      Citizenship is through a parent or granted by a court. If neither applies, you are an immigrant, legal or illegal. But citizenship should not be the issue for SS when he paid into the system for 50 yrs.

      He never served in the military. He applied. He got a social security card probably because he was in his dad's home state, looked like a regular white kid from the area, gave them a school ID and got an SS#. His dad never applied for citizenship for him. A big "oops", so a bureaucrat later realized he didn't have status as either a legal foreigner or a citizen, so he has to clear that up by getting his dad's records. That's what probably what happened.

      The IRS doesn't create federal laws. Congress does. The one woman said the laws related to this changed over time. The public has been programmed to obsess over executives and not care who is in the legislative branches -- the most important of the three branches.
      If this guy held a security clearance while in the military, he should ask them to go through archived records. Back then, foreigners weren't eligible for one. Investigators would have documented that he's a US citizen. It's interesting that he applied early for SS benefits and kept old driver's licenses and ID cards. Maybe he's known he never had US citizenship and would run into problems someday.

There are eligibility requirements (such as father living in the US for at least 10 years before the child’s birth) and it has to be applied for. His father should have done that.     What is blatantly missing in this discussion is his birth certificate. Being born in Canada automatically makes him a citizen. Moving to the US his parents would have to apply for his American citizenship. He wasn't born in the US and his father was living in Canada for the most part. Birth Certificates are required for primary education, drivers licenses, social security number, marriage licenses, joining the military the list is endless. Why has he saved all of the old drivers licenses and voter registrations? That's because he knew and New York/New Jersey is also responsible for this mess. Since the US has a tax treaty with Canada this guy can receive his full Social Security once he moves back to Canada. All of this could have been avoided if the immigration rules had been followed.

      The fact that the feds are accusing him of not being a citizen ONLY after he asks them for his money back, per their contract with him, tells you that he is absolutely a citizen, and the feds are just looking for an excuse to swindle him. If he weren't a citizen, that would've come out a LONG time ago, such as when he enlisted. It is far too convenient that the moment he's eligible for social security benefits, suddenly he's "not a citizen." If the yotes and terrorists crossing our borders illegally can get benefits the moment they invade, this good American man needs to be given what he's paid into without questioning where he's actually from.

      His genealogist is likely acquiring school records, tax returns and other proof that his father was not only born in the U.S., but spent the first 23 years of his life in the U.S. (as evidenced by the 1930, 1940 and 1950 U.S. censuses).

      @@ducknorris233 A "natural born" citizen requires his father or mother to be born in the US. Otherwise, I'm not really sure. For any person to be born to an American though, born or otherwise, should make him an American. There is no legal distinction between an American born in the US and one born outside the US as far as one being more "real" than the other. A US citizen is a US citizen. The only difference is that a citizen that was naturalized (not born here) can have his citizenship taken away for specific crimes. In this man's case though, that's not really relevant. He was born of a US citizen and is therefore a US citizen. I think it would be insane to have any law that states otherwise and I don't believe on exists. (Although I could be wrong, it seems like that would be illegal for such a law to exist).

      SS has screwed people before. I've seen stories where people found out they were marked as "dead" when they tried to apply for SS. They went through hell trying to prove that they were still living. When the SS department screws up, they make you jump through hoops no matter who you are.

      The problem is there is no proof of that. He could be illegitimate or his parents could have lied, etc. Very difficult situation. He already has a Social Security Number, he's been allowed to pay into the program all these years, he was allowed to vote, and he was allowed to serve in the Marines.     I had the same problem when I applied for social security. Their records stated I was not a citizen because their computer data showed I was an alien. I was born in Germany when my father was stationed there as a soldier. My mother was a naturalized American. I represented my report of birth of us citizens and my certificate of US citizenship. It still took several weeks to resolve. They stated that unless I resolved it. I would not get social security and they would reimburse me of just the money I paid in. Thank my parents to have the foresight to get the documents I need when I was born and my certificate of citizenship. Oh by the way I served 26 years in the Air Force and retired as a Colonel.....

    A good attorney can help him. This happened to my Great Grandmother. She and her husband were led to believe they were citizens after they came from Canada in 1929. In the 60's when she retired she was informed the company that brought her and her husband here never finished the paperwork. She voted, she paid taxes, she worked and raised a family here. But they allowed her to become a citizen and paid her. He needs a better attorney.

    A child is considered a U.S. citizen so long as one parent is American no matter where the child is born according to a statement on the IRS website. The same happened to me when I was 21. This should get cleared up within a yes for him. Darn shame though.

    When I was 17, I applied for a Passport to go on a trip to Europe. I was born in Germany, my mother is German, my Father is American and was in the Military. I was lacking a government form from the Army proving birth of a child to an American abroad. Otherwise, my father would have to prove he was American with a very long list of items they wanted, which were almost impossible to obtain since the town he lived and was born in was destroyed in a flood in Pennsylvania. Long story shorter, I found the form in our attic, after sweating for several hours in the heat of the attic. Got my Passport!

If he wins, he gets his benefits, at most back dated to when they should have been paid. He still has to pay for all of the legal expenses.
      The government will try to keep the case going fighting him. The government has unlimited resources to fight and the government has no concern about passing away. The government can fight as long as it takes. They fight not just to avoid paying him, but others like him. The government has nothing to lose.
      Your comparison with police wrongdoing is great in theory. The problem is that the law allows police misconduct to be compensated with attorney fees. Attorneys line up for these cases because everyone can get paid.
      Social Security benefits, with very few exceptions, you are on your own for legal fees. He could fight for 10 years and win, and spend 20 years of benefits paying attorneys.

      Sounds like his grandfather was native born, but his dad might have been born overseas, and was raised overseas. In those cases, the grandkid would not have automatic citizen status if they were also born abroad. He needs to get a congressman to pass a special bill giving him his citizenship.

      That's not how the law worked when he was born. The citizenship laws have been continually changing. Back when he was born in order for your children to automatically gain US citizenship a US citizen had to have continuously lived in the US for a 10 year period after their (IIRC) 14th birthday. Living continuously meaning no time abroad longer than (IIRC) 6 months.
      This is also the same law that tripped Barack Obama up, since he used to claim he had been born in Kenya and because his mother moved abroad before she was 25 her children would not then gain automatic citizenship unless they were born on US soil.
