      In his majority opinion, Judge Richardson noted that the ability of Americans to exercise self defense was the “central component” of the Second Amendment.
      Richardson added that the right of the citizenry to arm itself was self-defense against tyrannical government.
      “So while the individual right of self-defense was “the central component” of the Second Amendment, the civic purpose “was codified” based on the fear that a tyrannical government would eliminate the civically minded militia. Both reflected the pre-existing right of self-defense that the Founders valued as the core purpose of the state. “In the Founders’ world, individual self protection and community defense were not wholly separate spheres,” Judge Richardson stated.

    • @scootergrant8683
      @scootergrant8683 Před 6 měsíci

      Yes it is@@carokat1111. It's an issue which has existed for decades. Tyrannical leaders often involved firearm and other weapon restrictions. In a more discriminatorial sense, Scotland had such before the rest of Britain because the Highlanders didn't agree with the King of the time.
      To put aside the tens of 20th century dictatorial governments whom have benefitted of these restrictions, I can provide a more relevant example.
      During the Ukraine war, Zelensky realised Ukraine did not have the military might to fight the Russians despite its great technology. Numbers are valuable. So, Zelensky removed the enforcement of all firearm laws and hurried the training of his people. Fortunately for him, Ukraine is an ex-soviet bloc country, so it has weapons stockpiled everywhere. This allowed for fast arming of their nation. If the offensive swept any faster, people likely wouldn't have been trained in time as training takes months if not years.
      This is one of the founding bases to the Second Amendment to the United States Constitution.
      Remember, it's the Second Amendment, not the twenty seventh. Therefore, it was one of the first considerations ever made.
      Back then, the US wasn't short of smart generals and politicians. Given the incoming restrictions of overpowered empires and governments of the time, they were not going to overlook the same eventuality occurring within their new country. Thus why the Second Amendment is necessary to the security of a free state.

    Aussie here. You can’t really compare the U S with Australia when it comes to guns. Americans fought for their freedom, Australians didn’t. The gang crime and poverty in the U S is much greater than in Australia. Hunting for sport is big in the U S while in Australia it’s mostly banned and mainly for survival purposes in rural areas. The Port Arthur massacre was about the only major mass shooting in a long time before that except maybe during the under world gang land shootings between criminals in Melbourne in the 90s.There’s no way they would have given their weapons back. I liked Kevin Rudd as Prime Minister back in 2007 and 2011 but I think he’s got it wrong on this one. The guns are just the symptom and ironically the states with the stricter gun laws in the U S are where more of the mass shootings are.

      Also, an understanding of the histories of Australia and the USA will show you that firearms are deeply embedded into the American psyche, culture, legal system and society in a way that is just not the case in Australia.
      Remember, America was settled with firearms, fought its way to its current democracy with firearms, has massive firearms industries, became the leading economic and military power post WW2 with firearms, sustains an active hunting culture, uses firearms to protect from animals that will on occasion actively hunt and kill people.

      All you stated about firearms in America, except massive firearms industries, although there are smaller industries, also happened in Australia.

    What is interesting to note is that it was an Australian conservative government, the Liberal/Nationals Coalition that instituted the new firearm laws & the buy-back scheme & the laws were passed with bipartisan support in the parliament. Makes a mockery of any kind of bipartisan support in the US Congress that these sort of laws would receive. But then, we Australians aren't on a one way road to self destruction. We also don't have firearm manufacturers who profit very handsomely, thank you very much, from these horrific mass shootings. Witness the spike in the sales of weapons after every mass shooting & the jump in the stock price of the weapons manufacturers. Do they want to see a law forbidding people from owning automatic & semi-automatic weapons? Do they want to see the end of mass shootings? Their top executives' bonuses & stock values are linked to increased sales due to mass shootings. They directly benefit financially from mass shootings. It surely must be a sick society when Republican members of congress can blame everyone & everything for these mass shootings rather than the easy access to these military-type weapons & the insistence that more stringent background checks will be an infringement of peoples' "freedoms".
    A small correction for the presenter; former prime ministers, such as Kevin Rudd aren't referred to as "prime minister", unlike American presidents. Only current, sitting prime ministers can be.
