    Summary from Wikipedia:
    A Shaggy defense is a legal strategy in which the defendant denies that they were the one witnessed or recorded committing an alleged act. The strategy's name is derived from reggae musician Shaggy's 2000 single "It Wasn't Me", which is based around the concept; it was coined by Slate writer Josh Levin in 2008 to describe the defense used by singer R. Kelly while he was on trial.
    "It Wasn't Me" by reggae musician Shaggy was released in September 2000 as the first single from his fifth album Hot Shot, eventually reaching #1 on the Billboard Hot 100 and other countries. The lyrics of the song depict one man asking his friend what to do after his girlfriend catches him with another woman. His friend's advice is to deny everything, despite clear evidence to the contrary, with the phrase "It wasn't me". As the narrator describes all the evidence his girlfriend has against him, from a video recording to witnessing the cheating herself, his friend adamantly repeats "it wasn't me". Ultimately, the narrator says that the advice "makes no sense at all".

But sometimes they make me want to pull my hair out because they are ridiculous. While all legal movies and shows take dramatic license to make things more interesting (nobody wants to see hundreds of hours of brief writing), many of them have a grain of truth.       Speaking of Shaggy, I made this suggestion on a previous video but it'd be cool to see an episode or two about the legality of Mystery Incorporated (The Scooby Doo gang).       The default assumption is that the worst result of cheating is breaking up which doesn't require the law to step in unless you're married. Which cheating can be used as a reason to convince the court to grant a divorce.

      @@michaeledmunds7266 Actually, it *does* often happen during 'regular business hours', as many purchasers of...someone's time...are, in fact, married men/men cohabitating with their primary partner. Said purchasers generally return home in the evening after typical business hours, and thus enjoy someone else's time before they would typically be expected home (most commonly during a lunch break, or directly after work whilst claiming to have been working a bit late, if asked). 😳😊

    Objection! RikRok’s girlfriend is a time-traveling sorceress. Cellphones did not have anywhere near that level of quality in the year 2000. Her video evidence, whether recorded on her phone or streamed from CCTV, comes from technology that had not yet been invented.

      As a point, it would cast doubt that the evidence is too good to be true. Clearly what we're seeing is the video she showed him and the scenese that play during the conversation are mockup recollections.
      It's entirely possible that this guy is being gaslighted by his girlfriend who has manufactured cinema grade evidence to convince him of his own guilt. She appears to be a woman of means, she might be trying to convince him to leave quietly. He strikes me as the kind of guy who would fall for it. And he has an embarrassing friend she might not want to be connected to.
      "Honey, I wasn't there."
      "I saw you! I have it on video and there are marks on your shoulder."
      "Wow. This really does look like me. And I do have marks on my shoulder... Maybe I did do it."

    since the footage looked like security footage I would argue that she does not have the right to the footage because the security system is installed in the house(that presumably he owns and her name is not on the title ) and since he gave her "an extra key" she has no more rights to the security footage than the housekeeper and would that not make it inadmissible in court and since she was watching in her car that could add a voyeurism charge on her ( i am not a lawyer at all I am just throwing out my opinion)

    Alternative defense: He was under the impression that they had an open relationship. That way he doesn't have to defend against clearly damning eyewitness testimony and his own admissions. He only has to argue the reasoning behind his actions. He thought they had agreed that sleeping with other people was allowed.       @@kharnthebetrayer8251 I assume this is a misunderstanding based around wording, but wanted to be clear, polyamory doesn't necessarily have anything to do with marriage, the word for poly marriage is polygamy. But assuming that is a misunderstanding, I'd agree most likely most places adultery laws and anti-poly laws only apply to married couples, at least that i know of in the US. However I wouldn't be at all surprised if that was not the case, especially in more conservative states. I mean there are anti-sodomy laws, anti-oral laws, laws restricting the amount of dildos you can own, laws about not eating soup with a fork. I don't have high expectations for our modern world, certainly not the States.

That just comes with exercising your own critical thinking skills. Nobody's views match up exactly. Although not enough people realize this fact. Case in point (but working in the opposite direction), I recently figured out why my ex is so passionate about her support for Trump. She hates "bleeding heart liberal SJWs" so she decided to align herself with the complete polar opposite, effectively attempting to offset extremist views with opposing extremist views. Whereas my political alignment is closer to centrist. But I digress.
      Extremes should really be avoided. Just because you like someone, doesn't mean you have to go all in on sharing their views. And just because you don't like someone, doesn't mean you should automatically join the opposing side.
      Don't just follow blindly. Form your own opinions. Sorry for the wall of text. I just hate it when people pull this crap. It shows a complete lack of critical thinking. And that's why the world is so messed up right now. Too many parrots and sheep.

    Question: is instructing a client to lie (e.g. saying "it wasn't me" when it in fact was) not itself a crime? Something like conspiracy to commit perjury.

      Is the defendant really expected to be truthful? I'm asking because I'm not sure how that works in American law.
      In Swedish law, only witnesses can be charged with perjury since neither the plaintiff nor the defendant are ever heard under oath.

      @@enemixius The crime with which Bill Clinton was ultimately charged in his impeachment proceedings was perjury, for stating under oath that he "did not have sexual relations with that woman." Any claim you make under oath must be truthful.
      However, the 5th Amendment to the Constitution of the United States guarantees the right not to be compelled to incriminate oneself- so a defendant can refuse to answer a question by "pleading the 5th." Of course, a person can always voluntarily confess, waiving their 5th Amendment rights.

      Maybe technically, but to quote a defense lawyer on reddit, "the lawyer never goes to jail." The real reason most defense attorneys wouldn't advise lying is because the defendant has a right to not testify against themselves. Saying nothing is better than getting caught in a lie.

      Feasibly a crime, but definitely a violation of the lawyer's code of professional responsibility. A violation that jeopardizes their license and livelihood. Considering how often clients are total strangers to a lawyer and have absolutely zero reciprocal loyalty and will throw the lawyer under the bus in a heartbeat... How much do you think lawyers want to risk their livelihood for that?

      @@freddybenelli9100 Exactly. Bill Clinton lied under oath. He was under oath because he was called as a witness. The defendant is not under oath, only witnesses. It's incredibly rare in real life trials for a defendant to be called as a witness themselves. If they were, they'd be under oath. But it hardly ever happens.

    That was amazing. So I believe I can ask for a consultation about my client, a woman called Carrie, who is accused of having trashed her boyfriend's car so thoroughly he was better off sending it to the scrapyard. She didn't even just admit to it, she bragged about it and wrote her own name into the car. Do I have the grounds to go with a temporary insanity defense due to rage about perceiving herself to be cheated on, even though that turned out to be incorrect?

      plus the whole song is a joke. It is not exactly clear that it is so from the various narrative techniques plus the genre sometimes makes hard to understand what people actually mean and what is a joke but in this case it was made deliberately so it would look ridiculous. The contrast between the damning evidence and the defence "it wasn't me" is so stark that it makes the defence look ridiculous and this is why it ends with a resolution, that it is better to just admit your wrongdoings. But they aren't at a court of course.
