An armed robber is shot dead during a botched heist.
From "Thinking Makes It So" (Season 16, Episode 18): When an armed robber is shot dead during a botched heist involving an unlikely bank manager, Detectives Fontana (Dennis Farina) and Green (Jesse L. Martin) soon discover the executive was forced to assist in the robbery by the men who kidnapped his daughter. Fearing for the girl's safety, the detectives begin an aggressive search resulting in Fontana having to use heavy-handed means to extract the child's location. The questionable tactics then leave A.D.A Jack McCoy (Sam Waterston) to face a deceptively canny defense attorney (guest star Peter Jacobson) who will fully exploit the issue of excessive force.

It is easy to assume then from what the ex husband said that the ex wife does not work. But not every workplace is child friendly. It would be stupid to assume that he could just bring the kid along with him to work. Most offices dont allow kids roaming around. It is also too distracting to the dad who would have to watch his kid while doing his job at the same time.

The kidnapping and robbery were planned by father-son con artists (the son is the one killed in the opening by the guard) and Fontana later threatens with a gun and then waterboards the father in a toilet in order to force him to reveal where the girl is-on the boat where she's totally safe and wasn't harmed at all. Defense argues the questionable tactics Fontana likely took call for a mistrial and that the girl was never in danger (though he personally thinks his client asked for it) and McCoy while not agreeing with what Fontana did and struggles with it still insists that what Fontana did or didn't do is irrelevant (still kidnapped her and planned a robbery). Borgia keeps a mistrial from happening by researching and proving that the Police would've eventually figured out where the girl was without the interrogation tactics-though disagreeing with what Fontana did more openly, she's wishing she didn't have to do that to begin with-and the guy ends up convicted of both crimes. The Defense poses the question at the end to McCoy that would what Fontana have done been alright if it was the guy's mother or something instead and neither knows the answer.
