Not really. It's up to the judge to grant him an appeal or not. And usually nobody gets an appeal if they can't prove the case was mishandled, or prove that there is new evidence to present.

So this is civil case not a criminal case. She sued him and there was enough evidence to justify a payout. Separately the government would try him in a criminal court for sexual assault. She has no say in that. Now there could be a few reasons why he isn’t in jail: statue of limitations expired, not enough evidence for a conviction, or bribery.
