    I remember a while back, like a year at least, maybe a couple years ago, there was a landlord/tenant defendant and Judge Middleton said 'by the way Ms. Defendant, there's a warrant out for your arrest'. Defendant is of course shocked and has no idea what the judge is talking about it. If I recall the judge advises her to turn herself in and get that warrant taken care of. Landlord/plaintiff and plaintiff's attorney is on stream.
    Next hearing Judge Middleton explains that the issue was sorted when (if I recall) the very confuzzled defendant went to the sheriff's department to turn herself in. Turns out the person with the warrant had the exact same name, first middle and last, and almost the same birthday...like the year was a bit off. Judge Middleton apologized and made sure to explain the situation with the plaintiff/attorney on stream so they'd know their defendant never actually had a warrant.

    This is why you should verify the identity of the parties before you start. You can't just confirm part of their name. You need their full name and address.

      That's why some judges ask for the defendant's entire name. I know Judge Bryant does.
      I had a nursing home calling me for a patient's relative. It seems they used a name similar to mine that they looked up. I had to finally ask for the manager/owner to straighten it out. They were calling about da delinquent bill.

      ​@@Shakaiharp Only two people in that video had responsibility to find the right defendant. She was one of them, and we saw zero sign that she cared about getting it wrong, or the stress that the lady felt as a result of the accusation. How would you feel if a judge was threatening to make you homeless? The attorney showed zero humanity, and the best defense she has is the one you argued. Blame it on the judge, right? There's no reason the plaintiff should know what their customers look like, is there?

      Currently in litigation with family over my grandpa's estate. Grandfather was the III and his son the IV, and his son the V. It's caused so much confusion in court.

    The fact ms strong was rolling her eyes and making the yea right faces, just to have the judge ask the righr questiins that she should have asked makes it even funnier. Hopefully ms strong just learned a valuable lesson poor detective works bites you in the backside. Also if you listen, the aunt is in a care facility and the rental company wants to sue for back rent on the trailer space. Next move will be to say, give up the trailer and we will call it even so they can rent it out. Very common tactic.

    This is a disgusting display of two people not doing due diligence before a proceeding. This "attorney" should be subject to a formal review. This is not acceptable regardless of the name issue.

      The lawyer wasn’t the one who made the mistake in identity. That was the jail and court clerks. They saw the first and last name, but didn’t see or notice a middle name or DOB. It’s also not like the woman was accused of mass murder or something.

    I appreciate the Judge is lied too daily. Attorney Strong who provided "proof of service" to the court is who holds responsibility for this. The Judge who is on the record for official court records is attempting to clean this mess up, due to the actions of Attorney Strong. Just my thoughts

    This stuff happens a lot. It’s more of a flaw in the system than negligence. If they were all required to read the full names and confirm that’s their name before proceeding. It would help cut down on errors like this.

    for info I've seen the conclusion of this case. the Aunt is in a care home, her daughter Heidi is squatting, and owes a lot of rent. Judge middleton gave a 10 day possession order, leading to eviction, I think 2 days ago

    Sounds like there should be a review of the attorney Casey Strong. If it's not the same person, why continue with the prosecution?! We citizens ask our public servants to do better...

      The attorney filed paperwork for the correct person, the judge made the misidentification which lead to the wrong person being brought before the court.
      It wasn't a prosecution it was civil.
      Finally they didn't continue, the judge suspected something was a miss and questioned it.

    This is frightening. People could be locked up for no reason just because folks do not do their due diligence. There was a note on the proof. The lawyer needs to get a grip ! She accused someone of breaking the law and had them held for no reason !
    Wouldn't the lawyer have checked for identity ? This is why middle initials and dates of birth are important. If they knew the defendents dob they would have realized this woman is not as old as her aunt !
    She might actually have reason to sue the judge, court, lawyer, mobile home park for false identification, defamation and embarrassment as this is on yourube. The fact she is in jail for a probation violation has nothing to do with the misdentification

    Welp...mistakes happen even in the Technology driven year of 2024! In all fairness, this particular case turned my Moan-Day back into a doable Monday! The "Mistaken Identity" in the title LoneWolf peeked my interest. I immediately thought okay...no real drama or awful circumstances, just a good old fashioned OOPS! 🤣 And then Judge Middleton's "Disregard everything I have said to you" and he even apologized for disrupting her as she waited to get out of Dodge with her PO Bobbie Jo! This was a nice break in the norm LoneWolf and MOO From COW-lumbus, Ohio....The Armpit Of The Midwest! 👋😊

    Had something like this happen when my wife and I were adopting our daughter. County showed up for the interview thinking I was someone else. That guy has a rap sheet a mile long for drugs, assaults, and other stuff, obviously someone who doesn't have any business trying to raise a 1yr old. Same 3 names, except his first and middle were swapped from mine, he's about 20 years younger than me and lives in the next county over.

      There were no false papers. The judge just saw the name and assumed it was the person with that name in jail and had her brought in. He failed to verify her identity adequately. The mobile home park did nothing wrong.

    They can’t double check a name. Other cops around the country can’t double check addresses and swat wrong homes. If “ officials “ took a few moments to make sure, lots of unjust actions would be avoided.

      it's a local coloquialism in the southern US. It's intentionally mispronounced "conversatin'" or "converstaing". But you are correct, outside of this niche language pidgin, the proper grammatical form would be "conversing". In particular, "conversating" is the act of conversing on subjects that do not work to progress a conversation forward. A form of informal small talk or gossip session. Welcome to reading spoken word style writing... I would be remissed to not also point out that, technically, although not commonly used, conversate can be formed as a gerund or present participle in the form of conversating.

    Everyone talking bad about the judge should realize that he was trying to save her from missing the hearing which would have granted a default judgment to the plaintiff. If you can't see how 2 family members with the same name got mixed up while the judge was rushing to help her out then there are probably a lot of things you dont understand, like tying your shoes or wiping your butt...

      Looking at the comments, I don't see "everyone talking bad about the judge". But we should be somewhat harsh, because he talked over her several times when she was correcting his mistake. We understand why, but it's also entitlement, and sometimes you get burned by that. We also appreciate the good effort he was making, and just as much we appreciate his apology.
      Did you notice how the attorney didn't even apologize? She expressed that she was worried about herself, not the woman she was trying to erroneously evict... That type of selfish behavior is par for the course in legal matters, and compared with her, the judge showed a modicum of dignity.

    Sorry Lone Wolf - there is no such verb as conversating. The verb is converse and becomes the noun conversation. I have to say because I am hearing this over and over and it drives me crazy!

    It was the judge who said that's the person we have in jail, it the attorney, the attorney believed the judge brought the person she was seeking.
