  • democracynow.org - We broadcast from New Orleans, Louisiana, the heart of the world's prison capital, where more people are behind bars any other state per capita -- an incarceration rate 13 times that of China. Louisiana also ranks among the highest in the country in terms of the number of people per capita who are exonerated after serving years in prison for crimes they did not commit. We are joined by Henry James, the longest serving prisoner to be exonerated in Louisiana. James spent 30 years in the notorious Louisiana State Penitentiary, known as Angola Prison, on a life sentence without parole for rape. At trial, the prosecution never told the jury that serology testing from the rape kit excluded James as the perpetrator. In 2011, DNA evidence found by accident proved James' innocence, winning him his release. We also speak with Emily Maw, director of the Innocence Project of New Orleans, which helped win his exoneration. "Henry James' case is unfortunately atypical. Everybody in Louisiana who is convicted of murder or rape gets sentenced to life without parole, there is no other sentence for those two crimes. What is atypical about Henry's case is that they found the evidence," Maw says. "In Louisiana, as in many places, evidence storage and preservation practices are atrocious. People lose evidence all the time in cases where DNA testing could prove their innocence."

$25,000 a year is in on the poverty margin. So not only did he busted his ass everyday for 30yrs, incarcerated for 30yrs. All he gets is $25,000 a year over a crime he never committed. The only thing his life is worth is living, sleeping, and breathing in poverty.

why is it that Angola prison has so many prisoners that are innocent, who is running the courts that are procecuting these innocent men, isnt anyone liable here,is there any justice for these men?We can't continue to let the justice system get away with criminal activities, someone has to be made accountable so that when the next procecutor or judge gets a case and they know the guy is innocent they will do the right thing and not continue with the case and throw it out because to continue with it will mean tbere taking a chance of going to jail themselves,,doesnt that make sense?

I'm so fucking angry at what they did to Mr. James! Took 30 years of his life and he didn't do the crime. He deserves compensation for ALL the years he was locked up, not just 10!

Shame he was probably not knowledgeable at the time also what a damn hot mess they say 30 grand is the highest compensation you can receive but even that’s denied for many prisoners with the same situation how horrible.

I think that’s what the state is allowed to compensate someone but if the wrongfully convicted sues they’re compensated whatever the jury deems
I hope he sued and got enough he never has to worry about $ again because he certainly deserves it
