I really liked Gina's character, I was very disappointed when Disney dropped her. I don't think she should have been treated the way she was!
If Disney is unable to get this case dismissed, look for them to do everything imaginable in order to prevent it from going to trial, thus exposing them to the rules of Discovery. I expect them to literally throw millions of dollars at Gina in order to make her go away.

You know, the Ewoks weren't that bad. They mainly suffered from the fact that they came out at the tail end of the trilogy - all the stories were set in a time period previous to ROTJ, and felt like they couldn't really go anywhere for long.

there's an issue here, Carano has to abide to the rules of the company that employs her, so that's going to be difficult. The thing going for her is, the court must decide, when does the employee's personal time starts and end, therefor deciding when does she loses her first amendment rights begin and end when giving her opinion as a private citizen and not an employee. I hope this doesn't get dismissed because so many people have lost their jobs over hurt feelings of some weak minded people. This (to me) is more important than it seems. a company's salary can not and shall not determine what a person is or not allowed to say, where I'm from that's known as communism.
The real issue, as many have pointed out, is the discriminatory double standard Disney chooses to apply. It caught up to them this time and all it's going to take for her to win is to get a side by side comparison of her instagram post against Pedro's.

DJ has mild spina bifida with 85-90% use of his right leg and 50% use of his left. He uses handle crutches and designed his workspace at ILM to allow him to move around and still be productive. He committed the cardinal sin of consulting his godfather George Lucas for ideas regarding production design for the sequel trilogy. Kathleen Kennedy forced him out by outsourcing all of his work to shops without ramps or elevators, then "laid him off" due to "safety concerns in the new workspace". Either way it's illegal AF and the fine Disney and Lucasfilm can look forward to will likely completely tank their already falling stock price.

Superb Video. Am recalling Jim Carey’s best dramatic role in the movie The Majestic. In the movie set in the time of McCarthyism, he played a black listed writer who was set to be called into a public interrogation of alleged communist sympathies. Through a series of mishaps he wound up in a small town with amnesia. Eventually he was captured and brought before an investigating sub-committee where he (Carey) gave his best dramatic performance of his acting career. He spoke of the persecution of those who differed in opinion from the ruling class and of the sacrifices made by those who fought and died for the right of every citizen to have the right to hold their own beliefs and not be hammered for them. Disney (the ruling class) hammered (black listed/fired) Gina Carano for her own personal beliefs. The point is that Hollywood in reality had to suffer persecution during McCarthyism and in response to this injustice of then and now they produced movies such as The Majestic, Citizen Cohn etc. to emphasize the unfairness and mean spiritedness of McCarthyism and yet they did everything they could to humiliate Gina. Hollywood hypocrisy at its worst.

Hollywood makes its own rules. Just remember this... Many things are written into all the Guild, Union, Producer, Talent, Agency rules and contracts. Until that language is purged, nothing changes.
Contracts don't override laws. Illegal contracts are unenforceable, and California labor law forbids workplace political discrimination. If Gina wins, expect a lot more litigation to follow.

If disneys 1st amendment right is not a valid defense then dismiss fails.
If itbis considered a valid defense then the case becomes companies 1st amendment right vs labour laws so companies do not abuse this position of power.
That kind of case is decided by a the finders of fact(judge or jury) upon hearing evidence from both parties as to why there arguement fits the law and situation best.
And of course there is also a 3rd option the court could bypass the trail altogther and as disney has confessed in the repaly to the guna case they view her speech as political and fired her for it but not others.
Well they might just say the confession and proof is enough to say disney has violated the labour laws..
I am not a legal expert so i cannot say how likely this will be but all the proof is there she was treated differently and disney gired her for her political speech.
I suspect the courts will want yo make an example of this case though and so will not do this...although from a disney perspective that version pf the events would be best as they skip diacovery or it at least becomes very limited discover to aaasess fair damages only.

I've read the opposition to the motion to dismiss. In case anyone is interested, there was one point by Disney and two points by Gina. Disney argued that because of the 1st amendment, they had right of association and could fire anyone they wanted. Except that's backward. So the first point by Gina was that 1st amendment allows for hiring people based on sex, race or otherwise because of the creative message they want to put out. But you can't fire someone based on those reasons alone. You can only fire someone for creative reasons. And Disney admitted they didn't fire Gina for creative reasons. Only that they disagreed with it. Later, they claimed it was "interfering" with Disney's ability to convey its own message but didn't mention what message that was. Gina counters that she is not advocating to change the writing in any of Disney's shows or any of Disney's message.
Gina's second point is that affirmative defenses (affirmative defense is where you admit to the allegations, but say it's legal) can't be argued in a motion to dismiss. In a motion to dismiss, you're supposed to take EVERYTHING in the complaint as true and it still fails on the merits of the law. An affirmative defense doesn't satisfy that requirement. It's a new defense that can be argued at trial, but not in a motion to dismiss. Gina's lawyers also destroyed the affirmative defense anyhow. It's quite a brutal takedown too.
Basically, every single precedent that Disney brought up was where the person was in a place to convey the message of the company or organization. Gina never attempted to change any of Disney's shows. Without that link, I don't see how Disney can win. Well, aside from corrupt legal system.
