Defendant is of course shocked and has no idea what the judge is talking about it. If I recall the judge advises her to turn herself in and get that warrant taken care of. Landlord/plaintiff and plaintiff's attorney is on stream. Next hearing Judge Middleton explains that the issue was sorted when (if I recall) the very confuzzled defendant went to the sheriff's department to turn herself in. Turns out the person with the warrant had the exact same name, first middle and last, and almost the same birthday...like the year was a bit off. Judge Middleton apologized and made sure to explain the situation with the plaintiff/attorney on stream so they'd know their defendant never actually had a warrant.
This is why you should verify the identity of the parties before you start. You can't just confirm part of their name. You need their full name and address.

It seems they used a name similar to mine that they looked up. I had to finally ask for the manager/owner to straighten it out. They were calling about da delinquent bill.

The attorney filed paperwork for the correct person, the judge made the misidentification which lead to the wrong person being brought before the court. It wasn't a prosecution it was civil. Finally they didn't continue, the judge suspected something was a miss and questioned it.
This is frightening. People could be locked up for no reason just because folks do not do their due diligence. There was a note on the proof. The lawyer needs to get a grip ! She accused someone of breaking the law and had them held for no reason ! Wouldn't the lawyer have checked for identity ? This is why middle initials and dates of birth are important. Same 3 names, except his first and middle were swapped from mine, he's about 20 years younger than me and lives in the next county over.
There were no false papers. The judge just saw the name and assumed it was the person with that name in jail and had her brought in. He failed to verify her identity adequately. The mobile home park did nothing wrong.
That isn’t what happened and there are no damages. Being woken from a nap in a jail cell and moved into a room for a zoom hearing, in the same jail, doesn’t have any financial cost associated
