    If they have injuries from the past but it had nothing to do with you, but they're using those injuries against you, how do you defend yourself against that? Let's say it was years ago and they're pinning eveything on you for some sort of gain, what should you do?

    Can a petitioner bring in new information that they did not include in their petition during court?

      In California, yes. But I would cross examine them on it, pointing out that they did not include it in their petition, or at least bring it up to the judge in my own testimony.

    Hey Greetings from Illinois,
    I have court on the 13th here in Chicago, The petitioner whom put the PO on me went on a jealous rage and broke my female friends car windows for still being in communication with me. Even though she has a protective order on me, can I use that against her in court? She has being doing this entire time, she is playing victim and abusing the system crying wolf when in fact she’s the aggressor

      This is the 3rd time in 2 weeks that someone involved in a restraining order has had a car vandalized, and I saw a car this morning that had the Carrie Underwood treatment. There must be something in the water...
      I'm not licensed in IL, but in CA, this is a complicated issue, and the answer is basically that it depends. First, can you prove that it was her? (It doesn't need to be 100%... like the car I saw this morning said "CHEATER," etc in spray paint, and if the guy has texts from the night before where she calls him out for cheating, that would probably be enough.) Second, what does it show/why is it relevant? Are you using it to show that she was the aggressor, and any physical altercations were self defense? Are you using it to show that she is the abuser, and this is an extension of her abuse? Are you using it to show that the two of you had a toxic relationship overall, but it was a two way street (careful with this one)? It can't be just to show that she's a bad person. (Again, this is all based on CA law; please consult a lawyer in IL.)

      @@veronicatbartonesq Thank you so much for your response, I really appreciate your feedback. We had court set for status yesterday, I heard the judge Say that she would like to file a motion to amend/ or modify the order. I have to show up on the 13th and now she has to show up on the 19th for a hearing. I also went on the cook county clerks website and the case usually shows up, and now it read “NO CASES FOUND” 🤔
