അതെ ഇതാണ് ന്യായം. ഈ സർക്കാർ അധികാരമേറ്റത് കോടതി വിധിയുടെ ബലത്തിൽ അല്ലല്ലോ . ആ സർക്കാരിന് ഭൂരിപക്ഷം MLA മാരുടെയും , ആ MLA മാർക്കു ഭൂരിപക്ഷം ജനങ്ങളുടെയും അംഗീകാരം ലഭിച്ചിട്ടല്ലേ , ഒന്നോർത്തു നോക്കു ഏതേങ്കിൽം കോടതി വിധിയുടെ ബലത്തിൽ ബിജെപി ഇപ്പോൾ കേരളം ഭരിക്കുന്ന സാഹചര്യം . ഹ ഹ മാത്രവുമല്ല മലങ്കര പള്ളികൾ ഒരു സഭയുടെയും ( യാക്കോബായ ആയിക്കോട്ടെ ഓർത്തഡോൿസ്‌ ആയിക്കോട്ടെ ) ഉടമസ്ഥതിൽ ഉള്ളതല്ല . ആ പള്ളികൾ ഉണ്ടാക്കിയ ഇടവകർക്കാണ് ആ പള്ളികളുടെ അവകാശം . അതാണ് ഈ ബില് വ്യവസ്ഥ ചെയ്യുന്നതെന്നാണ് ഞാൻ മനസ്സിലാക്കുന്നത് . ഈ ബില്ലിനെ എതിർക്കുന്ന ഏതു സഭ വിശ്വാസി ആയിക്കോട്ടെ ഏതെങ്കിലും മെത്രാനറെ കുണ്ടി താങ്ങി ആയിരിക്കും എന്നുറപ്പാണ് .

How can you compare mullaperiar,state disputes,kashmir issue with this.those issues ca be decided only by constitution of India.the panel advocate has referred to article 26 with which the supreme court decicision in religious properties can be superceded by legislature by law whether it is mentioned in supreme court judgement or not.

The proposed referendum should have a legitimate legal foundation. The present controversy between the two groups is not a novel one. A decision on a fresh dispute can be settled on a referendum or voting to find the majority. But a dispute of historical confusion and confrontation and alternating public opinions cannot be settled by voting. There can be only true situation.. Those who differ can leave without disturbing the the right position.

Justice K.T. Thomas an invitee to the meeting organised by patriarka fraction and listen to what was his speech. I do not have the copy of speech. He was 100 percent supporting them. So he is 100 percent partial. How can a partial person can be and adviser. Will all christian fractions or just to overcome the suprime court judgement ordinance. Let them make a ordinance and again let suprime court decide.

By all means Justice K.T.Thomas can show his loyalty to Jacobites, but NOT by using his current position. He is paid from the tax money of the poor and he should not enter in to a case that was already decided by the Supreme Court and when the verdict executions are in progress.
In every verdict there will be a looser and the looser knows his options well and mostly he accepts defeat and to moves on.
Here the Jacobites had taken a different and unusual unacceptable approach when the judgement was not very promising to them. They severely criticized the judiciary, accused the judges by claiming that they have taken bribes and wrote the verdict, staged street protests, harthals, disobeyed court orders, created public nuisances. They deserve nothing other than severe punishment for everything they did unlawful.
They are no one different to that of a normal citizen who happens to loose in a court verdict and then moving on by accepting the defeat in the ordinary course of life.
Instead of bringing them in to stringent discipline and to a peaceful settlement in line with the verdict the judge’s intervention jeopardizing even the basic concepts of judiciary is to be rejected.

@@georgeverghese5121 The issue should not be whether any private citizen (K. T. Thomas or anyone else) is or is not telling the truth. The real issue is whether the final verdict of the Indian Supreme Court is to be respected by all, and implemented fully.
@@ip3302 SC can only rule by the laws that exist, even if it is unjust or inhumane…. For example rights of SC & ST, law had to be changed to give justice to them. Rights of LGBT groups, law had to be changed to give them their rights. So many laws are outdated or inhumane, but the courts can only rule by the law that exist. So every ruling can’t be respected or implemented and that’s why Govt is there in majority to understand the situation and rectify the injustice by amending laws or bringing new laws that is meaningful to the current era and situation
@@georgeverghese5121 SC, ST, LGBT etc are social issues. They relate to social stigmas assigned to large groups of people for no fault of their own. Jacobite - Orthodox issue is very different. Fundamentally, it is a civil litigation relating to the legality of the bylaws of a religious Trust. In such a case, the claim that ‘justice’ is not rendered by the Supreme Court verdict is meaningless. In all likelihood, every losing party in such a case would claim that it did not receive ‘justice’. The clamor for ‘justice’ cannot be the basis for new legislation to nullify a Supreme Court verdict in such a case. If this is allowed, that would seriously weaken Indian judicial system because all other losing parties in similar cases could then rightfully claim legislative circumvention of the judicial process.
@@ip3302 unfortunately I would like to differ on this argument. I would consider this as a social issue as we have been grabbing churches of the other faction for no fault of the believers. However we try or put forth any argument on bylaw etc, it is a case of faith, and no methran in our sabha can convince or change their belief that the holy Patriarch is the head of the church and all prayers and rituals are blessed from St Peter’s throne. However loud our baba scream telling the other faction doesn’t exist will not change facts…. As I myself is uncomfortable with IOC tag as I grew up knowing I am a malankara suriyani orthodox sabha member…. Till the other day we claimed that we r from St Thomas, but then went and told the court last week that the Patriarch is our head meaning we are from the throne of St Peter!!!! Very confusing and all a drama for wealth and power and nothing more…. And I and many in the church disagree to what our bava and his chelas are doing…. Any attempt to circumvent the judiciary is a very dangerous course, and inconsistent with democracy. There is no modern developed country where judiciary does not have final say in a civil conflict. This trend, if true, will destroy the integrity of India.
This is a naked attempt to make the Supreme Court of India totally irrelevant. This extra judicial and extra constitutional attempt to thwart the final verdict of the Indian Supreme Court must be rejected by all those who respect the Indian Constitution and Indian democracy.

What existence a Parish Church has without a Constitutionally established Sabha! The Parish Church is governed by the Executive Committee elected by the General Body . It doesn't go to any other body of the Sabha. The Vicar is appointed by the Bhadrasana Metropolitan. In a Democracy all decisions are not taken by democratic principles. It depends on constitutionally established principles. If a State in our Union of India makes a referendum to have a free State , is it possible? Can we even establish a referendum here ? Can we take majority of public decisions to slash Orders of Court of Law ? Why should the media conduct the discussions over a repeatedly confirmed verdicts of the highest Court of our land ? If one man commission headed by a Rtd Justice can perform above the highest Court of this land why should there be a Judiciary ? These retired Justices will solve all issues saying that once they were on the elephant's back !

കോടതിവിധികൾ നിലനിൽക്കുന്ന നിയമത്തിന് മറികടന്നുകൊണ്ട് വിധി പ്രസ്താവിച്ചാൽ ആ വിധിയെ നിയമസഭയ്ക്ക് മാറ്റ് ആയിട്ടുള്ള അധികാരം ഭരണഘടന നൽകിയിട്ടുണ്ട്. എന്നാൽ സഭാ കേസിലെ 2017 ലെ വിധി അങ്ങനെ ഒരു തെറ്റും ചെയ്യാത്ത താണ്. 1934 ലെ ഭരണഘടന സത്യമാണ് എന്നേക്കും നിലനിൽക്കുന്നതാണ്. അപ്പോൾ പിന്നെ വിധി വിധി തന്നെയാണ്. അതുകൊണ്ട് നിയമനിർമാണം വഴി അത് മാറ്റേണ്ട ആവശ്യം ഇല്ല.
