- Subject . Non fallowing the laws, Non implementation of the Orders of the Supreme court, Issuance of illegal circulars by the EPFO and non action by the Govt of India and, consequently, injustice with the senior citizens of the country.
Honorable Madam/ Sir, It is, the most humbly and respectfully brought to your kind notice that the provision of higher pension of EPS 95 , a welfare scheme of Govt of India, is not implemented by the Employees Provident Fund Organisation , EPFO , since last 20 years , by issuing various illegal circulars , one after other. Brief details are as below.
1) That by issuing illegal circular dated first December 2004, circular dated twentieth of July 2006, and circular dated 31 of May 2017 , the Employees Provident Fund Organisation, EPFO, did not allow the Employees to exercise their options for higher pension under proviso to para 11 (3) of the Employees pension scheme 1995 and deprived the Employees from the higher pension benefits . All these circulars are held illegal and arbitrary by the Honourable Supreme Court, vide above referred orders/ judgement dated 31 of March 2016, dated 12 of July 2016, dated fourth October 2016 and dated fourth November 2022 ( order of larger bench). However, in spite of all the above mentioned judgements/ orders, the employees are not being allowed for the benefits of the higher pension by playing very dirty tricks of issuing illegal circulars, one after other and entanglement in legal litigations.
2) That the EPFO has not been accepting the joint options of employees, for higher pension under proviso to para 11 ( 3) , since first of December 2004 on the name of cut off date . This " cut off date issue" is finally decided and settled after the judgement of the Honourable Supreme Court, dated fourth October 2016 in R C Gupta case. The Honourable Supreme Court in above Orders/ Judgements in 10 Special Leave Petitions held that the EPFO has no power to fix up any cut off date for option and there is no time limit for giving joint option, under proviso to para 11 ( 3) of the pension scheme. Now, it is very surprising to note that the EPFO , itself, had not allowed and not accepted the joint options of employees, since first of December 2004 till the judgement in R C Gupta ( fourth of October 2016) and now , it says that the employees should have exercise their options prior to their retirement who retired prior to first of September 2014. This is very strange and illogical on the part of EPFO.
3) That the EPFO, now after declaring all earlier circulars illegal, issued two new circulars dated twenty ninth December 2022 and dated twenty fifth of January 2023 saying that the employees those who retired prior to first September 2014 were required to give option prior to their retirement. During their service period, they were not allowed to give option, and now, it is said that they should have given the said options prior to their retirement. This is a grave injustice with the Employees & senior citizens of the country. This is nothing but cheating and fraud, by the authorities of the EPFO. Moreover, theses circulars dated twenty ninth December 2022 twenty fifth of January 2023 are in contradiction to all the orders/judgements of the Honourable Supreme Court mentioned above, in the reference. However, the authorities of the EPFO issue such illegal circulars ( without any approval of Govt of India), because no responsibility is fixed on such official by the Government of India, Ministry of labour and employees.
4) That issuing such illegal circulars dated first December 2004 , dated twenty of July 2006 and dated thirty first of May 2017, the employees have not been allowed to exercise their options and forced to approach the courts.

I request the Hon'ble Supreme court to call for the records from various central government departments in respect of non implementation of court's orders in service matters even after the deadline prescribed by various courts are over... Govt itself is encouraging litigations and increasing the pendency of cases in various courts. The biggest litigant is govt only in most of the service matters.
Modi is the main culprit for not enhancing minimum eps pension.
The senior employees are mostly crossed their 80s they couldn't even apply for the pension. This is time for the excess pension for their health and everything. So please consider for the opportunity for the old people. Thank you for sharing with you.
It is better to sanction minimum pension @6000/- temporarily so that EPF95 pensioners may lead some better life. Please think all members.

Supreme court judgements given earlier are not implemented in a contemptable epfo became extra constitutional authority in beaurocratic connivance with politicians in power to swallow hard earned money of retirees ,no justice done , let those others in similar conditions of age must please be reduced to pay similar pensions for short lived political careers of legislators getting fatty pension in addition to loot of public money

Sir, another issue regarding Family Pension Fund. Out of our monthly contribution from salary, 8.33% was towards FPF, and 3.67% was for Provident Fund. On our retirement, we received only 3.67% towards PF and the major contribution (8.33%) was left for Family Pension. Presently we get a small monthly Family Pension, with which it is difficult to get on in old age, with health problems. I am a private employee. It will be greatly appreciated if the Government looks into the problems of Senior Citizens.

We will not get our pension arrears, unless we pay 6,50,000/- we are unable to pay this huge amount till our death, I am expressing my option, please deduct what we have to pay be deducted from the arrears amount and return our arrears to our savings bank account.

There is no mention about pension amount now paid which is lowest quantum of std living amount of Rs 12000/- just representing about circulars and action on EpF authorities will not help the sr. Citizens. Similarly representation to submitted to prime minister to increase minimum pension in present living standards. Welfare pensions given by govts are more than EPF 95 pension payment.
The law makers also one day the other should also retire. Then only
