After 4 Decades in Solitary, Dying Angola 3 Prisoner Herman Wallace Freed, Conviction Overturned

  • www.democracynow.org - A dying prisoner has been released in Louisiana after serving nearly 42 years in solitary confinement, longer than any other person in the United States. Herman Wallace, and two others known as the Angola 3, were placed in solitary in 1972 following the murder of a prison guard. The Angola 3 and their supporters say they were framed for the murder over their political activism as members of one of the first prison chapters of the Black Panthers. In a surprise development on Tuesday, Wallace was released from prison after a federal judge overturned his conviction, saying he did not receive a fair trial. Wallace, who is near death from advanced liver cancer, was taken directly to a New Orleans hospital where supporters greeted his arrival. We are joined by three guests: Robert King, who until Tuesday night was the only freed member of the Angola 3 and helped deliver to Wallace the news of his release; Wallace's defense attorney, George Kendall; and Jackie Sumell, an artist and Wallace supporter who is with him at the Louisiana State University medical center in New Orleans. "This is a tremendous victory and a miracle that Herman Wallace will die a free man," Sumell says. "He's had 42 years of maintaining his innocence in solitary confinement, and if his last few breaths are as a free man, we've won."

      Criminals like this must be dealt with swiftly and harshly for murdering guards or else every prison guard in the system would be dead within a day. Solitary is the prison within the prison. The judge overturned his conviction, NOT ruled him innocent. Big difference. He was convicted of the robbery and very very likely participated in the murder of the guard.

      Delroy Craine I can't even imagine. That's just inhuman. Check out "World's Most Dangerous Prisons" on Netflix and look up the one from Norway. Here in Canada, our prisons are pretty lax, but I believe that everyone should adopt the Norway method.

    Odd how this man spent 41 years in solitary confinement for a murder that even the dead man's widow didn't believe he committed! These men were exonerated more than once only to have these charges brought back up repeatedly, their rights were stolen several times! His original crime wasn't murder was robbery and he was only 17, he joined the Black Panthers for solidarity and protection, which only made matters much, much worse! My entire soul is grieved, I'm familiar with this story and the racist comments just boil my mental. No person deserves this treatment, as they lay dying already. Why cavity search somebody who because of the nature of their disease, can barely hold solid stool? Despicable

    Perhaps this sounds trivial. I am very familiar with cases of wrongful conviction. As Herman Wallace we being taken from prison to the hospital, again I was hanging my head in sorrow and shame, and then all of a sudden the crowd started rejoicing at his release. What was there to be joyful about? This man's life was taken away from him. The judge did the right thing. He allowed Herman to die with some dignity, that of a free man. But to rejoice as if this was something to celebrate? Do these people have any perspective? I found this bewildering.

      These three men are murderers, dangerous and admitted members of a known terrorist organization. They should have been executed upon conviction. Prison wardens are responsible for the safety of the public and are prohibited from releasing any inmate if that inmate posses and imminent threat to society. These men were all admitted members of a terrorist organization. Such membership constitutes an imminent danger to society therefore he had no choice but to keep him confined.

    No he's not a free man , He stayed in a prison cell for 42 years and now will likely spend the remainder of his life in s hospital for cancer treatment. That's not free. He's basically spent his whole life in an institution. Whether it's a correctional or medical.

    In Greece, lifers get parole after 19 to 25 years (depending on the crime) in prison. No-one can be sentenced to life in solitary confinement, there is no such penalty. And just like all EU countries, we have abolished the death penalty (last execution was in 1972). We may be half bankrupt, but at least we're a country with humane laws.

      In Greece, as well as in several other EU countries I believe, lifers and all those who serve long sentences, after 5 years are eligible for 5 day leaves every 3 or 4 months. Provided of course that they behave themselves while in jail and they don't violate the terms of the leave. There have been incidents of running away of course but they are very rare and sooner or later the escapee is recaptured. But in general, it is a very humane institution, which is very beneficial for the inmates, the prisons and the society as a whole.

      Many countries - about half of them - have abolished the death penalty and other inhuman punishments such as life imprisonment in solitary confinment, non-release until death. But such practices do not happen only in China and N. Korea. Iran, Saudi Arabia, Singapore and many others are also in the top list of Amnesty International for their horrible intolerance and absence of leniency.

    Justice is only to be released.... NO!!!!Everyone involved in their conviction and torture should endure the same if not worse punishment from the judges, jurors, prison guard's and especially the wardens...     Here's something to protest and riot about! We live in a time where people are so concerned with self that problems like this will never be fixed. Slowly prisoners will be forgotten all together and the abusive system and cruel and unusual tactics will continue and grow.     Judges that had down sentencing like this should be sued and held responsible for the actions and disbarred. This man suffered and the others as well and now they want to free him from a wrong judgement put upon him and he's dying at the same time. May the good lord bless his soul.
