      Thanks! I tried to get caregivers pay, since I am service connected and I am 100% disabled due to injuries from war. And they won't let me have it, because I was discharged out before 9/11

    70% mental, 60% various physical conditions, with a grand total of 90%. They gave me individual unemployability because primarily on the mental, but did factor in the physical issues and consider me house bound. April 2022 will be my 4th payment for the the IU and housebound. I have yet to receive any information on my limitations and what housebound is considered through the VA. Im still able to move around but it hurts, and being in crowds I often spaz out. Being housebound am I no longer capable of going to the grocery store? If so how do I get my food? Being housebound how am I suppose to see the doctor? Being housebound does that mean I have permission to push my friends and family completely out of my life because I can no longer visit with them? Being housebound does that mean I can't go to my little fishing hole anymore? It's all very confusing and the VA being so vague about everything, and the pandemic making it even harder to get any live information about it, makes the mental health situation even more stressful.

    Dad was 100% disabled, mom receives DIC and Aid and Attendance. Her condition is deteriorating, and as her son I take care of her. I can't work anymore (3years) can't even grocery shop for over an hour. Can mom get this SMC. We also need a grant to fix the house for VERY sick folks (heart). I really need some help! NOWAY mom is going to a facility if it kills me!

      Since no one responded to this, I will to the best of my knowledge. SMC rates are attached to the servicemember. It would not pass on to your mom.

      Your mother can't get SMC but your father may be able to. This is especially true if his conditions are 100% service-connected and he has other service-connected conditions that equal up to 60%. However, in order to receive this he will have to either apply for it himself (doing it himself, with the help of a attorney or through a veterans assistance program) or assign you as his power of attorney with the VA to apply on his behalf. If you are assigned as his power of attorney then you will be able to fill out form 526 EZ to apply for his SMC.
      I'm not even sure that the above is entirely accurate but it's close and should put you on the path of getting things done. I understand wholeheartedly how you may feel as I'm almost the same boat-taking care of both my mom and my father at the same time and desperately trying to keep them out of assisted-living or nursing homes! I'm getting ready to apply for SMC for him as well and this is what I was told. I wish you luck!

      @CCK_Law  Před 3 měsíci

      Hello! Housebound benefits, part of SMC, are not meant to compensate a veteran for the effects that their disability has on earning potential, but rather for non-economic factors such as personal inconvenience, social inadaptability, or the profound nature of a disability. Check out our blog on VA Housebound Benefits here: cck-law.com/blog/va-housebound-benefits/

    How do I apply for housebound

    • @CCK_Law
      @CCK_Law  Před 7 měsíci +1

      Hello!
      VA should automatically grant Special Monthly Compensation if a veteran qualifies for it, especially if it is based on ratings. So, while veterans should not have to apply for SMC(s), they may need to let VA know that they are interested in pursuing it to help ensure that it is properly addressed. Veterans may also fill out VA Form 21-2680, Examination for Housebound Status and submit to VA.
