  • Certain observations on the Letter of Additional Central Provident Fund Commissioner, Vijayawada, Andhra Pradesh to The Central Provident Fund Commissioner, EPFO Head Quarters, New Delhi:
    Sri Parveen Kohliji, just a while ago shared the above letter on his WhatsApp EPS, '95 Seva Groups:
    The letter aims to do away altogether with the Higher Pension to State/Central Public Sector Employees by "faithfully" following the observations of CAG on the audit of Public Sector Undertakings.
    The Employees' Provident Funds & Miscellaneous Provisions Act, 1952 was promulgated through an Ordinance by the President of India on 15th November, 1951 and by gradual implementation of the Act in the intitial states "only" to Private Sector as per the first Annual Report for the period from 01-11-1952 to 31-03-1954 which is available with me, and ultimately decided 1st November, 1952 as the "Implementation Date" which is also called as EPFO formation day.
    Right from 01-11-1952 till the CAG report as mentioned in the letter, CPSUs/SPSUs are contribution to the Provident Fund on full wages along with the Employer. Then leaving all these years i.e., from 1952 to 2017 i.e., 65 years, now CAG is pointing now.
    In the report, it is stated that CAG pointed out that Public Money i.e., expenditure incurred by CPSUs/SPSUs cannot benefit a section i.e., employees. Then even revision of Pay Scales, Grant of Annual Increments, Fixation on Promotions, etc are coming in this category. Can it be permitted to stop these benefits to the employee as this is the public money.
    When Central/State Government employees are getting Pension under "Old Pension Scheme" basing on the Pay of the last day of retirement (even if the employee gets promotion on the last day), why not Employees' and Employers' Contribution is on full Wages as Contributory Provident Fund Scheme is only alternative to "Old Pension Scheme" or "Contributory Pension Scheme" or NPS,'2004.
    Even under Contributory Pension Scheme, or NPS,'04, the Employee is contributing @ 10% on his Pay whereas the Central Government is contributing 14% on Pay i.e., 4% more percent from 01-01-2019. It the contribution by the Government is only on Full Wages but even 4% excess. It is not drain on the Public Money? This is even applicable to the employees of CAG.
    How come Addl. Central Provident Fund Commissioner, Vijayawada, treating the observations of CAG in 2018 as "Magna Carta" when it comes to denying Higher Pension to Employees of CPSUs and SPSUs, when it ignored the directions of the Hon'ble Supreme Court (Much higher institution than CAG) in the judgement of Sri R.C. Gupta & Others when it denied Higher Pension to the employees of Exempted establishments, the decision of which was turned down by various Hon'ble High Court by passing strictures against EPFO for its letter of 31st May, 2017?

    Liked and subscribed. Thanks for the quick update and providing the relevant info. EPFO has created another new twist to the higher pension tale. There seems to be great reluctance on EPFO part to give higher pension. Almost 2 years have passed after the Supreme court judgment and still no much progress has been made.

    Supreme Court is the more than governments & it's agencies as well as Constitutional Agencies as per our Indian Constitution. Already Supreme Court passed the orders over rided government order of sealing limit of Rs 15000.

      మరి ప్రభుత్వాలు, EPFO కోర్టు తీర్పులు ఎందుకు అమలు చేయడం లేదు. గందరగోళ పరచవలసిన అవసరం మాకేం ఉంది. ప్రస్తుతం ఏమీ జరుగుతుందో pensioners ను ఎలర్ట్ చేస్తున్నాం. అంతే.

      గురువు గారికి నమస్కారములు. అయ్యా నాకు 2023 సంవత్సరనకు బేసిక్ డిఎ మొత్తం ప్రస్తుతం 90,000రూపాయాలు. అయితే 2023 సంవత్సరం నవంబరు లో నాకు డిమేండు నోటీసు రావడం దానికి నేను అంగీకరించిన తర్వాత అక్షరాల 1287000 రూపాయలును సుమారు గా నా పిఫ్ నుంచి ఈ ఫిఎఫ్ ఎకౌంటుకి మళ్లించారు. నేను 2026 జూన్ నెలలో పదవి విరమణ పొందుతున్నాను. అయితే నాకు ఇపపుడు నెలకి హయ్యర్ పెన్షన్ ఎంత వస్తుంది. అసలు ఇప్పుడు మా విశాఖ స్టీల్ పరిశ్రమ ఉద్యోగులకు వర్తింప జేస్తూ ఉన్నద లేద దయచేసి వివరణతో తెలప గోరుచుననాను. ధన్య వాధములు. 4:01
