      Believe it or not, that’s actually the point. As a security officer of my own, these auditors act like that on purpose in the name of catching an officer slipping up. The only reason they shouldn’t be allowed to video record anything is if they are ON the private property. Otherwise it’s entirely legal and protected by the 1st amendment right

      Auditors fulfill the function of a stress test for law enforcement. Stress tests are meant to push the boundaries to find failure points or demonstrate the resiliency of the police department.

      @@Stinngerr Then it needs thorough investigation. A cop tampering with and/or destroying evidence is VERY serious, any allegation of such corruption needs to be taken seriously. The camera being out of his possession and the deleted video needing to be recovered, plus that video containing evidence of the initial incident and the following police interactions (including an illegal arrest), is means, motive, and opportunity. Thorough investigation is the only appropriate response.

      His immediate reaction after getting pushed and potentially assaulted is understandable. After that guy left and the others took over, whom were much more calm and attempted to deescalate, the guy continued to escalate and be an asshole. When the cop asked him to please not yell, so as to prevent a situation escalating, the guy proceeded to escalate further and, be an asshole.

    In my opinion, if a police officer is caught attempting to delete, conceal, or tamper with evidence in order to cover up their own unlawful actions, then they should face the same legal repercussions as a citizen who's committed that same action.

      How? He was walking and taking pictures. They escalated it by putting their hands on him. The cops were trying to put the blame on him, and when he wouldn't let them do that, they called in officer asshole to make it even worse.     Look I spent 40 years in law enforcement and private corrections. I took my oath seriously, and never allowed my ego to get involved in situations. I absolutely support first amendment auditors, and it’s frankly embarrassing that cops don’t know basic law and civil rights. I don’t however see the point it literally trying to create confrontation as he did initially by attacking the cop who up to that point had done nothing to insult or threaten the guy. I won’t even try to defend the dumb ass cop who arrested him. It’s just my opinion it wouldn’t have ever got to that point had the auditor not escalated the situation in the first place.

      Careful, that actually might be a benefit to the officer. If you quit, you are generally ineligible for unemployment; however, you may have a case for unemployment if terminated. It’d be a long shot since they would terminate with cause, but I could see any little mistake being used to allow for unemployment benefits. Additionally, being fired with cause is simply not a barrier of entry for another police job, as evidenced by the fact that “problem” cops often end up passed around multiple departments, changing hands once they also have an issue caused by that LEO.

      What got me is the way pepperoni pizza guy deployed his Taser. Self defense in regards to weaponry as covered under the 2nd amendment requires the individual to prove their perception of imminent threat of death or great personal injury as well as having attempted to either verbally or physically de-escalated the situation if an opportunity to do so was presented. The fact that he physically got in the one guys space can be considered an act of aggression which can disqualify self defense as a viable option.     Dude was 100% told to resign and was referred to another department. Nothing comes from these incidents besides the officer having to pack up and move on to the next community to terrorize. The united states courts need to take these incidents much more seriously and treat police officers like this one with the same swift justice they enforce on every other tax paying citizen. That is the ONLY way we get the bad eggs out for good.

      And such internal investigations need to be open the the public so everyone can see exactly how the individuals involved reached their conclusions. None of this "no evidence of wrongdoing was found" should be allowed unless the investigation was clearly done properly and a subject of record.

      Tyler King, Very well said and an excellent point. I agree 💯% and I very much appreciate the civility you said it with. So many people today either get belligerent or violent whether they are right or wrong, both in the video and in many of these comments. But as shown in the video the guy was within his rights but his disgusting mouth and not letting the deputies do their job, is probably the reason they called for the Sargent.

      Mr. Roberts gets an F for intentionally instigating a first amendment audit without understanding property law and ownership of easements. It is completely expected that a chance encounter with the police may result in some factual misunderstandings surrounding the law by the auditor in question. However, Mr. Roberts was clearly seeking a police encounter and was fundamentally wrong in the law and the rights it would provide in the specific circumstances in which he was seeking the encounter. While the money Mr. Roberts gets from his CZcams may be a secondary benefit, it still makes him a paid professional auditor and he must therefore meet a higher expectation of conduct just as we expect from the police.

      Sheriff departments are highly political organizations owing to the fact that the Sheriff is an elected official. Given this fact they are packed with political hires by the party the Sheriff ran under. The only real 'qualification' for employment is that you vote for that party! As such the quality of the officer they employ has nothing to do with whether the person is qualified or even of moral character.

    in the UK Breach of the peace is not an arrest-able offence.
    You can be arrested to prevent a breach of the peace. Once you are move from the area you will be released.

    As a security contractor it’s astounding how many of my clients need to be reminded the legalities of filming in public. It’s always awkward when a client orders you to “stop someone’s filming” and you have to instead sit them down and professionally explain why what they’re doing is completely legal.

      @@11274reece Honestly, it’s mostly just ignorance from my experience. They simply just don’t understand that public eye=the right to film. Once I explain establishing “a reasonable expectation of privacy” such as installing blinds or even solid perimeter fences that can’t be filmed through they usually understand a little better. But I’ve definitely had clients fly off the hinge at people recording before.

      Legality of the action of filming has nothing to do with this bullshit. Instead of finding a productive place in life, these people point there cameras in hopes of a negative reaction. So one must ask themselves, why purposely set out to do things that they know will incite panic, annoy people and waste the time of law enforcement.       I worked security at the mall- it was my first time working security (side note never work at a mall unless you getting paid 30k an hour lol) and we were told (and I saw it in the rule books) that ppl are allowed to film inside and I was like huh? No way why?? Bc i was baffled. They explained to me how it has to do with “terrorism” bc it’s a hot spot for possible terrorist acts and also bc of “theft” which I’ve actually seen first hand dumbass ppl recording the layout of stores and where the merchandise is so they can study where and when to go hit up a store. Although it kind of made sense after hearing that explanation I was still very hesitant to tell ppl not to record when they are clearly just making an innocent (but also ridiculous) tiktok video or something lol I’m just curious- is it legit? And within our right to tell them to stop? Or were they legally still allowed to regardless of us asking them to stop? Even tho I don’t work there anymore I know I shouldve know this.. regardless of the law (within reason) I still have to uphold the rules of the mall bc that’s who we worked for. Im not saying I’d ever do something violent or illegal just bc they told me to but I mean non threatening things.. idk if I’m making sense but any thoughts?

      The reason it is, is because police can detain you for suspicion of a crime, and you have to comply with that. If you resist a lawful detention, even if the investigation clears you of other charges, you still committed a crime by resisting.

    The cop threatening to arrest instead of politely requesting the allowance of pursuit of investigation is a false de-escalation. He literally threatened the guy instead of starting with a polite request.

      Filming in public is just so creepy. No one likes some random camera pointed in their direction and he was doing it to prove a point that he CAN do it. The problem is, not one wants to watch a video of someone taking a video of a building. They WILL watch a video that ends up like this for enjoyment purposes only.
