emulator for the patreon, Nintendo SHUT DOWN the emulator because the patreons obtained access to a secret discord that has free or even paid roms from switch to run the emulator.
    And this is completely illegal and is not what game preservation is...
    Also the code needed to decrypt the games was copywrited, so... Yuzu could have survived ONLY if they didn't offered access to the Switch's roms Discord in first place, because if nintendo wanted to... They could have shut down every emulator for their consoles, and they are not doing it.
    Also this could apply for citra, because they are the same creators and didn't wanted more problems, they shut down THEMSELVES this emulator too.

And that code used to decrypt games is legally obtained, if nintendo has a piece of hardware that has a vulnerability in it the user who paid full price for it has the choice that they can do whatever they want with that. it may be against nintendo's terms of service but it is legal. Yuzu shut themselves down because they couldn't handle the heat of taking this to court because they are not a gigantic mega corporation.

      And that only works if they use reverse engineering to decrypt the games, not using the straight up code of the console.

      And no, getting the decryption codes are not legal (at least in USA)
      The legal demand wasn't for the emulator, it was for the access early for the games

    The laments of people who haven't bought a video game since Obama's first term.
    It's easy to have every game ever made on your platform when it's all pirated software and you don't have to worry about pesky things like licensing and royalty fees.
    NSO is $49 a year, not a month. Yuzu wasn't taking donations to preserve old games. They were bankrolling off day and date rips of TOTK. Truth is, Nintendo doesn't care about emulators or emulation. They do care about people making money off their stuff.
    The museum analogy isn't very good. The people who own the works put them in the museum themselves by selling it to them. Nintendo's situation would be like museum staff breaking into people's houses, stealing their items, displaying it at their museum then getting pissed off when the original owners show up with the police to get their stuff back.

      One, i mustve given off an older age then i am but i have bought nintendo games after 2016. I still do I bought tears of the kingdom when it released. And two i dumped tears of the kingdom and played a backup on pc day one. which is legal, but two yuzu wouldnt let you boot tears of the kingdom that early youd have to look to ryujinx so for you to accuse yuzu devs of "bankrolling of day and date rips of TOTK" is just an outright lie. Your completely misunderstanding the museum analogy because yuzu wasnt stealing anyones copyrighted code. they simply created a software which emulates a piece of hardware which has been legal since the ps1 era. the only reason nintendo was able to take them down is because a court said it was wrong to lock more actively updated builds behind a paywall. yuzu did not break or disturb anything. please research before you write hateful comments assuming things about others.

      Yuzu was indeed bankrolling from TOTK rips and had the game running day and date due to having the encryption keys and the Rom and distributing them through their discord. So yes, they DID steal Nintendo's copyrighted code and were forced to give it back per the settlement. The lawsuit wasn't even going after emulators. It was going after hacking tools and proprietary code used to get the game running on the emulator.
      Why would they settle so quickly if everything they were doing was above board? Why is ryujinx and 100s of other Switch emulators which can be easily found by a simple google search doing just fine if Nintendo just wanted to take down every emulator?
      Emulation in dumping your own purchased game is perfectly Legal and Nintendo knows this, regardless of how they feel about it. What yuzu did, in illegally distributing game roms along with encryption keys to circumvent Switch security while paywalling it is not.

    i never really liked nintendo, most of their consoles have annoying gimmicks. Nintendo makes such good games but they just lock them behind a gimmicky console. The wii has motion controls, the ds has 2 screens the switch has joycons etc.
    They just shut down emulators for trying to preserve old games and so people can play them without that (no longer produced) console
