      In civil court it’s called preponderance of evidence 👩‍⚖️ but in criminal court it is called beyond a reasonable doubt. I think the plaintiff bringing in those pictures was enough evidence to prove it probably was not her car. Smart move on her part.

    I think she should've dismissed the case without prejudice. That way, they could go back to a different court , get more evidence, and sue either the defendants, or the other person that it could've been.

      A case would not be dismissed without prejudice for that reason simply to prevent harassment through repeated lawsuits. The judicial system aims to ensure that individuals are not subjected to repeated litigation for the same issue. For example If the state accuses someone of a crime and fails to provide sufficient evidence, the judge would dismiss the case, allowing the state to keep suing the person till they get lucky or the my h but not with the intention of allowing for repeated suits.
      Judges primarily dismiss cases without prejudice due to procedural errors. These errors could include filing the case in the wrong court, mistakes in paperwork, or situations where both parties wish to resolve the matter outside of court.
      Cases are not usually dismissed for lack of evidence; instead, judges often grant a specific time frame, such as two weeks, for the parties to gather and present the necessary evidence, like phone records.

    He saw the car pull off so He knows which direction it was facing. He also followed the car so he knows which way the car was facing because he was driving in the same direction. What does she mean he doesnt know what direction? He saw the damn car pull off.

      Yeah, I was a bit confused by that part as well. I thought an eyewitness to the car pulling off, would've helped the case, but I guess not.🙅‍♀️🙅‍♀️🙅‍♀️

      ​@calvthomas6153 the eye witness only supports the plaintiff side and also has something to gain. Had a police report stated the same thing the judge would have an on the day recollection of what happened and not something made up later for court

      @@gladitordragon - That's how it usually works doesn't it? A subpoena'd witness will usually support one side or the other. It's whether or not their testimony helps to sway (more likely than not), the judge's decision. In this situation i think what won the case, was the testimony from the defendant regarding the other vehicle. I did think that the testimony from the witness would've rebutted that but it didn't. Oh well...🤷‍♀️🤷‍♀️🤷‍♀️.

      @calvthomas6153 not in every case. When I was hit by a care, my witness was a random person who had no connection to me. It was more believable.
      The witness in this case, is basically part of the case. It's hard to believe him and they didn't have police report to support the first sighting.

      She said she couldn’t remember at the time that the detective came to speak to her about the accident but she remembers now.

      @@PennRynnAgain, she was saying that when the detective all of a sudden showed up at her door, she couldn’t remember at that time when the accident (involving a different vehicle) occurred. Since then, obviously in time for the court case she was able to remember. Whether it was through report records etc.

      I think that either she or someone else was holding the pictures up to the camera at some other time. Could have been before, during, or after the taping. Or it could have been her reviewing the pictures at a different time. Because when they show a close up of the picture, one is on top and the other on the bottom. Then we they pan back out, she’s all of a sudden holding the pics side by side. If that makes sense.

    2 red Impalas in the same area and BOTH with front end damage…that’s one hell of a coincidence but I believe the defendant. I don’t believe her car hit the plaintiffs and even if it did, the fact that there were no witnesses to witness the accent is reason enough to dismiss the whole case until definitive proof can be established. This case was just wild.

      @@toyacrowder510 I’m not sure what state you’re in, but most insurance companies require a police report to cover hit and run accidents. She did the right thing by notifying the police and allowing them to investigate. They CONFIRMED the defendant hit her car. Judge Milian is going by pictures and assumptions, I’d trust the word of the cops before anyone else.

    I must disagree with the judge this time they saw the accident. They see the car every day. The judge is only looking at pictures. She has not seen the car. She can’t tell from pictures.

      There were two identical cars. Both red impalas with damage. One had damage on driver’s side. The other on the passenger side.

As such, the damage is on the side corresponding to the direction it was going so there can only be one of the two cars that fits that.

    There’s no way that new car did that damage. There’s no blue paint on it and there’s no way the giant dent in that fender was caused by sideswiping a truck. I’ve been in auto body for almost a decade. There’s no way and JM should have known that.

    Having a car is the worst necessity! Shit goes down in value, anyone could get away with damaging it, scammers constantly selling them, taxes, insurance, maintenance, expensive asf!
    And yet…we NEED cars for traveling and commuting. There needs to be a better way!

    I dont think the plaintiff cared who did it, the defendant or the car the defendant snapped, she just wants her car payed for. I wouldnt want ro pin it on the wrong person either, but the plaintiff needs to go back to the police because they did a half assed job as well as the accident dude, they just wanted another case closed whether it was her or not. Pretty bad really.

    Judge M should stop asking litigants why 3rd parties said or did something, or didn't say or do something. How is the litigant supposed to know why the Officer completed the accident investigation in that manner?
    But I agree with the verdict - no definite evidence to support that it was the defendant's car.

      I agree. While the question to ask why the report was made that was is valid, the plaintiffs have no control over how the police conduct their investigation.

    I wished there was a way to cross examine the driver of the other car. Unfortunately, this was not a criminal case. The good thing is that with the introduction of the 2nd car, maybe there can be some more detective work.

    The judge did ask the defendant enough questions like where is her police report for the “her accident “ that coincidentally happen month ago and why would the person SHE hit give them a fake number wouldn’t they want there vehicle to be fix like I would understand if the other person hit them and ran off with a fake # but she said she hit them and her damage is to the front of her car
    The plantif constantly said he seen the vehicle flee the scene so ofc he would know what direction the car was coming from even the police said it you can’t tell by just photos nowadays
    This case shouldn’t have been ruled the way it was and should’ve called a recess and allow the plantiff to get police report as well as allow the defendant to show her police report in which she coincidentally hit another vehicle and not the plantiffs

    My daughter parked opposite a driveway . The car up the drive had her paint on the bumper .
    Cop said no witness

    The reason why the Plaintiff is bringing this to court is because she either doesn't have insurance or her claim was denied by her insurance company because of the weather conditions. She was probably denied because she didn't take due care of her vehicle due to the conditions. (Acts of God) So she needs to find the perpetrator to pay for damages. The Defendant definitely had a plot twist no one saw coming with pics of the same make and model car with matching damages. I was hoping JM was going to ask for insurance claim documentation to see when claims were submitted. Not to mention, that was lazy police work. Shame!

    So as a claims adjuster the same thing happened so it isn’t odd that she doesn’t have a police report especially those states that do not come for minor accidents. I proved it was prior damages by calling progressive who handles the claim and they sent pictures to me.

    Wow, now the judge has more expertise then the actual accident investigators!! Always talks about people bringing an expert or having the right evidence these two do exactly that and her butt goes nope I don't think the investigator was right! Oh my!

      Except they didn't actually investigate anything since to do an crash investigation, they have to compare the cars side by side. A cars bumber height changes between make and model so even if they have visible damage, the actual dent could be an inch higher or lower than where it'd be. All they did was say "That car has damage. Good enough". If the officer mentioned the impala had blue paint flecks in it, or a diagram, or anything, then it'd be great but it's literally just "We visually looked at the car in question, there was damage, she's guilty".
