  • In OH v. Chad Doerman, the defendant is accused of murdering his three sons. He confessed to taking their lives on a number of occasions. Now, the court has granted in part his Motion to Suppress these interrogations, meaning it will not be able to be introduced as evidence.     Just to allay everybody’s fears- it makes little difference whether the confession is admissible or not. The entire neighborhood witnessed this man murdering his family. The wife witnessed it and was shot herself. The daughter witnessed it and was shot herself. The police arrived to find him with the murder weapon IN his hands and they had to scream at him to put it down before they could even approach him.
    On top of that, the little girl- the daughter- went running down the road screaming “my daddy is killing everybody” for the entire neighborhood to hear. I looked up exceptions to the hearsay rule and it says “excited utterances” are considered exceptions and usually admissible. Also, in some cases screams that aren’t directed at one particular person can be considered as part of a witness’ own perception of the events as they unfolded, and that WOULD be admissible.
    So this guy is going to prison forever. Where he can enjoy every minute of every day inside of a 6 x 8 concrete box eating vomit flavored glue-paste-cardboard “food” and being Pretty Pretty Princess at the beck and call of some dude named Bubbles.
    So I wouldn’t worry about it too much. This man is already dead by lethal injection, he just doesn’t know it yet.

    I am glad the judge has tossed the confession. Not saying I want the guy set free- on the contrary, I expect everything else to get him locked up for the rest of his miserable existence. But maintaining consistency through all cases is very important. Gotta protect the guilty from misconduct if we're gonna protect the innocent from the same.

      Plus if they didn’t you just know the guy would win on appeal and that’s BAD. So take no chances is usually the courts philosophy (I assume lol)
