2011ൽ നടന്ന Ms. സൗമ്യ കൊലക്കേസും (Ms. സൗമ്യയെ ട്രെയിനിൽ നിന്ന് തള്ളിയിട്ട് കൊന്ന ദുഖകരമായ സംഭവം, പ്രതി - Mr. ഗോവിന്ദച്ചാമി) 2016ൽ നടന്ന Ms. ജിഷ കെ പി കൊലക്കേസും (പ്രതി - Mr. അമീറുൽ ഇസ്‌ലാം) തമ്മിൽ താഴെപറയുന്ന സാമ്യങ്ങൾ എനിക്ക് തോന്നി.
(1) Ms. Soumya worked in a mall in Ernakulam district. Ms. Jisha KP lived in Ernakulam district. So, both Ms. Soumya and Ms. Jisha KP were present in Ernakulam district for sometime.
(2) Both Ms. Soumya and Ms. Jisha K P were murdered by strangers. Murderer of Ms. Soumya, that is Mr. Govindachami, was a stranger to Ms. Soumya. Murderer of Ms. Jisha K P, that is Mr. Ameer-ul-Islam, was a stranger to Ms. Jisha KP.
(3) In both cases, victims (Ms. Soumya and Ms. Jisha KP) were not rich.
(4) Both murder cases took place in Kerala and the murdered woman in both cases were Keralites. But, in both cases the convicted murderers, were non-Keralalites. The convicted murderers in both cases hailed from Indian states outside Kerala. In Ms. Soumya murder case, the convict murderer Mr. Govindachami's mother tongue was Tamil. He was born and brought up outside Kerala. In Ms. Jisha KP murder case, the convicted murderer Mr. Ameer-ul-Islam hailed from Assam.
(5) In both cases, the convicted murderers were not rich. The convicted murderer in Ms. Soumya murder case, Mr. Govindachami was not rich. Mr. Govindachami was known as a beggar. The convicted murderer in Ms. Jisha KP murder case, Mr. Ameer-ul-Islam was poor. Adv. Biju Antony Aloor appeared in the court as defense council for accused in both Ms. Soumya murder case and Ms. Jisha K P murder case.

The unlimited number of anticipatory bail applications that an accused can file, throughout the legal proceedings, is the biggest loophole for the accused to be free from conviction and gives indirect licence to do the crime again even if the public interest is against it.
The only solution is to restrict the number of anticipatory bail application filing to just 1 to any other accused and no right of anticipatory bail application filing for accused who has done heinous crime.
Parallely ammendment should be made under article 21 (if I am not wrong) ( right to personal life and liberty) of the constitution of india. Wherein accused of heinous crime is an exception to article 21 of the constitution.
Let the central and state governments come with that ammendment soon.
Let's see what's the scope of these defence lawyers after this ammendment .

The accused must be given an opportunity to defend him. Otherwise, no need to have the Judiciary. Police can make allegation, arrest, and convict.
Is it better system?
How many case can a court take up a day for trial.(starting from 11am), 5 or 6 at the maximum. Posting double the number can be taken as normal. But it is seen that 4 to 5 ( 25 to 30 cases) times are some times posted. All the parties associated with those cases have to be present. They have to pay the advocate for appearing on that date. It appears that considering that no limit is there for charging fee and the delay in delivering justice extending for decades , justice for the people takes a back seat. This happens because everything regarding the justice delivery mechanism is decided by advocates and institutions controlled and represented by them only. Since the inefficiencies, delays etc of the system affects the people especially the poor and underprivileged sections directly, people of integrity from sections of the society other than advocate fraternity should also be represented in the decision making bodies of justice delivery mechanism for ensuring accountability towards people.
