    It is a vert helpful info you have provided and thanks for that. But what about a scenario like - working as a employee in H1B (FTE) for a Company A and working for your own company B, would it be a different scenario? what are the possibilities? Please share your opinion/answers.

    Thats a great information. Thanks for sharing with us! However, i do have an unrelated question regarding job site. So can i work for a company fully remote from different state? Lets say my company is in California and i want to work from Texas, is it possible? And even if is, will it still have some negative impact in the future filings? TIA

    Rahul/Emily - I have couple of follow up questions .
    1. Does the job at Company B require that the employee has to have same Job Title (or roles/responsibilities) as in Company A?
    2. Can one transfer green card petition from Company A to Company B?

      Do not need to have the same title. Salary restrictions are the same as regular H-1B. No restrictions on hours you have a second job for 40 hours or less if you want so.

    I have quick question- Let's say I'm currently working with consulting company called "A" on c2c basis and would like to apply for new full time with the company called 'B'.
    Once the company B petition has been approved, can we switch the Company's A H1 regular petition to H1 concurrent petition ?
    How this works ?

    US immigration have to bring up a law for H1B's by asking them to make 120K per Anum for every petition this way they cant spoil American tech market by quoting very small price , also there should be law for foreign opt's to make at least 80K and rest of foreign visas 120K per Anum.

    Nicely explained. Thank you. Please share your thought on couple of my queries.
    What is the impact of concurrent H1 on primary H1 renewal or transfer. Can it result in RFE or does the primary petitioner need to know about concurrent approval?
    Additionally, With the concurrent filling approval date being greater than primary H1 end date, would the end date of can the primary application end date get extended as well?

I want to know an OPT student can work for multiple employers if yes then for stem extension which employer details I need to fill in form I-983 and also I need to report my university regarding employer details what details I need to provide if I was working for multiple employers.

      Do not need to have the same title. Salary restrictions are the same as regular H-1B. No restrictions on hours you have a second job for 40 hours or less if you want so.

    Eb2 approved PD 2/2013. Can one work on EAD at 2nd job and continue working with main employer (who has Eb2 approved) on h1b at same time ? - people who have really done this inputs appreciated. Idea is to keep the H1b going, but also have the option of EAD. Spouse is on H4, and has H4 EAD approved. But H4 EAD has never been used. - principal H1b is not interested in AP parole at all. Getting Stamping done is not an issue. Does it make sense to downgrade from Eb2 to EB3 Now with filing action date up to 2015 in oct. 2020 bulletin? Getting EAD early is goal, can wait longer for GC if EB3 retrogresses more than Eb2, it’s ok. Thanks. Please Share your views.

    Doesnt it cause problems at the time of filing I485? I have my EB2 I40 approved from employer A and have concurrent fulltime approved with employer B. At the time of I485, i have to submit all of my documents to employer A’s attorney. That would reveal about my concurrent job and thus by loosing employment. My priority date is around the corner.

    Is a H1B concurrent still subject to the cap? i.e Do you still have to file at the beginning of the year and wait till August, or can it be filed at any time of the year? Will that concurrent H1 count towards that annual cap, or will it utilize the existing H1 as a transfer would?

    Can an H1b visa holder earn from CZcams channel? What I mean is this CZcams job would not be mentioned in LCA; is that possible?

      That is really tricky the problem is when you leave the country and come back CBP does not have the provision of giving I-94 for two companies. So you have to chose the main company and get the H-1B stamped to come back and then file a concurrent H-1B again.

    You mentioned about concurrent Visa but what if Employer B filed H1b transfer (not selected concurrent option) then can I work for A & B both?
    More scenario clarification:
    If I am working for employer A on H1b from 1 year and I got offer from Employer B and they did H1b transfer and it got approved but I haven’t told Employer A regarding that. Now in that case can I continue working with A and start working with B and work for both companies as full time with approved H1b (not concurrent)?
    If the answer is No then how much time I have to work with both and what’s the deadline to give final notice to Employer A? (Like can work for both for a month but after month I need to say No to one)

    One question about the H1B transfer, my current employer will terminate the employment in Dec 2020 due to the COVID-19, I am at Non-Working Period but continuously paid until the termination date (Dec 2020), if a new employer files an H1B transfer petition and got approval in Nov, can I start work for the new employer before the termination date with my current employer?

      I have question last year end 2019 my H1B lottery selected and due to Covid-19 stamping not happen. So my H1B expiry on March 21.
      1) If possible to increase the time duration of the H1B ?

    I have one question
    After getting concurrent approval from employer B, while at the time of Employer A H1B extension do we have to share employer B approval copy in the Employer A extension. Or vice -versa .

    Excellent piece of information and thank you Rahul and Emily for the clarity on this topic. I got this doubt if possible could you please clarify me the following:
    1. Candidate is working for Employer A aka Primary (non-profit org full-time job) and he gets/finds a new job with Employer B Secondary(for-profit org full-time job) and it sounds like according to your video the validity of the VISA is upon the expiry of Employer A's. Please correct me if I am wrong.
    2. Say after 2/3 years If the candidate switch the primary employment to a different non-profit org aka Employer C what are the steps to be taken to notify the Employer B

    Hi, I am on H1B visa and I was working for employer A till dec 31st 2019 and moved to employer B from Jan1st on receipt notice. My transfer got rejected so I came to India and my employer B again filed the transfer in premium in Feb 2020 and it got approved. Can I now go for stamping. Also I have couple of pay checks from employer B when I was in USA for a month after changing the employer.

      Why do you think you can't go?
      You are perfectly fine to go for stamping, make sure you have correct documentation to prove you are having a job and all the paper work to show.
