In this video, I'm joined by @JessTheMD to go over the alleged injuries in New York v. Jonathan Majors, and what resulted from this conversation was an opinion that the defense strategy was flawed, to say the least.
FOR CONTEXT:
New York prosecutors allege that on March 24, 2023, actor Jonathan Majors physically assaulted his then-girlfriend, Grace Jabbari in the back seat of a hired driver's car before throwing her back into the car after she tried to get out. Jabbari says that as a result of this altercation, she suffered a fractured right middle finger, a cut to her right ear, and bruising to her head. Majors, on the other hand, disputes the characterization of the altercation: he says she attacked him, and that he suffered scratches on his face and body as a result, and that he threw her into the car so he could get away from her before she tried chasing him down on the streets of New York.

I hope one day they offer this product in Australia.
. ive been watching and keeping up with this case since it started.
I just wanted to assess that in regards to the ear injury we kept referring back to the incident in the SUV. But we havent went to other footage where she is seen hitting her head on the DJ booth.
Which brings me to believe based off the medical experts assertion, an injury that can occur from a "blow from behind", gives me more reasonable doubt that this could've been caused by any measures taken by the accused.
As somebody who has had an ear injury on a ride at the fair where I had cut my ear in a slightly similar way, I noticed right away, swelling and discomfort as well as bleeding.
As well as when you introduce sweat into the situation you'd experience more discomfort from a sharp burning sensation on the point of injury.
So could it be possible that she acquired this injury from the DJ booth?
@legalbytesmedia I have been watching your coverage since the Johnny Depp defamation trial very disappointed in your analysis. Reasonable doubt was in abundance in this criminal case!
@@ernestclayboniii656 I totally agree. I was very disappointed in the assersion that it had to have all occurred in the car
@@leneildavis8733It does not go with the video evidence of everything else that happened that night. The “ice” cube from the champagne bucket sounds like B S. She was seen on video using her hand with full dexterity with no issues. The same can be said for her ear. Is there video evidence of this ice Grace never mentioned it at all! Legal bytes is CAPING Hard for Grace! Why is that?
I just cant get over them completely ignoring the ONLY other person present during the incident, the driver. He Said she did everything and then he runs away from her. Wild!
They said the driver was biased and on JM's side.
@@genzo_-sensei5719 If by they you are referring to the state you are correct but the driver was the states witness.
The state are the ones who called the witness... smh.

@jibril2473 I t was not the girl it was the police who lied and said he strangled her. It was D A Bragg that wanted to push a narrative instead of justice!
There are just too many doubts to find him guilty again, "Beyond any reasonable doubt"
The problem is when you look at the injuries and compare them to what they prosecutors and grace said he did it doesn’t make sense . So now a bunch of people are tryna make sense of a story that never made sense to begin with
Exactly
How is she passed out in. Closet when you re texting people 🤔
Thank you!!🙏🏽
I m an MD too and shocked he was convicted she would known about the ear lac pretty quickly - it obvious that didn’t happen in the car and no one notice the injury on her to continue out clubbing
Thank you Docter, this is the hardest fact to convince people of.
Thanks Doc! She was around people all night hugging people dancing with people and they would have noticed. Not to mention she would have noticed as much as she was dealing with the back of her hair as seen on video! She was not bleeding on any of the servalance footage after the club. There is plenty of reasonable doubt regarding her injuries.
I've cut my neck or nicked my ear shaving and I've been asked about it by a bouncer and/or not let into a club. They are pretty observant, also friends are quick to take the piss out of me, as I am to them. You notice.
@@RogerS1978 exactly, the blood was so bad it matted her hair...no one noticed 😏
Something is odd about this case. “The math ain’t’ mathin’!”
JM is innocent.
All this showed me was he did not intentionally harm her and her actions contributed to her injuries.
Crazy how someone can get charged for harassment for trying to get away from someone attacking them 😮
The main issue is why was there a criminal trial when there was no evidence of intentional misconduct other than publicity and big trial involving a celebrity
DA needed the publicity
@@daveanthoney3982 Facts
I’m really surprised any conviction happened just on reasonable doubt, I really wish there were cameras to see how well the lawyers performed
That's why there were no cameras
@@bartell20jAbsolutely the cameras were there at first with the first Judge. The next Judge refused cameras and put a gag order on the attorneys.
I agree, based on what we know I’m surprised he was convicted, but considering we could be missing quite a bit of important information, at this point I feel that we have to just trust the jury, as they saw things and heard things we didn’t.
@@keirstenduren7188 No reasonable doubt is the standard and the state did not reach this requirement.
Reasonable doubt is the standard, but it’s the lawyers job to make that reasoning clear. From what I’ve heard his lawyers made doubt seem UN-reasonable.
The fact that there is no blood in the car, nor in her clothes nor even visible blood pouring down her neck with that big ass gash makes me question if it really happened in the car.
I think post trial there been too much spotlight on “poor defends strategy” and no attention on the actual facts and evidence. There’s too much focus on winning trials instead of presenting evidence, we all heard the driver testifying that grace did ecerything and she was the aggressor, we all saw majors try to de-escalate and remove himself from the equation. We all saw her chasing him, and yet he gets convicted of reckless assault, because he was too aggressive in trying to get away from her. Roles reversed Grace would’ve been applauded for her bravery in getting away. There’s no conclusive evidence that shows majors hurt her finger or caused the ear laceration. There’s so much reasonable doubt and not enough proof in order to convict him of anything.
yeah. his defense made more than a few mistakes, but at the end of the day the prosecution just did not prove their case beyond a reasonable doubt. it's clear members of the jury were biased.
czcams.com/video/PR_wCeYi-i8/video.html
You are correct. All the attention is focused on the defense strategy. There was enough not to convict him of anything. Not enough attention was focused on her behavior. We know this had to do with gender & race.
If I'm fighting for my life, I want a shark for a defense lawyer. I can't depend on the evidence, the cops, or on the intelligence of the jury. Trials are not won on what you can prove, they're won on what the jury believes. His lawyers needed to present a story that poked holes in the presecutions story and witnesses, while painting a better, more believeable one of JM. In her closing argument, his lawyer needed to go over every prosecution witness and recap every hole in the witness testimonies for the jury like they're in kindergarten, and remind them that if they see any room for doubt, he gets off. They didn't take the time to be that thorough, so they failed him. Johnny Depp's lawyer was a rockstar. She went through every piece of testimony, every piece of evidence and poked holes in it all for that jury in her closing. She made AH lawyers look inept. JM should've hired her.
So, to me, if the doctor has doubt, then there is reasonable doubt
Yes but your justice system is bs
The Dr in the trial said that her injuries didn’t match injuries consistent with how she described them.
Clearly the ear injury didn't happen before the 5 block chase . The surveillance videos proves that.
Absolutely she is fixing her hair right after she chased Majors and started following him again. Why is Zollers testimony so compelling to Legal Bytes when the drivers police officers and everyone else’s not?
I have a high pain tolerance. In middle school, I broke a bone in my foot (Calcaneus chipped internal toward the center of my ankle) and it did not bother me until I was in a basketball tournament and was running a lot. After a coach screamed at me for running to slow I got it checked out. The complete look of shook on the x-ray tech's face and the slow glances from me to the x-ray are burned into my memory. Apparently, it was broken for about a month, no swelling, no bruising, and "low" pain.
On the other hand, in high school, I broke my pinky... that one I knew immediately something was wrong. I told my basketball coach, who taped my finger, and (assuming it was just dislocated) squished it to "pop it back in". I burst into tears immediately. I would imagine it would be similar to a hair-tie squishing your finger into your hair and would have expected at least a wince. Got an ex-ray, and it was definitely broken.
Yeah I got a fracture on my pinky toe and could hardly walk for 2 months. 3 with shoes on.
And fingers are much more sensitive than the feet.
49:39 But how does that add up to beyond a reasonable doubt? That sounds like a "more likely than not" argument, which simply ISN'T supposed to be the standard that we're working with here.
4:59 there were TWO board certified ER physicians as both prosecution and defense witnesses, who COMPLETELY contradicted Jabbari. So there’s that!
Her OWN treating physician said it was BS - despite trying his hardest to please the State - he fell apart on cross.
@DaniDoesThisAndThat there was more than enough reasonable doubt! Do you think that the police will release the body camera audio now that the case is over?
Thank you. It's crazy the way people are trying to blame the defense for this absurd farce.
@@ernestclayboniii656 I’m honestly surprised the audio and videos haven’t been released yet under public records.
@@DaniDoesThisAndThatWe had the audio for other New York cases that were far more serious.
How would there be a cut like that from the car and there’s no blood whatsoever seen from anyone . Not even grace noticed any blood the whole night she was out ?
Also the prosecution said the laceration came from him slapping her but imo neither that or the leather seat theory make sense
There's been a lot of talk about his team letting him down but how much of a defense is decided by the defendant? Is it possible they gave him better options but that he was worried about any admission of becoming physical at all would be taken poorly?
I would Imagine that’s why Major’s lawyer made the statements she named about the case and victims. I know defense attorneys are suppose to, well, defend their clients but I wonder how many of them told their clients that both of them need to shut up in front of cameras.
anyone with half a brain knows it would've been taken poorly. a man admitting he injured a woman, even if accidentally, is a guilty man. that's why this case is so important. people are biased when it comes to male/female physical disputes.
The club footage alone was enough to prove it didn’t happen at the car. The timing of bruising after fracture and phalange trauma would have been evident that night. Especially when drinking is involved.
@nomotiin2005 Facts she would have been bleeding a lot with all the alcohol!
Dude is on video doing the New York Marathon to get away from her. The video of her at the club using her hands for her phone, hair, etc. I mean..this is crazy
A very informative video, thank you 😊
Legalbytes out here putting in the work my goodness
48:45 Wrong. All that blood behind the ear and no one noticed in the club?
My Theory is that it happened while she was grabbing and trying to hang onto him while he was yanking himself away from her right before breaking free to run once out of the car. His coat was ripped and buttons torn off. In my opinion for his coat to be ripped she must have been holding on pretty tight while he was yanking away.
While It did upset me, I cannot deny that ad transition was the smoothest I've ever seen
If her ear got injured in the car, there would have been blood all over immediately. Also if he punched her in the several times and fractured her finger, she wouldn't have been able to chase him and go clubbing
The laceration doesn’t look deep so I doubt there was much blood.
@@SEAZNDragon That's not what the state's doctor said.
Google it...the police body cam found blood on the comforter as well as vomit, and the cop was asked about collecting evidence when he was on the stand
This explanation explains why Majors is innocent
But there was a clear photo of her hand that night from them taking pictures as well as testimony of her walking into a wall as well as her hitting her head on the Dj booth in the video.
Great breakdown on the injuries. I’m not sure what the defense actually said about the car situation, it looks like she is holding onto him as he was trying to leave the SUV. What do you think?
I think she may have gotten hurt from him trying to break her hold on him. She is probably not strong enough to keep him in the car, but she probably has the grip strength to hold him tightly as he tries to leave the SUV.
In addition, I believe the defense attorney said he was trying to put her in the SUV, but it doesn’t seem like that was the only action he was trying to take in that moment because it doesn’t seem like the best way for him to do it. If that really was the only goal, then it seems like it would have been easier for him to pull her into the SUV rather than put her in it. What do you think?
Just another reason why I’m disappointed about the outcome of this trial.
Loved this breakdown and deeper dive! SO much to think about and how JM team dropped the ball. I am concerned if he is appealing and keeping the same defense team.
Can it be possible for him to appeal and get a retrial?
I heard he's appealing
Yes but the news will not report it
@@bartell20jThat’s the sad part about classical trained Yale educated talented actor won’t be able to use his talents. This case is sad his appeal even if successful will not be reported on with the same zeal or intensity.
@@ernestclayboniii656 it doesn't matter as long as disney re-hire him to play kang. I still have hope
@@othmanehaldaoui Hopefully the audio of the Bodycam a release of Graces full text and an appeal vindication will lead to that.
im still thinking she was so drunk she either fell on her hand and broke that finger that way (or something similar) and tried to put that on Majors just to get at him.
She was drunk by her own admission and on top of that took sleeping pills by her own admission. She could have easily hurt herself at home being drunk and talking sleeping pills. Crazy legal bytes didn’t address this whatsoever!!!!! She was found naked from the waist down wearing a sweatshirt with her underwear and matching sweat pants bundled up next to her in the closet. She could have hurt herself taking her pants off and tripping in the process. Why did legal bytes not do a longer analysis on this ?????????? What is the reason???? Is it unreasonable to think a person that is extremely drunk extremely high that has been attacked someone, clubbing and dancing, taking pills could fall at home? She said she went to sleep on the bathroom floor??? How did she end up in the closet anyway????? PLENTY OF REASONABLE DOUBT!
Anytime I discussed this case or commented on other videos covering it, I always said his biggest mistake was hiring the wrong lawyer/legal team...and it was very clear straight from the start of the trial. His layer kept on trying to keep the case in the public eye which was stupid. She kept making bombastic statements and promises that she never lived up to. she also kept trying to litigate the case in social media...none of these things made any sort of sense. I also don't understand why this wasn't handled using any one of a slew of pretrial mitigations that thousands of people get daily...this was just one giant shitshow his legal team enacted.
THIS!!!! I fully agree. Her biggest mistake was to go to the MEDIA...and making promises. It's a rookie move. Like make one statement and focus on the case at hand.
@@WonderWoman780 Yeah, how many times did that idiot lawyer tell the media "I have irrefutable evidence that will 100% exonerate my client"?? Like just the sheer stupidity for a licensed attorney to make such statements is bewildering. I knew he would lose his career the moment that attorney started opening her mouth to the media.
I fully agree with you. She should have had a simple statement of "My client is innocent, and we will prove this in court". Full stop and focus on their defense strategy behind the scenes and leave the public out of it. If I were his lawyer, I would have shared evidence through Insider as soon as that Rolling Stone's article came out to combat this narrative. Priya was cocky and sloppy in handling this man's career and case. @@GSP-76
She definitely didn't do him any favors with the 7 hour cross examination wherein the girl starts crying multiple times and she probably came off as the bully instead of being precise to the point and asking questions that would have left an impression on the jury.
Still going through this, but i really think his team messed up by going with the racism angle. Not saying its not possible for the cops or the legal system as a whole to have bias, but there was less direct evidence of that. For example the cops could have been more focused on the fact the majors was a man and in DV cases the partner is usually going to be considered a suspect. Given the evidence the officers had i think it would make sense to investigate Majors as it's possible he could of been lying. Obviously once they looked into it i would hope they would conclude there wasn't enough evidence to conclude he's guilty...
Although im aware of the comment one officer made about how Majors could afford the home which to be fair NY is expensive and Majors happened to be rich. So again , not "impossible" for there to be racism at play but not 100% certain enough to make it a key part of the argument.
So ignoring race in a racist criminal justice system is the way to deal with bias.
Fully agree with your conclusion. The Jury based on the arguments given were reasonable in their conclusion but there were still questions remaining for me to definitely conclude Majors caused the injury. Another thing that was not argued that im curious about is if its ok for reasonable force to be used to get your phone back.
No, bringing it up when you don't have enough evidence is a way to make a jury skeptical of your argument and potentially introduce unnecessary doubt is what im saying. @@rickmanigault6447
The audio from the police body camera was not heard by the jury. It included the comments about a black man affording the apartment and the police coaching Grace to say Majors Choked her after she said she didn’t know what happened over 19 times. The police were not even there for a domestic violence call. The Domestic Violence Prevention Offer who testified in court said he didn’t see where an arrest was necessary. The Sgt. That was seen making choking gestures on video who asked Grace what happened and wrote half of Graces victim statement made the bogus arrest.
@KevaughnFrancis there was definitely evidence but the judge would not allow the jury to hear the audio on the bodycam footage where they basically question how someone like JM could afford a place like that amongst other things. People really want to put all the blame on his team but if you really knew all the details JM was in a lose lose situation no matter what angle his team chose to go. Race played a huge factor in this case whether people want to acknowledge it or not.
This is terrible. The MDs take on the finger was “okay” she is wrong in where blood would pool. It would not prefer the joint region over the soft tissue areas in the shaft of the phalanxes. If I were to guess that discoloration is a reaction from trauma to the joints with or without intrarticular fractures. In this video they completely ignore the fact that she was hitting him which could explain a fracture from an impact and why her joints look that way.
The ear laceration is not possibly a shear injury 1.) they are usually not that clean of a cut. 2.) the head is a very well vascularized region of the body, a cut like that would have been bleeding like crazy and would not go unnoticed. I am very surprised she said that the ear lobe wouldn’t become red after suffering a laceration… especially if they are handling it in any manner or if she slept on that ear.
There is zero evidence that he caused her any injury. My guess with what I know of the evidence is she got blackout drunk fell and hit her right side against object(s). Hit her hand against something and cut her ear on a ledge (only times I have seen these kinds of injuries).
Something went very wrong in this case. DA delaying requests from the defense, to dropping her charges so she can come back to the country to testify against him. No evidence he hurt her. Completely not even bringing up that he has a right to defend himself and his property like what is going on? This case should have been a slam dunk for the defense, what happened?!
TBH this case screams reasonable doubt. Example, Did anyone mention how much she was pushing her hair behind her ear with her hand when she was talking to the people outside the building? She doesn't indicate finger or ear being in pain !! She was more focused on the text message!!!
Her finger fracture is interesting. For a spinal fracture, if her finger got twisted around, wouldn't a joint dislocate before the bone breaking? And for a crush fracture, if he grabbed her hand so hard, wouldn't there be at least some kind of injury on the other fingers?
I’ve been watching JessTheMD’s channel for a while and, just like her appearance here, she’s always great at explaining medical issues with clarity. Her Scrubs videos are great.
I have been hit, blunt force, on the side of my head, and it caused a weird laceration behind my ear. I always thought it was strange, it looked like a clean cut, but I always assumed it was from the force against my ear crushing that cartilage behind my ear and causing it to split. So I definitely think it’s possible.
Was there blood ?
The system let him down
How is he convicted of a misdemeanour but she ain’t
That’s USA law or New York State law
I was diagnosed with cancer over 10 years ago. Jess was cleared but my doctor told me that treating my pain was the hardest thing in the world. Because I have the high pain tolerance and not much Makes me ever think wow? I should go to a hospital. I'm like I can stiched that at myself. I got this.
I've never seen a person who bleeds internally, but doesn't bleed externally.
Is it possible to have injured the finger while grabbing his coat. There was enough force to rip the pocket and rip the buttons off.
@juanitahayes9471 I don’t think so. She would have shown a reaction on all of that video footage of her putting up her hair, signing checks, using credit cards, dancing with her right hand held. Most likely she hurt her hand after she chased and attacked Majors.
This should have never went to trial. That’s the biggest issue. Also, even if the defense wasn’t perfect there was enough reasonable doubt not to convict.
I don't know why s many people are hellbent to blame his defense when there were so many bad actors from Jabbari, to the cops, to the DA, to the press, and even the judge who just wanted to get this man. I guess it's easier to condemn his defense than the system itself.
Exactly. Racism and unfair treatment of men who are victims of domestic violence are all in this Johnathan Majors case.
Glad my thoughts were basically correct. I continue to think the finger injury happened when drunk back at the penthouse, the ear lac would make sense in the car but there was no blood witnessed by anyone, there was no blood visible on her hair at the club. She would have felt it right away, thats the biggest issue i have with her claims, these injuries aren't a feel it later kind of injury, these are "FUCKING CHRIST THAT HURT" injuries. And even if she did somehow have them from the car incident, there is no feasible way she could bend her finger let alone dance with it.
Major's team threw the case and its pretty depressing. There is no way it holds up on appeal if they get a better team, unfortunately the damage is done and his career is cooked.
I hope he can recover his career in some way. I definitely don’t think he hurt her. This case had too much reasonable doubt to get a guilty verdict.
@@ernestclayboniii656 if he did it was clear he didn't mean to. All he wanted to do was get away from her. He had injuries too, ones that definitely did come from a person.
He landed the role of a lifetime as the next big villain in the coming MCU phase. He had a ton of marvel movies and shows coming his way, he can never recover that.
The defense kinda fucked him.
@@youtubeSuckssNowthe defense fu&ed up no doubt. But he didn’t hurt her and there is no doubt if he wanted to hurt her he could. The reasonable doubt that her didn’t hurt her is overwhelming. All you need is a shadow of a doubt. He had an abundance of doubt!
@@youtubeSuckssNowShe was even arrested for attacking him. He had video and photographic evidence also. This case is ridiculous.
Only thing that can help him is when he brings jabbari into a trail and the. DA which he will do in civil court. Jabbari and the DA being liable .. will make make a world of a difference. Hope he stays strong with clearing his name!
Could his defense team have arranged a plea deal to avoid the court case/publicity altogether? Can you research if this was legally viable option? Thank you and again, great video!!
I think Zoller is lying. I think she was coached by the prosecution to tie up loose ends in a very weak case. No way she asked for ice and moved her finger that freely the entire night. It doesn’t add up
It was very strange that the jury asked for the transcripts of Zollers testimony during deliberations. Grace never mentioned anything about ice at all. No one else said anything about ice and she was doing stuff with her hand all night at the club.
So... The ear injury might jave happened by being pushed backwards with leather seats. Thats not worth any prosecution. Its like argueing someone was pushed back with sandpaper on the wall as opposed to oiled rubber. Either they should be convicted for pushing or they are not. MAYBE you can find it wreckless... MAYBE.
And the finger injury, how in the hell do you break the top half of a finger? It has to have been grasping something. The only other option is crushing but that seems more insane considering when the injury is said to have occurred. If we assume he twisted the finger, then it would have been from prying a finger off of something. And again... If it's prying fingers from your own propery then you shouldn't face any prosecution .. ever. (Note... Pulling the finger backwards beyond its ability move doesn't fit my definition of 'prying'. That would be purposely breaking a finger... And it still seems strange that it was at the top half of the finger and not near the knuckle connecting the finger to the hand.
Where is the abuse in this case?
If it happened at the SUV where was the blood anywhere else? On her shirt? At the club? On her skin? Where is the blood from her ear?
Exactly, if you sustain a laceration of that size behind your ear you would be bleeding all down your neck and on to your shirt. She was wearing a white shirt that should have been covered with blood if we were to belive her story.
Could it be the GF was using painkillers like Oxy or fenatnyl - either recreationally before she went into the car, or after she was in the club without anyone noticing?
I once had the shingles on one side of my face, and it was incredibly painful. But one ibuprophen (the highest strength) was able to make me pain free to an extend that I could lie on the side of the face with the shingles - until it wore off. And opioids are more potent than that and a lot of people in the US take them recreationally.
Objection! This video is based on hearsay. 😉
Really enjoyed your insight on this case.
I think the biggest misstep the defense lawyers was not giving the jurors who believed that Jonathon Majors is innocent something more concrete to hang on their non guilty verdict. I believe the defense should have stated Majors' right to immediately take back property that was snatched from him with reasonable force. This may also be a little tricky but the sell would have been no one has a right to snatch another person's property without permission and there is a NY law that states this.
Also people can injure themselves while attacking someone else
He was charged for the finger not the ear so technically this whole last portion is pointless
My question on the ear is if the incident happened at the car how is there no trace of blood or mention of it at any given time despite all of her activity up until she goes back to the apartment
She lied to the cops
More than once
But I forgot we in a society where women are not held accountable for anything lying defamation etc
especially white women

I know pain is relative and alcohol mixed with adrenaline can prevent you from really feeling something at the time, but I keep thinking of the video where she pulls here hair up easily with a hair tie. In one motion. She doesn’t flinch. I’ve hurt my fingers and I could never do that. I wonder if she exacerbated injuries she sustained at the SUV.
I also wonder how common it is for people who attack others to sustain injuries. We saw with the Depp Heard case that she really believed she was injured at times she was likely attacking him. The supposed “head butt” etc… I think Jabari was the angry one. She was the aggressor. He ran from her. Why would he called 911 on himself? I also think she drinks a lot. That alone doesn’t matter but I think it may have escalated things. She had a right to be hurt and mad but she went out and drank more w strangers w a bloody ear and a fractured finger then after a night of drinking took sleeping pills on a bathroom floor and slept there. She sounds a little troubled and like she put herself in dangerous situations that night. Fighting a v strong man accosting him repeatedly then drinking w strangers then sleeping pills locked in a bathroom.
I think she’ll do things like this with other people in the future. I think she’s a dramatic troubled drinker.
Yehhhh adrenaline doesn’t last long
10:43 ur a lawyer u kno words matter. He tried to grab “his phone”. Saying “The Phone” makes the phone seem neutral.
But there was no blood on his or her clothes or in the car
@Dannosuke25 Bingo
He also had bruises on his face and arm , where are those pictures ? 👀
The jury was not allowed to see them.
Great breakdown. Thanks for this.
I think the only thing the jury used was the video showing him shoving at her in the car doorway. I think that was the only real benchmark, bc it showed an actual physical altercation between them in which those two injuries could have happened. I think the defense should have recognized their whole job centered around pointing loudly at all the reasons the two injuries could NOT have happened in that moment. Because, without that particular recording, I think the jury would have been perfectly capable of seeing there's no reliable evidence that he did this to her as accused and would have acquitted him altogether.
Just like Murdaugh - everything else, all the rest of the evidence and testimony was almost irrelevant compared to that one recording that showed he was there when all that time he had said he wasn't. The jury members who gave interviews even said that recording was the whole thing for them. I have a feeling that was exactly the case here, but, unlike Murdaugh, Majors actually had a decent platform to defend that his actions either did not cause those injuries or could not have been proven / likely to have caused them - but this defense squandered that platform.
Mr.Majors should hire Ms. jess for his
appeal and fire his old attorneys.
It’s possible but too much reasonable doubt. Regardless, she took his property, he had the right to use force to retrieve it, this her injuries are her fault…
I'm left with the question that if the ear was injured in the vehicle, was there blood? Yes, the timing of the discovery makes it look like Majors is at fault. I can only think of one way that an ear would be sheared on the seat of a car. But unfortunately life isn't limited by my imagination. Lots of things can happen in many different ways...
The driver said there was no blood in the car. Also she was wearing a white shirt and there was no blood on it in and video footage which leads me to believe this injury happened while she was by herself after she returned to the penthouse. That was a fairly large laceration and should have blead quite a bit

She ripped buttons off of his jacket, there are pictures in his report along with the scratches/cuts on his face and arm. What kind of fracture occurs when you get your finger snagged in a jacket while ripping off buttons as a person tries to escape your violence?
@katrinafisher7820 that and Grand Theft is why she was arrested by the NYPD for Domestic Violence against Majors.
Is it just me, but after listening to jessthemd I’m not sure how legalbytes could have thought anything she said would hurt Majors’ case, I’ve never seen such much doubt brought up, a lack of conclusiveness. The prosecution ultimately failed to prove their case and we all know that. So it doesn’t really lie with the defence anymore. We could have closed proceedings after the prosecution rested and still there was so much doubt. I mean there was that one day where all of their witnesses essentially testified in favour of the defence. Prosecution did a terrible job, fault lies in the jury 100%

czcams.com/video/PR_wCeYi-i8/video.html
1000000000000000000000% facts!!
Both Jabbari and the DA said a lot more than Majors hurt her in the car. They said that he was intentionally physically abusive. Jabbari said she felt him hitting her in the back of the head and twisting her hand back. They said it was physical abuse, the culmination of an abusive relationship. That's what this was about. That's what the press ran with. That's what the DA said after the end of the trial.
There was no proof of this and the jury agreed. You can argue that Majors defense did not cover their bases on the lesser charges. But I am really astounded at how people are so laser focused on this aspect and not how the judicial system conducted itself in this case. It's like arguing about how firefighters did their job when the arsonist is standing right there with the oil-soaked rag.
Great analogy!!
@@WonderWoman780 He has a good point but you know I feel that both can be true. The system screwed him and his attorneys screwed him also!
Fully agreed. I am quite shocked Priya wasn't mor eprepared compared to how she was able to have Adam Foss aquitted of a highly publicized rape case. Says alot about Lawyers... Some are good and some not so much.

@@WonderWoman780If you look into Foss it was an easy case! He should have never went to court due to social media in the first place. Majors lead attorney was still focused on the Foss case instead of the Majors case! Both men got screwed no doubt but she messed up Majors reputation with the public which hurt him more than a guilty verdict In my opinion!
I fully agree with you! She never went to the Media for Foss cases until AFTER he was fully acquitted. It was a smarter move. I see this case being investigated and studied for years.

50+mins, looks like I'm going to need to concentrate on this so saving for later.
Am wondering how badly "him not testifying on his behalf" affected the jurers opinion of him - and yes iiuc the Judge would have told them not to infer anything bad about him for doing that - or something like that.
Hearing he had threatened to "unalive" himself on multiple times, maybe it was felt if the other side got to ask him about this his career would have been done anyway so best keep him off the stand - it being suggested he uses this threat to get his own way (or something like that)
Grace texted that night that she was going to ki@@ herself. He checked on her to see if she was alright and called to get her help. Why is no one talking about unalive situation that night? That night is what the trial was about!
All of this and the DA has a questionable history.
So, it looks like yep, he was doomed from the start.
Listening to you delabotaring I can totally see why the jury would find him guilty of reckless assault, even considering Jabbari's not so straightforward testimony.
Was it a case of bad defence? I really don't know. Not because of the strategy (the ability to use force to retrieve your possesions was brought up but too many people in order for me personally to think that his lawyers made a conscious choice not to use it), but because we don't know how much of it was under the influence of Major's PR team.
They needed to prove her to be a lying lier but it doesn't seem to be the case here. They did have a fight and it was physical.
All the other things - her being arrested later, for instance - are fact, but I don't think they had any merrit in that particular case as basically the question was "Did he injure her in that car?".
very interesting video, as usual, but nothing contained within it to overcome the beyond reasonable doubt burden of evidence. An acquittal ought to have resulted irrespective of any mistake the Defence made in not arguing that the injuries were caused by Majors in his reasonable attempts to extricate himself from the assault he has been subjected to. I understand that may amount to a self-defence argument that would have required Majors to testify so how could not raising it be said to be a Defence error?
Stopped the video at the two minute, eleven second mark. Because I was not surprised at the verdict. His career tanked the moment the press got hold of the allegations. And it figures that it did. No one was in the room where it happened, so only the two parties involved really know what occurred. Did he or didn't he? Well, he may very well have. But, whether or not he did anything to her, the outcome was going to be the same. When it comes to these "high-profile" types in the entertainment industry, they'd be well served to have an advisor or agent or p.r. person that constantly hammers the point about what's done in private. For some in "Hollywood", they can get away with a bit more than others. Jonathan Majors falls into the "others" category. He's not Will Smith. I think he may prove to be the exception that proves the rule, and get some kind of career going for himself again. But he's going to have to go on an extensive "Mea Culpa Campaign" in order for that to happen. Frankly, it's a mystery as to why he didn't see that coming.
Ok if we look the worst case cinereal. He hits her hand when trying to take his phone and broses her year when hi is puling it from her, but she tries to get his phone, she hits him first by the words of the driver. So his fault is he used more force to get his property? And that is if, he did that. In the end. If you don't want to be hit don't hit the others. But she is a woman and if she breaks her finger wile hitting you it is the man's fault.
She says: You are a monster but I love you and you have to be all mine
He says: Yes I am abusive lets break up.
She says: You can't just dump me I am going to sue you.
It is funny that the firs time police started the investigation it was against her, but the prosecutor decided that hi is a better target. The police say it is her fault, the driver says it is her fault, the total drunk stranger says she needed ice in the bar. So it is his fault.
I still think the defense should have been on the line of, look at each of the injuries and when they may have happened. "She might have fallen and injured herself. We don't know because it's not shown on the video. However, if we assume they were caused during the scuffle in the car, it was over his phone. Each of us it legally entitled to defend ourselves and retrieve our property from those who take it. For instance, if your purse or wallet or phone is grabbed by anyone, you have the right to retrieve it. If the person who grabbed your property is injured in that scuffle, that is not your fault. You were legally attempting to retrieve your property. It doesn't matter if the person is a complete stranger, a friend or a loved one. Your property is your property and no one has the right to it without your consent. Mr. Majors didn't intend to hurt Ms. Jabbari, only to get his phone back and put space between himself and her as he is legally entitled to do. So even if you agree with the prosecution that Mr. Majors caused Ms. Jabbari's injuries during the scuffle in the SUV, it was because Ms. Jabbari grabbed his phone and is considered defense of one's self and property under the law, and Mr. Majors is NOT GUILTY on all counts."
Unfortunately, I still don't see how the jury came to the conclusion they did because the fact that EVERYONE who talks about this case say "it could have happened, but we can't say for sure" means there's reasonable doubt. PERIOD! However, I do agree that the defense should have presented all of the possible options of how she could have sustained those injuries to help cement the reasonable doubt in their minds.
He should have listened to his mother.
Billy Mitchell update?!? It’s so bad it’s good!
He said that she climbed on top of him, slapped him then clawed his face. His cheek looks like her nail was dug into his jaw. I think it is quite probable he pulled her ear to get her to release and that she damaged her own finger punching and hitting at him. That said, idk why Majors’ legal team didn’t argue self defense. She admitted to trying to take his property, and in her texts to her she admitted getting “scrappy” with him. Also, what happened to the strangulation charges? There was definitely bruising around her neck in the pics after the closet. I just think we are missing chunks of this story.
They dropped the strangulation charge because when she was examined by the doctor there were no injuries on her neck. This should have immediately been the red flag to get this whole case tossed. But they didn't toss it because they wanted to get him on something. The reason they didn't plead self defense is because there is no hard evidence that he caused her injuries. There are hours of video footage of her after the incident and she appears uninjured. He got a bad, biased jury. That's why this happened. Everything else is people making apologies for the corrupt system.

His legal team was trash for sure but so are the people in his circle that allowed him to engage in foolishness that could hurt his career. Majors chose this woman.
@kicknowledesmith8608 if he chooses a woman he should be screwed by the criminal justice system are you serious?

For those who are saying the jury "should've seen the doubt". Remember, The jury didn't get all of this disposition. They only heard what the prosecution witnesses and the defense witnesses told them. If the defense didn't point out the areas that looked flimsy, some jurors may not have gotten it. Not everyone is smart. Had the defense had their own doctor to say what we just saw in this video, then it would've been a wrap. Majors would've won. It's the defenses job to point these things out in closing arguments. Can't depend on Jane and Joe Blow to just "get it."
He messed himself up. She wasn't there alone. Throwing her back in the car, running thru the streets of NYC, the texts, grandiose speeches - all of that was problematic. None of that looked good. Hopefully, he'll get an opportunity to heal whatever he's going thru...her as well.
She was facing the car when he lifted her towards the car (he lifted her from the behind)... If she would have hit something, it would have been her forehead. But even that didn't happen as he gently put her in the car without her hitting the car. To someone watching the video for the first time, you would say damn he did it... well that's what I thought at first because he was quick at lifting her... but as you watch the video multiple times, putting her in the car he was slow, the pace was carefully slow to ensure she doesn't hit the car. All these injuries happen after the party, when she got home... she and God knows what she did to get all that.... it's sad that there are people who would go this far just to destroy someone's life...
HERE'S A CRAZY STORY ON PAIN AND BROKEN BONES:
This is from Ed Sheeran, when he broke BOTH HIS ARMS AND DIDN'T NOTICE IT: He once went out drinking with his friends. He biked to the bar, and fell off the bike. He got back on his bike with a noticeable pain in his arms but it didn't stop him. He drank all night at the bar, came home, slept, woke up at 5 AM in severe pain and only then went to the Emergency Room. Turns out he broke both his arms and a rib.
This is Ed explaining that story in the first minute of this video:

Looking at you Alyte, you can see your hair is 100% mostly at the back of your ear. Meaning if you were hurt or injured (had a cut at the back of your ear) you would feel pain and your hair will be stained with blood. My point is, Grace had her hair just like yours most of the time (50% of her time probably).... videos show that, her tying her hair... even while doing that touching the very ear she claimed it had the cut at that time... she would have felt the pain, blood would be all over her hair, she would be bleeding as the cut would still be fresh.... I'm all against the assumption that all this happen during the car incident...
Here’s the issue with this case and why some people see it as racial.
The implication is, because of how much it cost to Majors, that he is a big DV perp and he deserves to rot in jail. While in reality this is a situation that unfortunately happens all too frequently in life. Now I believe that he handled it poorly but does he deserve the Weinstein treatment? Does he deserve to be treated like a criminal?
The situation seems to be, based on everything we know, his girlfriend saw a spicy text message from a side chick. She got mad and was like give me that damn phone. Grabbed the phone from his hand. He was like girl, stop playing and give me the phone. Stupidity happened and he tried to use some force to grab the phone back from her hands (his mistake).
He told the driver to stop the car so he could get out. Once out, she tried to follow him in the streets like « who is this girl on your phone you ahole ».
He took her and tried to lift her back into the car (not a great idea) to run away.
He runs away. She chases him looking wild in these streets.
End of story! Does he deserve the Chris Brown treatment? Does he deserve the Spacey punishment?
What has he done to lose his career over? Tried to grab is phone back from his probably drunken girlfriend?
The late, great comedian Patrice O’Neil once said, as a joke, white women’s lives are very very valuable. I believe that this case shows this very well. I’m not sure this story would have been the same if he was with a black woman.
Don’t get me wrong, I believe he made mistakes in this situation. But does he deserve to be brought to justice for his actions, hell no! This whole situation is ridiculous in my view.
Also, his judgement is basically guilty of unintentionally hurting the person who was trying to steal his property. That’s insane to me. And now he’s losing his career and reputation for it. Clown show for sure.
@montrealsportsfan7547 How did Majors handle it poorly? Should he have laid down on the street and let Grace attack him until she got tired?
