Hunter Harassment on Minnesota Public Land

  • On a recent outing, a friend and I were harassed by a neighboring landowner. Although very upset, I managed to keep my cool and went to talk to the landowner, hoping we could resolve the issue. The landowner continued to harass us until we left the area, even after we informed him that he was breaking the law. This video was presented to the MN DNR and the landowner was dealt with by a couple of enforcement officers.

    Out here in NJ,I hunt in the Pine Barrens and I get people calling the State Police called on me for discharging my firearm. And the SP called the game wardens and they cited the people complaining for hunter harassment.

    In South Dakota I've had people congratulate me after shooting a deer, there's a farmer that always walks by in the morning after I finish hunting and asks how I did, other people tell me good spots where they saw birds too. Really glad I haven't had to deal with stuff like that and I've only ran into friendly people so far.

    I'm surprised the Game Warden put the pressure on you to decide his fate since MN regs (MN ST § 97A.037 ) clearly state the interference with hunters and chasing away of game is illegal (even if on his side of the property)..he broke the law, so you decide? sounds strange..charge him, he will just do it again, believe me.

    I posted a similar video about a month ago. A guy tried kicking me off public water and he got a hefty fine for harassment from the warden! He even put his hands on me and pushed me. If he hadn't of been so old I would have layed his ass out.

      I won the bet. Less than half hour for a antihunter to comment. Hunting legally on DNR or state land is a way to control the wildlife in the area. Even something as small as a field mouse would wreck havoc if the population is left unchecked. The general assumption is that hunters are nothing but a bunch of killers. That could not be farther from the truth. If you do some research you will find out that is thanks to hunters and fisherman's that we have state and national parks and wildlife preserves and is hunters and fisherman's that pay for the upkeep and protection of said park and preserves for all to enjoy.

You also don't know or you don't care to know that all hunting rifles sales, all munitions sale, all fishing lures,rods,reels, lines are taxed by the federal government and the money goes to pay for the upkeep of parks. It is called an excise tax to the tune of 10%. That is before sales taxes are added to it.Just so you don't have to spend too much time researching I will give you the names of the congressional acts and laws that take money from every hunter and fisherman to upkeep parks and preserves: The Pittman-Robertson act in 1937, added 10% on hunting gear, in 1950 the Dingell-Johnson act extended the tax on fishing gear, in 1984 the Wallop-Breaux amendment extended the tax to boat fuel. As of 2010 hunters and fishermans have spend over 20 billions on behalf of the environment (on average 1.5 billions of dollars a year). Every year Duck Unlimited, a noted duck hunter association donates on average 300 millions for the upkeep and expansion of wetlands. That is on top of licensing fees, duck stamps, access fees, boat ramp fees etc. etc. Contrary to what you stated in the previous comment hunters and fishermans do not destroy wildlife they are more of an environmentalist than you or me. I do not hunt or fish but I do not like when people take pot shots at hunters and fishermans without knowing or caring to know the facts.

      Eddie Truth, obviously you were too busy posting seven comments to take the time to read my previous comment in its entirety because if you did you would had read that I don't hunt or fish.That said I will add this: I agree with you about how the human race has destroyed the environment in the past and is still doing so this very moment, in fact if you are driving a car you ARE impacting the environment, if you are sitting in front of the computer with the lights on in a nice warm house you ARE impacting the environment, if you just ordered a Christmas present from amazon you ARE contributing to damage to the environment, and so on. I a perfect world there would not be a need for hunting but we don't live in a perfect world because we messed it up. We destroyed forests, contaminated water, air and ground ,hunted and killed countless species to extinction. I am well aware of that, however hunting and fishing in my opinion is a necessary tool to manage wildlife population. Nature left to its own devices will find it's balance but that means remove man from the equation. Are you willing to agree not have kids to reduce the population or to have just one kid? By the way that was tried in China in the 70's and 80's, it was called the "one child policy"and it didn't work, it was also a human right issue to the eyes of a lot of nations. Are you willing to pay more for food that is grown in a environmental friendly way? Are you willing to stop driving, are you willing to live in a smaller house, are you willing to upgrade you house so you use less energy? We can do a lot to lessen our impact on nature but are we willing to do it? As you can see I am well aware of the impact we humans have on the environment but I also understand that because we upset the balance of things by removing predators and destroying habitat we now have to play the roles of predators even if is not a very popular solution. In your comments you depict hunters as a bunch of wildcats shooting at anything that moves and that can not be any further from the truth. Hunters in general understand that they can do immeasurable damage and therefore one of the most careful and law abiding citizen (you can not take a bullet back once it leaves your gun). No self respecting hunter will ever poach or condone poaching. If one does there are serious consequences. Laws and regulations are enforced by a bunch of very dedicated people that care deeply about what they do. They definitely don't do it for the money since on average a us fish and wildlife officer only makes $50.000.00 a year.

    It's a shame you didnt have DNR issue a citation. When I was younger Michigan didn't have a hunter harrassment law on the books, I was just starting my career so pay was low, hours long and usually during deer season I'd get 1 or if I was lucky 2 days to hunt.
    Even 100lbs of meat would've taken a big chunk out of my grocery bill. But we got harrassed on public land by the non-hunters and 4 years in a row in different parts of the lower peninsula every hunt was interrupted by some idiot(s)
    It caused me to quit hunting for about 15 years until I met some people I could hunt with on their property. I sure could've used some meat in the freezer during those early years and I will give no break to someone who harasses me or anyone else.

    Shane I am very impressed with your cool head and calmness. I hope you had the CO issue a citation. I had a state trooper tell me several years back that he just wanted the person behind the wheel to drive safer. He said if he thought a warning would get the message across, a warning it was. He also said some people only change their actions after hitting their wallet. I feel positive a warning would not prevent the same thing happening again. A citation might not either, but at least the paper trail will have been started so further action could be taken.

    notice how everybody claims its their land until you can prove you are on public land? if they didn't know their stuff that land owner would have gotten away with falsely claiming that part. This happens to me with logging companies "your on private land". i suggest everyone get ahold of the google maps update that overlays private and public land. the one i have shows parks and reserves and lets you know exactly where you have a right to be. I got my mine from my local city hall

    Does Minnesota has harassment law to protect all hunters? I would just call law enforcement to handle this land owner instead of dealing with him directly. The land owner seemed to be very angry toward the two hunters. I don't recommend to confront the land owner. Please call the authority to report this harassment instead of dealing it by yourself.

    Sorry you got harassed. Looks like you were in the right.
    I have no problem at all with hunters near our private property as long as they follow the laws and show reasonable common sense. Unfortunately some of them do not. Had many trespass on our property when they could have asked permission. Had some put up stands on our property right next to the sign. Had some tear down our property marker signs. Some left empty shells and other trash. Some also were downright reckless by setting up a spot next to the line and firing into our property.
    After dealing with this kind of nonsense for a while we became less inclined to give permission to cross. Some knuckleheads get the mistaken idea that they should be allowed to hunt anywhere and ruin opportunities for everyone else.

      Was your property posted? non agricultural land needs to be posted. You can look in the DNR regulations for the definition of agricultural land but in short it is crops and their residue and maintained, planted grassland or CRP and livestock areas. these areas need not be posted. Any other land, private or public may be used for hunting WITHOUT permission as long as it is 500 feet from livestock/occupied buildings etc. If that land is not posted Permission is not needed from the landowner until the landowner asks you to leave. This is state law and i don't know how many landowners have yelled at me over the years simply for being ignorant to the laws of the state. Also if you want to bring up asking for permission.... In my experience 90% of the time I ask for permission to hunt land it ends with me driving away in my truck. over half the time people don't even answer the door when It's obvious they are home and of the 50% of the time landowners do answer the door 75% of it is no for various reasons. And that I'm fine with, it's your private land to do with what you choose but I'm tired of seeing comments on this thread that say landowners are accommodating to hunters. I've been hunting in this state since i was 12 and from experience it is simply not true.

      Jonathon Enright Yes it is posted as no hunting and no trespassing. The signs sometimes get torn down by hunters trespassing on my family's land. They also hunt within 500 feet of my dad's cabin which is usually occupied. So they are in clear violation of the law for at least vandalism and trespassing.
      They also leave all kinds of trash on the ground. They set up stands in our trees and leave all kinds of trash underneath. The spot they usually set up the stand is within 500 feet of the cabin.
      My dad is a lot more forgiving than I am. I would be furious if they discharged a firearm in the direction of my home and family while trespassing and vandalizing. That could become an ugly situation.

      My cousin hunts pheasants in a similar fashion..birds kept crossing in a particular location..he'd either ground sit ,using natural cover or set up one of his ground blinds..didn't have a dog to flush and retrieve the birds..shot lots of pheasants that way

    Personally, not trying to start something here, I'd harvest my own food.
    Knowing where my food comes from is very satisfying. I know what i ear had a good life in the wild rather than raised for food in a 2x2 cell force fed so they're twice as fat as normally possible.
    For all thoes people who believe its better to eat food thats unhealthy, inhumane, and down right sick. (In my opinion) you can do that.
    The only food i get at the market is put up for sale by the neighbors Ive actually spoken with.

      EddieTruth thats why theres a list of animals u cant hunt, and theres a big difference between poachers and hunters, poachers kill for fun and trophies, hunters do it for food and controlling populations, u cant tell me that it is ok to raise a animal in a 2ft x 2ft box, never let it see daylight and then let some machine kill it in the most inhumane way possible, then let you eat it

    The reason it keeps happening is cause they keep getting away with it. No repercussions means no reason to be anything but difficult and abusive. I wouldn't even have gone to talk to the guy.     I know it sounds dumb-but looking at the tall grassy fields, how does one know where the property lines meet?
    I knew a soldier sister when I was in the Army wanting to get back home to Minnesota before hunting season ends.
    I asked her she'll have time before the first winter sets in in the mid west.
    Unfortunately she did not find it to be funny...

    I remember when my father and I were shooting all these mallards in a little water hole in the middle of our cornfield. We could see some hunters in orange hunting the woods to the North of us. Well anyways, my dad and I were banging at these mallards and the next thing you know, 2 disgruntled deer hunters in orange confronted us. Told us to get off our own property!! I'll never forget it. My father and I are very easy-going people, we just looked at eachother with a shitty little grin like these guys were on crack. Come to find out, it was my 9th grade science teacher who told us to get off our own land. They were pretty angry we ruined there deer opener but hey, that's how hunting goes.

      MKnight515 I completely understand what you mean lol. We have many uneducated people do the same thing, they believe they own everything. I simply just call the game warden and they quickly disperse because half of them have no hunting license.

    Believe it! I experienced this while hunting quail in California on public land. A guy who lived next to it, but more than 1/4 mile away, jumped in his loud pickup, and drove all around, hollering at us. I was pissed and immediately hiked out and confronted him. He started out talking shit until I let him know I was NOT going to put up with it. He quickly realized the error of his ways and left us alone. You were way more polite to that asshole than I would have been.

    Pretty funny, All that talking is doing more then Leaving that tractor running, It isn't going to scare crap, it's just going to bring the birds in. We get our tractors in the field and after the second pass Turkey an quail are already looking for bugs and seed. Those birds aren't stupid they know the sound of the dinner bell

    We had a guy that had rights to the property across road of our property we had rights to, purposely run ol clankety corn dryer that the grain ben was empty, to keep deer from running to our side, because he was mad he lost rights to our side. The DNR made him shut it off. Its was reportedly one of the driest years and no one had to dry their beans or corn that year, plus it was empty. Cant prove it but he stole some of our tree stands too. My cousin did catch the guys brother and kid antler hunting on the property in spring on trail cam.

    Here's a big part of the problem, hunters make videos of being harassed while hunting, and whine to others, yet do nothing about it. Most states have laws against hunter harassment, when faced with it you dont do a thing about it. Those people that harass you dont care one bit about you and your rights, they dont care if you call authorities, they dont care if you got shot, they dont care. Yet here we are again trying to reason with the idiot.
    Those harassers have no problem calling cops on you hunters and claim you pointed a gun at them, when you didnt, even if you tried to reason with them before they called the cops. So why am I angry at these hunters? Because they just made it ten times worse for the next hunters that come across that dick.
    Now if that harasser got a ticket for harassing these hunters he would think twice about doing it again. You dont stand up for your rights you will lose them...........................Michael

    Filing a complaint with the environMENTAL watchdogs for running his tractor (IDLING for extended periods of time is unlawful in many areas) and creating a source of pollution might have been the icing on the citation cake.

      Well, they can't give him a citation, game wardens who can are few and far, and local police are clueless. It might be good to know the local warden. Pick up phone and, "Hey Brent, this is Alex. Some old coot is deliberately running his tractor to scare off the pheasants. Care to pay him a visit and let him know what's what?"

    Your response to him is great, but man that muzzle control is awful, I watched the second hunters gun swing at least twice in tbe direction of the first hunter while walking to the farmer.

    im having the same problem, i live in northern minnesota, i have 12 acres and some guy bought 20 acres behind me and thinks he owns the whole county, he does this to me with quad runners, i have plenty of video of him but trying to get dnr or law enforcement to do anything is like pulling teeth,

    I hope this shit never happens to me. I live in Minnesota and have hunted deer here since I was 12 and I've never had an issue with people like this. I only hunt in the county I live in so I pretty much know everybody, though

    Whether you want to press a charge or not, you must file a complaint so that a record can be placed on file. Your complaint should be as accurate as you can make it, without exaggerations or opinions. Just the facts along with the date and time of day. The public record will show that a complaint against this owner was made.
    This might seem to be pointless, but there may be an incident at a future time where your complaint will be pulled out and considered in judging the outcome. Also, there may be complaints on file that you don't know about. A judge may have ordered him to leave hunters alone and will reconsider that judgement. Of course, nothing may happen also.
    What happens after your complaint is made is out of your hands and is not your concern. It may be too late this time, but in the future, file a complaint whether you want to or not.

    yeah you were shooting his pheasents coming off his property lol that's what he thinks ! went thru that deer hunting once guy accused me of shooting all his deer just because they came from his property onto my hunting area they just don't realise they aren't any ones property other than the state's !

    Crazy some times. Was on a wma near leech lake bow hunting turkey, posted wma everywhere, and some guy on an atv came and chased me off his land. Long story short he reluctantly gave me permission and left...some peoples kids.

      +Jack Yang Most or all states have laws pertaining to hunting with firearms in proximity to occupied and/or unoccupied structures. The closest structure to us was 1/3 - 1/2 mile away, well beyond the legal minimum distance.

    New York City is such an awesome place. In fact, all our cities are just amazing. I know it looks really cool to be out in rural America on the Discovery Channel, but those are all lies. You all have the best in life right there downtown or uptown. So if you’re thinking of leaving the big city for some country living, just don’t.     I have hunted all my life, BUT it is public land so everyone has the right to use it as they deem fit as long as it’s done legally. Is what the harasser doing smart, nice or safe, no.
